You're right by asking who started it. You can't be the aggressor and then claim self defense. In my opinion all 3 defendants are responsible for Ahmaud Arberys death

Travis' testimony was extremely helpful to her cause. She'd have had a much tougher task if he hadn't admitted to the two things that gave Arbery the right to defend himself... 1) Pointing his shotgun at Arbery prior to the confrontation at the front of the truck and 2) Having no knowledge of Arbery having committed a felony that day. The defense didn't have much to offer to counter that.

Gough is presenting a "vigorous defense" for his client... he just doesn't have much of a leg to stand on. All the motions for mistrial, keeping "black pastors" out of the gallery etc. is about all he can try. You can respect the effort even if you don't respect the arguments. The other attorneys are in the same boat, but they really haven't been as "vigorous" as Gough... it's like they're counting on the jury to sympathize with the "if you see a black man running... you know he did something wrong" mentality that so many Southern bigots have. We'll know pretty soon if they're right.

In this case the murder charge is excessive. Clearly they had no intention of killing Arbery. But their rash decision to become their own posse of vigilantes led to a very unpleasant outcome for everybody involved. They should indeed pay a penalty for their ill-advised actions, but life in prison for murder-one would be way out of line IMHO.

We see this happening again & again when victim is murdered so completely unable to defend themselves, insidious defence can then accuse victim of anything they like as deceased person cannot defend themselves. @@crand20033 yup, and multiple times caught on camera, everyone in the neighborhood seemed to be aware of Ahmaud and were concerned. There seems to be no evidence Ahmaud had ever actually “jogged” there. False alibi. Media narrative. Because if he was a burglar it blows up the states case.

It's been established AA jogged there often- that's why he was "familiar" to Greg/Travis in the 1st place. Regardless of what either side argues the Citizens Arrest Statute is, the McMichael's neither directly witnessed nor had immediate knowledge a crime was committed because NO CRIME WAS EVER COMMITTED (&, nevermind that to legally chase someone down for a proper citizens arrest, the "crime" committed had to have reached the standard of a FELONY!!) Before this case was even brought, the actual homeowner was asked about what the video showed, all the times AA had gone into the property and the homeowner said "He always went into the same spot, that back corner" when asked what was located in that back corner the homeowner said "I assumed he was accessing the water spigot" (this fact was inadmissible bc that corner was off camera, but it's safe for the homeowner to speculate this as the reason when the only thing back where AA always went was the water line) So that explains why AA had been seen so many times, going into the house, 2.5 miles into his routine "jogs" for a drink of water. Homeowner was told by PD if he had a problem w the traffic in the property he should post no trespassing signs (which would allow them to act, the next time anyone went into the property, but the homeowner, himself said he WASN'T at all worried about the curious passers by, BC he suspected it was the actual contractors HE HAD HIRED that were responsible for the theft of the equipment off of his boat, there. The cameras were sufficient & he declined to post a "no trespassing" sign, so the cops DID NOT HAVE ANY AUTHORITY TO ACT ON AA (NOR ANYONE ELSE) TRESPASSING... And so McMichael's sure as EFF didn't have the authority, either! (Btw, in CRJ 101 (@NU) we were taught that "Immediate Knowledge" meant if someone walking by witnesses a man hauling ass out of a park, holding a little kid & the mother following IMMEDIATELY behind him yelling "STOP THAT MAN! HE JUST KIDNAPPED MY 2Y/O SON!!!" That is "IMMEDIATE KNOWLEDGE"

@@geraldineallen8060 Arbery was not jogging. The ex-football player was running away as fast as he could after making eye contact with neighbor Mr. Albenzi who was on the phone with police. The felony convict probationer was in their neighborhood acting suspiciously and those two ex-cops wanted to know why he was running. They brought their guns because they thought he was armed. Then he attacked them because he didn't want to go back to jail.

"Who started it?" is a legal standard for self defense but using different wording. Basically if you provoke an altercation with someone you have lost the right to claim self defense.

The only one here who could’ve gotten away or had lesser charges was Roddy Bryan, had he turned on the mcmichaels and given the video to authorities from day one I see how he could’ve pulled the concerned citizen card but his statements were very telling and his own words sunk his defense… mind you he has the worst attorney here lol.

Roddie Brian gave the video up immediately, you can even hear him offering it to the officers on the bodycam footage immediately after the shooting. The problem with Brian was that he used his vehicle to pin in Arbery at the moment where Arbery could have escaped the Satilla Shores neighborhood. That's where Brian's defense becomes difficult. Prosecution says that Arbery might have escaped had it not been for Brian. And it seems that they are probably correct

Linda Dunikoski and her team was Phenomenal her courtroom performance is Awesome. I read her bio she is a assistance DA for the state. She was awarded several years for attorney of the year on several occasions. Judge Walmsley was Awesome he wasn't biased to either side. He had to excuse himself from the courtroom after repmending defense attorney to clam down

Will the jury get a history lesson that informs them that the wording of the citizen's arrest law goes back prior to 1863? Will they get a history lesson that tells them that if an enslaved person run away that person was committing a theft by stealing themselves because that enslaved person was considered property? it was also legal to use lethal force to stop an enslaved person who had run away. These three were enacting history while ignorant of history.

*One Big Question* Were the 3 defendants fully authorized to make a citizens arrest under the Georgia law, or were they not? Because if they were not, then all 3 are guilty of the charges. Simple as that. No matter what wonderful things the defense had said in their closing remarks about their clients, if they weren't justified in making a lawful citizens arrest, then all three are guilty as charged. Thats the bottom line. And since the citizens arrest law states that the defendants had to see the crime committed in their presence or have immediate knowledge of the crime in order to detain and arrest Arbery, then all three defendants are guilty. They had no knowledge Arbery had committed any crime on that day. Seeing a black man hauling ass down the road isn't a crime. But they wrongfully assumed he committed a crime that day simply because he was running. Flawed thinking by the defendants led to Arbery's demise. *Second Big Question* Was Travis M. acting in self defense when he shot Arbery, or not? Well, if he was not fully authorized to make a citizens arrest, then all his attempts to hold and detain Arbery made him the aggressor, causing Arbery to fear for his life. As the law states, Travis can't then claim self defense since he was the aggressor. Arbery, on the other hand, had the right to defend himself. The verdict will depend on how the jury will view these two questions. If they follow what the law states, guilty verdicts will be handed down.

We know damn well Travis saw Ahmaud at that house being built, called the police and said Ahmaud had a gun. **THAT'S ALL YOU HAVE TO SAY IS A BLACK MAN HAVE A GUN**. I have been saying there was no grounds for a citizen arrest/self defense claim since the video was released in Feb 2020. At most, all the McMichaels had as grounds is a misdemeanor charge in a citizen arrest, which is NOT grounds for a felony and chasing Ahmaud down, and this makes the McMichaels the aggressor. The McMichaels did not even have prior knowledge that Ahmaud had taken anything from the England house construction site. In fact, all they had was video of Ahmaud trespassing and NOT taking anything from the site. England even stated nothing was taken during the times Ahmaud appeared on his security cameras. England even said he did not know when the items stolen from his boat were taken or who took them, since he had moved his boat many times.

How on earth could this ever be self defence? Against an unarmed man jogging?? All he was guilty of was ignoring armed men chasing him, all he did try to avoid them! This was a horrendous racist murder, where perpetrators assumed this man was guilty of something purely on the colour of his skin!! Show the most horrendous underlying hatred!! These people are incredibly dangerous, the more so because they show no signs of regret, never attempted to give any medical aid!! Those are rare & very frightening combination in any person!!!

When Travis identified Arbery as the person he had seen days before he shot him, it may have been a lie. It seems obvious that after the shooting he had incentive to finger Arbery as the person he encountered earlier. That identification isn't a fact. It surprised me when Court TV correspondent Julia Jenaé stated as fact that Arbery was who "Travis had that encounter eleven days before". Yes there was testimony about that but that doesn't make it necessarily true.

Regardless of whether or not they go with either definition of the CA law, be it the defendants "immediate knowledge" was from 11 days before, or at that moment doesn't the FACT that AA committed no crime (as the homeowner's CCTV shows) destroy their entire defence bc they couldn't have "witnessed" nor had "immediate knowledge" of ANYTHING if no crime had ever occurred..

Last time I checked law enforcement and the judicial system work for the citizens and not the other way around. Here’s the problem with a think tank like this, they really believe they are higher power, they really think law enforcement is higher power and that the citizens are there to assist but last time I checked it’s the citizens and the constitution of the United States from which it all stems from. See this is why law enforcement and people that are hired to enforce law and policy fall short of “the people” because they think we should bow to what they think is written and not necessarily what is the intent of the written words. I really think our judges at the higher level have been rock stars because they’re faced by poor interpretations of the lower judicial rulings and the undereducated law enforcement mechanism that really puts a strain on the real interpretation of core law and what’s right for its people.

@@crand20033 The key word there is "former." Besides, even for a cop it's not the same thing. Probable cause is a suspicion and not knowledge. Probable cause would allow an officer to act but not a civilian.

The evidence was overwhelming against these three murderers, taking the law into their hands and being vigilantes. I noticed some dummies bring up Ahmad’s criminal past, like that has anything to do with this case. Also dummies seem to grasp at the whole “grabbing Travis’s shotgun” thing. The evidence shows Ahmad was shot before he ever touched Travis. The people who believe these three men were justified in this, will one day wind up right where these three guys are now.

Bryan was part of it, whether he committed the killing or not is irrelevant. Its like someone who takes part in a robbery with other people and one of those other people decide to kill someone. They are all still guilty of the killing.

The problem that I see is the question of whether or not we are looking at it from the perspective of these defendants two of whom are not average citizens but are formally trained well experienced police officers who, while they are presently citizens, don’t just lose the mindset and training that they operated in for decades. Therein, we are trying to bring in the argument of a reasonable prudent person but we are not looking at it from the perspective of a former police officer who has the training and experience that they do. Just because you are no longer the police does that mean you suddenly drop your habits and mindset. No you are not going out doing traffic stops. But, investigation, Terry stops, , Probable cause, you’ve been operating in that mindset for all this time, you don’t just forget that stuff. You don’t just lose that mindset. If it would have been good for the police, it should have been argued that from their perspective that’s how they were operating. So they believed their beliefs and actions to be reasonable based upon their experience education training and habits.

True. But their beliefs and actions led to a very unfortunate outcome, for which they and they alone are responsible. Never understood how someone could be suspected of stealing from a property under construction, especially with no vehicle for getting away, no bags or sacks to carry anything, and wearing nothing but shorts and a tee shirt and shoes. So how could they have a compelling reason to suspect Arbery was stealing something? What could possibly be stolen from that property, bricks and planks? Makes no sense. Although I'm no fan of the defendants in this case, to convict them of murder and sentence them to life in prison IMHO would be a real injustice. However, there are lesser charges involved, as far as I am aware, that they should be convicted for. Frankly, I can't see a sentence of anymore than 10 years for the McMichaels' (with parole in 5 years), and 4 years for Bryan (with parole in 2 years). A vigilante lynch mob is no more welcome if the mob is "woke" than if the mob were rednecks.

Travis was a mechanic who had some boarding officers training. Greg was a police officer who could not maintain his certification. These men were not highly trained as you want to imply. They are mediocre at best but they believed that they were acting legally.

@@franks.2544 There is nothing Ahmaud did on that day that can justify his murder. Long (toenails) is subjective, some people think my toenails are long because they keep theirs shorter than mine. I do a French manicure so I don't cut mine off completely and I am a jogger. Dirty/ clean toenails have no bearing on jogging. That woman has a dark heart like her clients, racist and full of hatred and she exposed herself, and I for one was glad. This was a hate crime, an innocent man who wasn't armed, hadn't been committing a crime, was hunted and gunned down for refusing to comply with Travis' orders. The nerve! Such arrogance! To think a black man has to take orders from you or else risk getting shot! ("Stop or I'll blow you efing head off") Look what their arrogance and pride has done to them? 3 families have been destroyed because we cannot respect one another and understand nobody is the boss of another citizen. If you don't see how your heart is dark for defending the actions of these people you are deceived and deceiving yourself. Seek the Lord while he may be found, he will remove the heart of stone and give you a heart of flesh. Otherwise you will condemn yourself to he'll fire. Prosecutor didn't have to prove anything. Video provided the verdict. Can't claim self defense when your the pursuer. They all know their going to prison. You can see that in their faces. Roddy hung himself giving that video to the police. As soon as travis shot that guy he should of erased that video immediately. He wouldn't be facing prison. He could have denied having anything to do with the chase. Foolish.

Isn't that what he said. Then he told the Police Officer on the scene he didn't know what Ahmaud had done So I guess he couldn't even get his on story right

Vinny, "who started this" O. K. Your shopping in a Mall. You've been in three stores where you purchased items. On the way back to your car your stopped by a store employee who wants you to stop and wait for the police. She suspects you of stealing merchandize. Your child gets out of school in 10 minutes and it'll take that and maybe more if traffic is bad. You tell her the truth that you didn't steal anything but she doesn't believe you and she places herself between you and your car door. ?? Were the Mc Michaels making a "Citizens Arrest" or did they ask Mr. Arbery to stop and wait for the Police? The Police Body Cam shows them stating, "we asked him to stop and wait for the police". No where in any video do the Mc Michaels state, stop your under citizens arrest. The only people making this claim are the "Prosecution Team" Hummm.

Maybe if you were chased, hit so hard you were thrown in a ditch, hit 3 more times by truck, pinned in with both, told by one of the 3 men folliwing you that he was going to blow your f***ing head off, then passed and blocked in "like a rat" and had a gun aimed at you when you ran toward the truck, then finally ambushed with the gun at the front of the truck. Maybe that would make you angry and you would turn to defend yourself.

Both Nate and his guess said she did very well. They gave her 8 out of 10. I would give her 9. They dropped it to 7 after she, according to them, dragged it on for like 5 mins too long.

You need to do away with Ahmaud was stealing from the neighborhood. Travis said he didn't steal his gun. Officer Rash told Gregory they had picture of the man who stole the woman 's purse. And the best one The Homeowner Larry English told them and Officer Rash on February 11 that Ahmaud had never stolen anything from his property. I wonder why they didn't believe him. Because if they did they wouldn't be in prison.

I disagree the video showed Ahmaud being chased by Roddys truck and then seeing Travis truck in front and Travis standing with his shotgun at the side of drivers door Ahmaud on seeing this ran to the right passenger side of the truck Travis then moved from the drivers side and went round the front of the truck pointing the shotgun as Ahmaud went past passengers door coming face to face with Ahmaud ! This action alone on Travis part is aggressor as he went towards the victim that is why you Can Not claim that action was self defence!

Arbury escalated the situation by trying to take the gun. If Arbury had just waited for the cops to arrive the only charge might have been trespassing. Arbury chose to gamble with his life.

NOT GUILTY. Travis admitted that Ahmaud wasn't INITIALLY a threat when he was trying to get him to stop. But then Ahmaud BECAME a threat when he attacked Travis in an attempt to wrestle the gun away. Travis had to shoot him at that point. If Travis wanted to murder Amaud he would have shot him before he even got close. The fact that he waited until Ahmaud grabbed the gun is proof that he was trying to avoid shooting him if he could. All Ahmaud had to do was stop and say "What is this all about?" Then wait for the cops to come and determine if he was the guy responsible for the break-ins in the neighborhood. It was totally legitimate for a neighborhood watch group to be suspicious of any stranger in their neighborhood when there is an ongoing problem with crime in the area. Anyone who defiantly holds on to the attitude that they have the right to physically attack someone who is confronting them over a suspicion is only endangering themselves. There is so much crime these days, suspects HAVE to be confronted. By cops or neighborhood watch groups. It's a necessity to keep neighborhoods safe and EVERYONE needs to understand and comply.

Wrong. Ahmaud did not have to do anything. He did not have to stop and tell anyone anything. He owed no one an explanation of anything. You are so way out there in your comment that it's unbelievable. Also, people do not have to understand and comply with neighborhood watch organizations or anything else. You are not the police. You are not the judge. You are not the jury. You are not the executioners. You did not make the rules. People are not required to go by your rules. The people of this country decided what the laws and rules are. You are not special. Get over it. They are guilty.
