I was listening to a Romanian lawyer and things work differently there. I think it's 3 or 4 judges that overlook the case and Andrew has posted many videos on KZbin mocking the Romanian legal system / corruption. It's like laughing at your dentist before getting a root canal.

Lol. Ive watched quite a bit of Tate and never remember hearing him say "I manipulate women to come to Romania and force them to work in my cam business against their will, I control every aspect of their lives all so I can collect the money, even though I was already VERY successful" I also find it funny that none of these woman have come out against him. Or that these legal attacks didn't happen until Andrew started speaking against "the matrix"

Everything he admitted to is completely legal in Romania. Cam girls are one of the top industries there. He has admitted to nothing illegal. Case documents are public record, it has been shown that the business he ran has no bearing on these charges. This is the problem with only paying attention to one perspective of something. If you did you would see that there is way more evidence he is innocent than evidence of guilt. I don’t believe there has been ANY damning evidence presented, maybe not even substantial. Everything so far has been refuted

Exactly, he chose Romania because he thought he could manipulate the system there more easily than in England. Now he wants the same rights as he would get under English or US law. It doesn’t work that way.

A Romanian lawyer explained why they haven’t been charged yet. In Romania if they find new evidence for a new additional charge, they wait to gather evidence on that new charge. They also gather as much evidence as possible to decide if they have enough to proceed with a trial. This is how Romanian law works. If you want more cushy rights for when you commit a crime, commit them in a different country.

Two of the alleged victims have already come out and told the court that they aren't victims and the judge labeled them brainwashed. It's quite apparent they are treating him as guilty until proven innocent.

1. She never actually answered the question if she believes they are innocent. 2. This is Romania's justice system. Other countries disagree with and consider it unjust and inhumane to have the death penalty, but many states in the USA have it. The same could be said for laws against drugs like marijuana. If it's your country, you get to make the laws. He went there specifically because he thought he would be above the law there.

All of the US lawyers that I have seen commenting on this case have come down to the point that "Wow! Romanian law is not like US law and we don't think that's fair." Well congratulations on that groundbreaking realization. If you don't like how things work outside the US, I suggest you burn your passport as US constitutional protections are not extraterritorially applicable. As a point of note, Romania is part of the EU and thus if there is an issue where Romanian law or criminal procedure itself (or the application of the law and rules in this case) violates the European Convention on Human Rights, there is a clear appeal mechanism to the European Court of Human Rights in Strasbourg. Since there is no appeal that we know of to this court, can we assume that the Tates' lawyers don't believe that filing such an action would be successful? As a side note, it is entirely possible that the Tates' new lawyer is making things worse for the Tates. Also, Tate is apparently a US citizen/UK subject. Tate has admitted to bribing Romanian officials on video. Who wants to bet that DOJ is investigating with the help of the Romanian Ministry of Justice as to whether charges can be brought in the US for violation of the Foreign Corrupt Practices Act of 1977? I believe that there is an equivalent statute in the UK.

They've said they specifically moved to Romania because that legal system wouldn't give their victims the same rights as in the U.S. So I have trouble feeling bad for them now that they've gotten scooped up by that legal system and are complaining about their rights. 🤷‍♀️ Seems like justice to me, in a karmic sense.

Announcing to the world that their human rights are being breached is not a good start as it is based on ignorance, the fact that they are US citizens is irrelevant. Detention for up to 180 days is allowed in the EU if there is a flight risk, which in this case there is.

Bruce, pre-trial arrest is allowed by Romanian law only in a very few specific cases. Proof that the defendant might tamper with evidence or influence/threaten the witnesses or the victims, the defendant is a major flight risk, or the defendant has committed other crimes after the prosecutors have started their criminal investigation. Guess which of those very specific cases apply to the Tate brothers.

BR nailed it again. Tate said he moved to Romania because it was corrupt and he could buy his way out of any situation now he’s complaining about Romania being corrupt? I’m confused. Bringing in a high profile international lawyer is going to make the Romanian authorities more determined to get a conviction. You shut your friggin mouth, wait for your charges to drop then negotiate your best possible outcome.

No. Not hypocritical at all lol it’s so obvious that the people that dislike him are not familiar with what he actually believes. No one in the manosohere believes women are inferior. They believe that men and women are good at different things by nature. And those differences should be embraced instead of trying to make women like men, and men like women. Which is what has happened. Traditional masculinity is demonized, and traditional femininity is seen as weak or condescending.

She started with a correct explanation of the Romanian law, but then starts complaining that the prosecutors actually use it.🤔😂 The prosecutors have the right to detain you for 180 days in increments of 30 if they bring new evidence to the judge EVERY TIME they ask for another 30 days. The evidence must show that they're building the case and they asked for detention and not allow house arrest or bail because they are a flight risk, or they can influence the witnesses or tamper with the collection of evidence. If it's in the Romanian law, what nonsense is this to complain that the prosecutors are using it? They DON'T HAVE TO show what evidence they have so far to the defense lawyers ( they'll get to study the complete case file when a trial is set), but they have to show the judges in order for the extensions to be approved. In the unlikely scenario that the Tates were held in detention and there's no evidence, they have the right to sue the state and the state will pay compensations for the financial losses incurred ( the prosecutors can't risk paying 5-10 millions for every month they keep them in detention ).

I think there’s definitely evidence - I don’t think they’d go after Tate without having all their ducks in a row or at least most of them. They knew who he was when they went after him and he was already detained prior to this, but was released.

Apparently that lady can't practice law in Romania, she can only be a consultant, but she's in a world tour with the interviews. Theirs a Romania lawyer by the name Stefan Loredanthat (also has a youtube channel ) whom has already explained on another channel how the law and process works in Romania and even explained why they didn't get bail or charged yet. And they do have Bail hearings in Romania is just the nature of crime that they involved and being investigated by Romania’s Directorate for Investigating Organized Crime and Terrorism.

They could very likely be angling for a human rights case (ECtHR), regardless of the outcome of the investigation, even just based on what's transpired thus far. Pretty ironic considering the crimes he's being accused of are themselves human rignts violations and crimes under IL lol.

A judge is signing off on the extensions, so there must be something brewing in the background. One huge factor must be the fact that the Tate Brothers are not a flight risk, but a flight guarantee as soon as they have 5 minutes outside of their prison cells.

Not only that, but the strong risk of witness tampering/intimidation. The judge knows what kind of pull/power these guys wield in the streets of Romania. And I'm sure the 4 women that have come forth (other 2 have spoken favorably of andrew) probably don't feel safe until things are settled.

It's a fact that firearms were discovered when the police searched his house. So even if everything else drops, he's still guilty of possessing a firearm, given guns are illegal in Romania for civilian use except hunting licenses (which are difficult to obtain anyway and which only allow specific firearms, not handguns or smgs or anything that's not a hunting weapon) or working for a company that transports valuables.

As a beginner lawyer from Europe, I'm curious what do you guys in the US do when somebody is deemed a flight - risk and the prosecution needs time to build a case against them? In Poland, we can temporarily detain them for up to 3 months before presenting charges. Of course, it sometimes leads to the prosecutors abusing their power to detain somebody when some other measure would suffice, but that's another story. If I were to prosecute this case I would 100% ask the court to detain Mr. Tate, since he has multiple nationalities, vast amounts of wealth and the alegations againts him are serious, thus making him a text-book example of a flight risk.

Not to mention putting pressure on potential witnesses. Besides the US also keeps people in prison without the right to bail out if accused of terrorism (let alone the Guantanamo). What drives me mad, is their ignorance and patronizing attitude towards the east European countries. Romania has some corruption issues (which country hasn't?), but it is a part of the EU and it must obey its laws. A propos fleeing Romania. That happened a few years ago in the UK, where a wife of an American diplomat killed a teenager in a car crash (probably being intoxicated) and escaped to the US before facing the charges.

@bruce she actually has no jurisdiction in Romania, she has no license there and she wasn’t allowed in the room during this hearing. She is talking about US law and using it as if Romanian does the same. Meaning she was hired for PR and for international audiences. He said “you took over the case”, no she hasn’t, legally. Also, it’s no injustice, that’s how their law us designed and it would be the Same in France, similar policy.

Its a joke how many sources communicate the role of this attorney. The biggest thing She can do in this case is telling the journalists about what Tate's Romanian lawyers are doing. She is at most a spectator in a Romanian courtroom.

Other European countries have the same system, which is diff from the US - but it differs by *technicality.* The Tate brothers were presented to a judge within the first 24 hours of their arrest & the *judge* decided, based on the case and evidence presented by the prosecutor, that Tates should be in jail. *Since then,* another 3 sets of judges ruled over this decision. So if that's not due process & fair international standard, I don't know what is.

False. Give me 1 EU country where they can detain you for 180 days without charges. The judge in all of the West has the power to decide for the detainment of the defendant upon viewing the charges. What is happening here is they presented him with "potential uncovering of evidence". The judge and the system there are playing a political game to win political points. They have no evidence, their own witnesses have retracted themselves from the case and made a statement against the assumption of the prosecution. It's all falling apart, but because of the criminal laws of the Romanian justice system they can still hold them for up to 180 days without a case and try ruining their reputation.

Yeah in Sweden they can hold you for up to 9 months (usually less, more in some circumstances) before charging, and there is no bail and no jury. Tate at least got to choose which legal system he wanted to be subject to, most people don't do that.

He is held to Romanian law so this whole well in America this is done, is irrelevant. The potential crime was done in Romania, he lives in Romania and the trial will be in Romania. People can critique Romanian law all they want but similar things can be said about American law. Why does the US have a bail system?…..isn’t that elitist? I am no lawyer but from what I heard from a Romanian attorney, it seems it works pretty similar like my country so here’s the situation. In Chile, after arresting someone, you have something called “ control of detention audience”. Both parties present the current evidence and the judge decides if there is enough probable cause to order a detention order for 30 days (or more) to investigate and see if said probable cause is something like a fluke or serious allegations. They do this to make sure the arrest is legal. They also can decide where the person can spend this time. It can be at home or jail depending the circumstances. The lawyer is downplaying this by making it seem that Romanian law and American law are the same, since this practice would be illegal in the USA but completely normal there. Also, I am sure they did not order jail time just because. Probably the evidence against him is too substantial to ignore and he is also a flight risk. Edit to add more info for clarity

For the love of God. Under the Romanian law they are already facing charges; they wouldn't be arrested otherwise. In the current stage of the investigation he is already being referred to as a "defendant", not "suspect". If something you're looking at you don't really understand ( hence the Romanian legal justice - which is based on the French one ) that doesn't mean it's bad or doesn't respect human rights ( lol ), it means you need to study more until you can make statements.

​@@mareklame8589 , what's more funny is that in Romania there are no private prisons, there is no economical incentive to lock people up like the US, but everyone just fails to see that. Romania is part of the EU and it must abide to specific human rights guidelines; otherwise the EU can start infringement procedures and Tate could sue Romania at the European Court of Human Rights

They haven’t been brought before a judge, offered bail, or seen the evidence they are dealing with though. No law should allow that to happen. They are being charged but that’s about as much as they know, and they aren’t even able to defend themselves yet until an upwards of 180 days possibly while in detention. You literally missed the point.

I'm a Romanian citizen with relatives part of the legal system ( prosecutors & lawyers ), but yet you know more than I do. Below is an extract of the article 202, point 4) of the Romanian Criminal Code: (4) The preventive measures are: a) detention; b) judicial control; c) judicial control on bail; d) house arrest; Guess you had no ideea these exist, but how could you? You're just an ignorant browsing the web thinking he knows everything. The Tate brothers can apply to the remaining 3 options at any time during these 180 days, there's not even a limit - they can apply 100 times if they want. You know why they don't? Because they know they will be denied due to the evidences in the case. And we wouldn't want Tate's Lawyer going online saying they had bail hearing and was denied, that wouldn't do good for PR and people like you.

In Sweden, you can (in theory) be detained prior to trial indefinetely, with review every 14 days. The record thus far is near 4 years… 😮 (which is very rare, but it wasnt that long ago, like 2014, not ancient times) I would certainly agree that it is unjust to do so, but I dont think Sweden is alone in the west to have such rules.

@Andy Ash So you literally just proved him right. You say "he moved there because the country is corrupt" and "he gets arrested and shouts corruption". He moved there because he was rich and the corruption is more manipulatable for an average rich person than it is in countries like the Us or the Uk. But he never thought that even more powerful and rich people would opt for his arrest and manipulate even more deep state corruption than he ever could? He can manipulate maybe the local police if a street fight or a speeding ticket happens. But he cannot manipulate federal and EU police, that's only for the elites that have roots in deep state corruption.

I'm Romanian and I don't hate or fan of Tate. I've readed so many bad things about my country that I'm tired. 12 yrs children speaking about the legal system in romania. Many big guys, politicians with money and influence got in prison last years so I'm afraid that they have some solid evidence there (they know that they can be sued they're not stupid). He was puted in detention because he can escape or manipulate evidence. If he will be found guilty, he will blame anyway the "matrix"

From what I understand, when the prosecutors were requesting to extend the Tates' detainment, they provided the judge with an argument and a minimal amount of evidence and basically the judge could either agree or disagree and in this case he agreed, and then denied the appeal. What no one seems to get is that prosecution doesn't need to show anyone anything except for the judge, they can build up all the evidence they want until they have a case against the brothers innocence, and clearly they've got enough to prove that the brothers must remain detained. I just can't wait to see what else is coming up for the world to watch. Very very interesting indeed

There was no new information provided during the request for extension, actually. But this is normal in Romania. The first extension is basically "free of charge".

False , if u read the report in why the judge denied the appeal it was due to it being political. To this day All the reports show there's no evidence . The judge just said it would make Romania look bad if they were let go lol. This ain't about innocent or guilty this is about politics

Tates whole court case reminds me of an old story about a Russian guy who was about to be hanged. He got up to the hangman and was asked for his last words. He started bad mouthing his country and how everything and everyone in it was just shitty. The hangman pulled the lever when the guy was done and the rope snapped so he continued his tirade and said that they couldn't even hang people right so the judge agreed and got another rope so they could do it right.

If you think 60+ days w/o being charged in ROMANIA is Unjust .. watch daily bond court in Fulton County GA.. right here in the US… A LOT of defendant’s are sitting 500+ days w/o indictment and still waiting for preliminary hearings! Yet I don’t hear outrage or even a public conversation about what happens on our own soil!

@Andy Ash I’m in no way complaining tate hasn’t been charged.. simply making a point the standard people want applied in another country, we don’t even uphold here! Your right Romania is different and US policy and law doesn’t apply … If Tate wanted to be innocent until proven guilty he should have remained on US soil! My original comment sadly is a very true real issue in the US where people really are being held for A VERY long time without being charged.. in the USA you have a right to speedy trial unless waived but the speedy clock doesn’t start until you’ve been indicted so if you request preliminary hearing, states drags their feet and you can’t afford bond.. you just sit…2 years in county jail without indictment!!!!! And you never hear people streaming from the roof top about it yet people are outraged cause this sick twisted POS has had to sit down for 2 months… disgusting! That was my point!

Our system is far from perfect and I believe very broken .. but I also believe a system is necessary & I’m thankful we have one in place. That being said its time we start looking into cleaning up and getting our own yard in order! ❤️🐸
