From what I read Poland don't actually want to leave the EU and The EU can't kick EU member out.

Really? There are always ways to find. The first ones are juridical ones. If the Europen Court for Justice deems that Poland is wrong with its verdict, they will have to retract it (the first part of that verdict is expected next week). If Poland still denies this, then the other EU-countries have a right to disband their cooperation with Poland, 'cause if you are a member of an organisation and you're want to play with different rules, the usual consequence is that your membership is revoked. The second way is to organize a referendum in countries asking whther the local population still supports the notion that Poland receives one euro of the tax-payers of that country. If the answer is no, you go with that result to EU-council and demand that Poland receives no more money from the tax-payers of your country. If enough countries do this, then Poland gets no more money from the EU. I wonder if Poland decides to stay, if that's the case. And these are just two examples.

@@dirkgonthier101 you are wrong, the European court has jurisdiction only in cases where the member state surrendered its sovereignty. Rule of law is not defined, it is not against any law to appoint judges and so on. It is only some other member states’ opinion that it is not correct. In cases like education, migration, abortion, religion and so on the EU has absolutely zero say. You also have no idea about the cohesion funds, that is peanuts compared to the profit exported from Poland to Germany France and so on. People, read some studies before you comment, it is seriously frightening to see how uninformed many of you are!!!

@@nyali2 That's wrong. The Human Rights are the legal framework under which the EU works. You're right, many competences still belong to the member-states (like: education, foreign policy, defence, social programs and so on). But the member states need to accept the Human Rights in working out their policies. Austria had an EU-delegation over its floor, when the government chose to work with the FPO of Jorg Haider to check if the human rights still were respected in Austria. This was the case. So is also the rule of law one of the cornerstones of the EU. Certainly it isn't a problem to appoint judges. Every country does that (in its constitutional court). But it becomes a problem if the independence of the juridical branch comes into jeapardy. Because, then you don't have an independent legal branche anymore and the state can influence the verdicts of the courts (like in China and Russia can happen). Besides, the discussion doesn't go about that anymore. It's the Polish decision to make its own constitution weigh heavier than the ECJ. While, when you become a member of the EU, it's clear that the ECJ is the highest authority in legal matters within the EU. It is that simple. For the moment, we're all waiting on the ECJ-ruling concerning the objections that Poland and Hungary made against the new (since the beginning of this year) directive of the EU concerning the rule of law. If the ECJ follows the EU, the EU will be able to block all EU-funds to Poland and Hungary. This ruling is expected this week. We'll see what it says.

@@dirkgonthier101 the EU court is as independent as its Chinese counterpart. Obviously any ruling regarding a conservative country was made before it went in front of the judges. The European court has no superiority, only in cases where the treaty grants it. Human rights and democracy are basic pillars, but it is very hard to define the boundaries. Do you think for instance that Brussels’ attempt to overturn conservative governments is democratic? Are they respecting the Hungarians democratic decision? Or are they respecting art 14 section 3, when they are not distributing COVID recovery funds due to an unrelated education bill?

@@nyali2 That may be your opinion, but every legal mind that I hear, tells me the opposite. Even the conservativbe supreme court in the USA didn't follow Trump in his claims of election fraude. Human rights are a treaty. That means that what they mean is written down, just like constitutions. There are disputes over it and they go before the ECJ. Brussels is not attempting to overthrow conservative governments. Ursula von der Leyen is a CDU-politician, thus of a conservative party. Charles Michel is a politician from the Mouvement Reformateur, thus a conservative party. The only thing that occupies Brussels is the correct compliance to EU-rules. If everybody follows them, it isn't too much to ask that Poland follows them too. For the rest, Brussels doesn't care which government sits where. As long as it follows the EU-rules, subcidies will continue to flow. As example you can always look at the two Austrian governments with parties of extreme right signature as a part of them (one with the FPO of Jorg Haider, the other one with the FPO of Heinz-Christiaan Strache). There never were problems with one of these governments and Brussels. Poland and Hungary are two nations that don't follow EU-rules. If you don't follow the EU-rules, you can't expect of the EU that the subcidies flow as usual. Both nations knew this on forehand, but they both stuck their middle finger up to Brussels. A reaction is bound to come. At the moment, we're waiting on the ruling of the ECJ about the objections Poland and Hungary made against the new directive of the EU (since the beginning of this year) regarding the rule of law. If the ECJ follows the EU, the EU can block as good as all EU-money to Poland and Hungary. This ruling is expected this week.

The Polish Constitutional Court has only confirm that EU law has primacy over national law only in areas delegated competence. The transfer of competence by Member States does not mean that their sovereignty is lost to the EU. It is contrary to the Polish Constitution for EU institutions to extend their competence arbitrarily.

The current neofascist leadership is willing to risk all that in its attempt to subvert the polish legal system to subservience to it. A good dose of economic implosion will humble the wannabe Mussolinis of the ironically named Law and Justice Party and the resultant economic vulnerability whilst being next to Revanchist Russia would seem an apt punishment.

Poland also pays contributions to the EU like every member state, a.thirdly, 80% of this money returns to Germany and France, because Poland was sold out to them before 2015 so it is not actually win win for Poland.

Of course, it is a political issue NOTHING more. In 2004 when Poland joined the Eu, the Polish PM was Marek Belka from the Democratic left Alliance. The PM of Hungary was the awful Ferenc Gyurcsany of the Socialist Party. They were in agreement with the leftist PMs of Western Europe and the Eu, so NO WONDER, it worked well. Poland and Hungary became populist when Western banks and businesses swooped in and made a killing (such as on student loans) , picking up factories for pennies. Also, there are 9 EU countries that have more rule infringements than Hungary and 3 more than Poland.

Well...the same law does not apply to certain members of State (Germany, France). Poland is growing rapidly (faster than the main leading countries) which threatens their interest that's why Poland is being bullied by them. Why transport law has been changed in France? Simply because polish transport companies were too competitive and took their business. That EU is a farse now. There are no equal rights to each member. Appointment of judges in Germany and France. The court's judges are elected by the Bundestag and the Bundesrat (a legislative body that represents the sixteen state governments on the federal level).In France, judges are recruited through competition or on the basis of special qualifications (Doctor of Law). They are then appointed by the president of the Republic. Elected governments in most countries appoint judges (Canada and USA for example) . Are they more independent than in Poland?

Upon accession, the competencies were fixed, the laws were harmonized and mutually recognized.Then, over time, the EU stole powers and changed laws. If these laws contradict the original and valid constitution or exceed competencies then the PL constitution grills. It is not a question of PLEXIT.

What laws are you talking about. The EU is trying to block the Polish government from taking over the whole court system, which would in effect make the courts puppets of the ruling party. The only thing now standing in the way of Kaczynski's authoritarian ambitions is the EU. Those patriots talking about sovereignty are helping the ruling party take complete control over Poland, which will be the end of sovereignty.

This Guy from Warsaw is delusional, he forgot to mention that Polish judiciary system was reformed because there was a problem of communists and their descendants practically fortifying in the high court and constitution tribunal, not allowing any other judges to work there (only their family members or people of mutual interest/profit were allowed). Judiciary system needed to be cleansed, and current government is doing just that, by allowing judges from outside to replace those with ties to the era when soviets ruled over Poland, and to this day occupy most important branches of our judiciary system. Eventually we can slowly start to say that the court rulings in Poland are beginning to be fair, and the opposition like this guy, say that it was illegal 😂 (because government finally broke the decades long cooperation of communist sсцm!)

EU law per se does not exist - EU regulations exist but they are enable by national laws which means that national laws have primacy. The EU likes to pretend otherwise. The issue is that EU regulations are being seriously used by Brussels to create “mission creep”. The same has been true of the ECHR.

No, in the EU treaty it is clear that countries transfer 5 economic areas to the EU (of which Poland does not apply to the common currency). That is why the Polish Constitutional Tribunal judges that the EU exceeds its competences beyond those unallocated areas. More than 10 constitutional offices of other countries have previously issued such judgments, e.g. Germany, France, Spain, Romania, Lithuania and others, and Poland twice in 2005 and 2010.

This is a rule that every member-state in the EU accepts (cause they all know what they have signed up for) except Poland. So, Poland needs to leave. It can't be that the rules of the EU are applicable to all member-states, except Poland. That is testimony of utter arrogance from Polaand towards all the other member-states of the EU.

Anyone who is against Poland, are against freedom and democracy, in mind mental thinking you are communist and Marxist ( including Polish left wing opposition PO party) PIS conservative party is democratically elected Government in Poland and Polish Constitutional Court (TK) is defending Polish Constitution. It is EU attacking Poland not Poland EU., EU are self appointed bureaucrats who radicalize themselves to far left, only because they want to be in power forever and in every cost even cost even human lives and human poverty because instead resolving problems the taking about lefties ideologies. EU they claim to be so tolerant and equal but they attacking Poland because we are conservative and good honest people. PIS is pro EU and half of EU member states saying PIS has right, First Polish Constitution then later EU law , unless its about EU competences set out in the treaties. In the event of an attack on Poland's Constitution, chaos and anarchy may arise throughout EU, because it may happen to another country
