I got a ticket, was told I had until whatever day to pay it, so I get off work, go to pay the ticket and find out they issued a warrant for my arrest because I didn't pay it by 8 a.m. that morning! Seriously??? Why tell people they have until that day if your time expires at 8 a.m. that day? So they can issue warrants and charge you more money to clear the warrant!

I definitely had that stressor effect when I was learning to play the drums. Anytime I played a note wrong, the pressure of getting it wrong and trying to get it right would take over and I'd constantly get it wrong again. I'd have to move on to a different part of the sheet music and come back to the other part later. Very strange the way the brain works.

I think this can happen on polygraph exams as well. They claim it is ok to be nervous and stressed out as that is a background thing that the test can filter out.. by looking at your baseline responses and judging your deviations from that. But I don't see it taking into account things like: (1) you know when you're being asked a key question and when the outcome of the test can have significant impact on your life, you respond to that question in an increased way even though you aren't trying to be deceptive; (2) sometimes you can pick up on certain tells that the examiner does when he marks you as being possibly deceptive when answering a particular question. Or you can _think_ you are perceiving tells when they aren't really there. Either way, it can be like your music example, when you think you've gotten the important question 'wrong' (as in you feel like your body may have reacted to it), you just get an increased reaction the next time it is asked.. your level of anxiety also can gradually increase throughout the course of the test; (3) they tell you to get a good night's sleep beforehand and don't do anything different from your usual routine, but there's just no way to remove the impact that unrelated experiences you may have in your life prior to the test can have on your responses. (I know polygraphs have been debunked by researchers many times in the past, but they're still used in the USA.)

@@johnsmith1474 So you’re saying an officer wasn’t halfway inside the vehicle and if the vehicle were to speed off, said officer wouldn’t be at any risk of serious injury or death? I’m just stating the facts of the case and you’re trying to dismiss me as an immature, delusional, ideologue which is ironic since you’re clearly all those things. Based on the evidence, I absolutely believe an officer was at risk of serious injury or death and it was perfectly acceptable to use deadly force. It seems like you’re deflecting and you’re the one who doesn’t actually believe what you’re saying because no reasonable person could believe speeding off with a person halfway inside your vehicle poses absolutely no risk to said person. I’m guessing you’re the ideologue trying to push an agenda but I’m not going to assume your motives and entire worldview based off a couple comments like you because that’s dumb... I’ll give you the benefit of the doubt and not assume you’re some kind of activist who think almost every police shooting they see is unjustified and couldn’t possibly look at these instance objectively. Again, you’re saying an officer wasn’t halfway inside the vehicle and if the vehicle were to speed off, said officer wouldn’t be at any risk of serious injury or death?

The trick to that test was to focus only at the center of the screen and use your peripheral to follow the white shirts as they pass the ball. The gorilla stands out because of the opposite color. Kind of like seeing a silhouette of a person in front of a sunset. This kind of psychological testing was presented to me during EMS training.
@kirikayumura6015
@kirikayumura6015 2 жыл бұрын
yea that part was actually easy for me and the gorilla stuck out like a sore thumb. What got me though, was that they said a clown walked in and 'killed' one of the white shirts.. then they showed it happening.. and I believed them! I was kicking myself.. how did I get the pass count right and see the gorilla but not see the more obvious anomaly of the clown or the fact that one of the white shirts would have been missing? Then you rewind back to the beginning and find that they're lying about the clown. Not just a test of selective attention.. but also a good demonstration of problems with interrogations and witness testimony when a person is asked leading questions or presented with a certain context or narrative before asking about what they remember.

Nah, just Kim Potter, she was wronged, has an awful judge who did a really bad trial, it's easily appealable and mistrialable but the judge covered her ass with a 14 month sentence so do you do the 14 months and put it all behind you because an appeal will take about that long or do you roll the dice to clear your record and take a chance on getting convicted again and a harsher sentence. The guy totally brought this on himself, he drove away with a cop half in the car and no awareness of where he was. If the stress is too much for them to make rational decisions then they should not be doing that job. Everyone who goes into law enforcement is aware that it is high stress and dangerous which is why they should be training to stay sharp, not to make something habitual instead of conscious.

Bruce you get the sequence wrong, and it matters. She had the gun out the whole time (5-7 seconds) she announced "taser taser" etc. She did not pull it out after her declaration. Second point is vocabulary, supersede means "to override" or to be above. It is not about sequence ie before or after, as both you & the prosecutor get wrong. The superseding cause in this case is of course that the wrong weapon was in hand. Every other detail in this arrest is more or less standard in these type events, which happen constantly in police work: 1. person tries to flee, 2. police follow procedure, 3. there is no death. When you interject "gun" for "taser" then use it, it CAUSES a death. The superseding cause is the presentation of a gun. That is fully & exclusively Potter's responsibility under her sworn role to practice competent policing. If every effort to flee from cops justifies slipshod application of force, we do have a problem. To say Potter is "beside herself with grief" is reading in; I see her as beside herself with self concern. She is thinking; "pension loss, retirement screwed up, prosecution, jail time." And that is exactly what she expresses, "I'm going to jail." She is not consumed with grief for the harmed person, or she would be down the street applying CPR asap. She also lies on the stand about not remembering, infers her left hand was occupied but it was not, lies that she saw fear in her partner's face, and failed to shed tears while crying. Please Bruce, cut the bullshit. PS you can play the video in real time and it's still stunning how long she points a gun at a person without summoning an awareness of what she is doing ie is negligent.

No one’s questioning her 26 yrs on the force, but in weighing her reaction in concert with other 2 Officers about how to secure Daunte at the scene in order to take him into custody, shooting him dead, is ridiculous! It looked to me like the two Officers were managing Daunte, but for Potter deciding she’d use lethal force to stop him! She’s culpable for her behaviour & death she caused. Then, all three Officers listened to the car crash and did nothing! Didn’t call for an ambulance, Sgt Johnson called for back up with “Shots fired”, except it was Police who shot Daunte! So other Officers came in hot, and misinformed.

I saw it this time, but only because after looking it up I realized I'd seen it before, and while I forgot the exact nature of the surprise part, my brain clearly didn't as my eyes locked right on and I laughed as I remembered the first time I saw it back in class. Thanks for the reminder of a pretty fun class, and the reminder that eye witnesses actually kinda suck, even though we tend to put so much emphasis on it (reminds me of another video we were shown where a bunch of witnesses couldn't agree who stabbed whom, it was split about 50/50, despite being caught on camera as a more or less unprovoked stabbing involving exactly two people. Still, about half the witnesses said the person with the stab wound was the stabber, not the stabee, despite the clear cut video that he never even swung a fist)

With all due respect, she was in complete shock. Listen, it was a terrible accident. She absolutely had a responsibility to know her tools. Now ……………… let’s be 100% transparent, just because someone has 26 years of experience does NOT mean they have road experience. I GUARANTEE she’s been “inside” the majority of her career. Due to “Defunding the Police” and the vilifying of an entire profession, her Department had to pull people who SHOULD NOT be on the road, on the road. And this is what can happen. Notice, the other officer had majority under control until he jumped BACK into the car. She is NOT in a patrol assignment, so she probably only touches that Taser ONCE a year for certification. She was right to attempt to use her Taser, but she was nervous and had complete tunnel vision. Now I’m speaking from the perspective of a 15 year Officer, a black woman, who rose through the ranks of Lieutenant ALL ON PATROL! Now, I’m not telling you this for any reason OTHER than for you have have an understanding from a patrol officers perspective. She was in a state of shock, you can see that CLEARLY in the video. I do not expect the general public to understand that as the assumptions are made from a video. But people tend to think you out that uniform on and all of a sudden, your no longer human. She was in complete shock, that was no acting. She made a horrible mistake, and she should be held accountable. However, this is a societal problem, let’s go BACK to what I said about “defunding” and pulling people out the station to work patrol, let alone train. Contrary to popular belief, WE HATE IT! Not everyone belongs in patrol or as an Officer, however, these are the cards we are dealt. Bruce per usual did a great job explaining audio and visual blockage. I always would love to challenge people with this perspective to go attend their local police depts civil board and try a few scenarios on a simulator. It will 1000% change your perspective. Again, please refer to the first thing I stated, “with all due respect”, just wanted to give me two cents on your comment of a performance. This isn’t it. Many blessings to you!

I REALLY appreciate hearing your insights. I’ve struggled with this. Like you, I have great empathy for both parties. No doubt, Daunte should be alive. No doubt, this was a mistake. I don’t believe she ever pulled her taser either. I gave her the benefit of the doubt regarding her breakdown after the accident. I’m old and hard of hearing so I did not hear “I’m going to prison!” or any claims of suicidal thoughts. I assumed her reaction was based on her mistake and the consequences of such action. However, I must acknowledge she didn’t race to DAUNTE’S vehicle to make any attempt to render aid. I don’t want to judge her because we never know how we will respond in a situation until it arises. With that said, I know my ONLY concern would be for Daunte and my actions would reflect such. God bless them both!!! My heart bleeds for both families. 💔 From a discernment standpoint, I believe she lacked proper training and the department should be held civilly liable. Based on that video, she shouldn’t have been carrying a gun. Such analysis is coming from a woman who also has no business carrying a weapon and therefore made that determination years ago. So few cops get held accountable publicly in a court of law for actions that cause a lot of outrage, it feels like Kim Potter is almost a sacrificial lamb. The public wants to see justice for so many cases that get hid behind qualified immunity, it seems like the prosecution is trying to satiate some of that by throwing everything possible at this one officer. My opinion, she should not have been out on the streets with the ability to take someone's life, her lack of actual experience makes it ludicrous that she was a training officer out on the beat, there's no question that she should face accountability. However, criminal charges seem a bit extreme. There was a whole system failure that put her in that position, not only endangering the public but also her fellow officers.

I'm a military vet of over a decade so I get the "muscle memory" argument if and only if for some reason, rather by SOP change or choice She switched the sides she carried her weapon and taser on. However if that's the case it's her job to retrain that instinct. And if there was no change in SOP or the way she wears her gear then the argument falls flat because that instinct and training should've guided her hand straight to her taser. When you've been empowered to carry a weapon professionally the standards are higher either way because you can't my bad a person back to life, you don't get a do over so you have to get it right the first time, every time.
@deaj8450

The way her taser was carried has switched three times over the course of her career. The defense use of force expert that testified for free (because he testifies in all criminal trials for free) said in his 44 years of police and swat experience she would've been justified to use either her taser or her gun intentionally as all 3 officers could be severely injured from the vehicle moving. He also testified that in many states it would have been criminal for the cops to let Daunte go. Daunte is a guy with a warrant attempting to flee arrest. If he successfully starts fleeing in the car he could easily crash and kill multiple innocent people. The use of force expert also wrote national best practices guidelines on use of tasers, and was in the first ever taser master class of instructors that was taught by Rick Smith. Co-patent holder of the taser and CEO of the TASER company. He is THE expert on this shit. I dont think she should be a cop because of this error, but I don't think she should be in prison either. We don't put people in prison for mistakes that aren't legally reckless. Civil Court exists for those reasons. And legal reckless use of a firearm has to have a conscious disregard for the consequences of your actions. She couldn't be consciously disregarding pulling her gun because it was an unconscious mistake. A mistake the prosecuters never even questioned. I came into this trial thinking she was guilty, but the defense did a good job and the prosecution didn't do their job of proving the charges they thought they could prove. Jury decision is legally wrong, but juries don't actually go by the law. I think that is a good thing is some cases, but a bad thing here.

@@deaj8450 there's 1 more major issue, why wasn't she looking where she was shooting? You aim down your weapon you don't blind fire. Also when I say SOP changes I mean recently. Also police, soldiers and anyone empowered with the ability to take life have to be held to a higher standard. Honestly I don't think she needs 15 years in prison, I honestly believe it was an honest mistake, but he's dead. And in a nation where civilians can be given 10 years easy for crimes that don't cost a life on a regular basis. A cop has to do prison time for this. Because I don't care what the "expert" said, the only time a cop should discharge a weapon is to prevent an immediate threat to civilian lives. And let's be honest even she said the reasons he was pulled over were BS. And that warrant was for failure to appear in court for a summons that was sent to the wrong address. I can agree with holding those people to a higher standard of behavior, but I disagree that this specific instance is below the standard they should be held to. I agree the reason he got pulled over was bs, but it wasn't her that pulled him over. It was her training partner. I guess she could've said not to, but I feel it'd be weird to assert you authority to not do what at first looks like an average traffic stop. I don't see why you wouldn't care about the expert witness. It's evidence in the trial. Your first comment mentioned you are a veteran, therefore attempting to make yourself more credible than an average citizen on use of force as authorized personnel.. At least, that was what I interpreted. Similarly, that expert is extremely qualified and much more credible than the prosecution's expert witness. I mean the guy has testified in thousands of cases, testifies he has been in hundreds of "critical instance" (potentially deadly encounter with suspect) scenarios, and has trained police forces in 33 countries for both swat and anti terrorism. He also came across very straightforward and honest, and is testifying against officers in other cases he's on. I trust and value his opinion on the matter, but that's me. @@deaj8450 the reason I don't care about the expert is because 1. He is not independent, whether he got payed or not his goal was to provide cover for her actions, same with most experts. 2. He and most cops have flawed techniques from the start. In the military there are 4 potential weapon statuses Clear - no mag in the well no round in the chamber, weapon on safe Green - mag in the well, no round in the chamber weapon on safe. Red - mag in the well, round in the chamber, weapon on safe. Black - mag in the well, round in the chamber, weapon on fire. For reference, on deployment during convoys the gunners were on Red and everyone else was on Green. That is in an active combat zone. It takes a trained shooter about 3 - 5 seconds to go from Green to Black. So for the life of me I don't understand why cops ride around the city with weapons on Black. How do I know it was on Black, because if it was on Green she would've had to charge it and take it off safe and on Red she would've still needed to take it off safe. Basically if she a cop who has never fired her weapon in the line of duty wasn't running around with her weapon on kill she wouldn't have been able to make the mistake to begin with

I'm with Mrs. Wright on this case. My condolences to the family. As for the former cop, she f*d up in the biggest way possible. There's no way around that, psychobabble notwithstanding. As a training officer, I suppose the best that can be said is that she gave a fabulous example of what not to do.

This is one of those trials that I just feel like as more about a DA and prosecutor scoring points, and getting press time, then about justice. That same DA and prosecutor plea down predators and send them to rehabilitation centers with minimal jail time, and yet they threw the book at an officer, who made a very grave mistake. She should’ve been charged, but the charges she got were overblown and ridiculous and it just wasn’t fair when you consider what sentences repeat dangerous criminals receive.

It's so difficult to go to jail especially when you know you did nothing wrong (although technically having warrants is wrong). But better to be alive to sue later than to die because a cop made a mistake (regardless whether you think the cop was right or wrong).

I can equate this with the stages of competence. If you’re wanting to learn to drive a car you go through the following phases 1. Unconscious incompetence where you may be a passenger but know nothing about cars or driving. But, you decide you want to learn. That takes you to : 2. Conscious incompetence. You know that you know nothing about gear changes, road rules, using a clutch if you want to drive a manual car. You see so many things that you’ve never bothered with before. So you study the rules, you find out when you need to use the indicators, how to steer and listen to instructions. You do your minimum number of hours - 50 - 80 hours. You can do it but you have to think about it all the time you’re driving. When you become more confident you reach: 3. Conscious competence. You know what to do but you can’t be distracted as you’re scanning to see others are obeying the rules. Late learners may never get past this stage, and that’s ok. You need to be very confident in driving so that it all becomes something you do without needing to think every tiny step through. This is likely where the police officer 👮 was - following training but not intuitively knowing what to do. She hadn’t done it before and wasn’t familiar enough wit the taser. The day you realise you’ve done everything correctly but don’t remember doing everything you did to get there but got there by rote learning, you are: 4. Unconsciously competent. This is the higher level of skill because you’re multitasking all the time without overthinking it. You know automatically who needs to give way, your gear changes and speed are correct for the area, you just do it on autopilot and aren’t worrying about doing the wrong thing at any time. Your confidence is automatic - but not arrogant. These are the best drivers.

Haven’t finished the video yet but I watched the whole trial. She does deserve to be charged. Mistake or not. It was reckless for her to fire a taser or gun into a car with other people in it and the possibility of the car taking off (which did) just like drunk driving. A mistake with accountability.

I think she was in the wrong. She should have known better then to grab her firearm. Guilty as charged. But , I do think she deserves mercy when they sentence her because she's a human being and had no malicious intent to murder him. She was just not skilled enough. Funny you often find this in Instructors (in many fields), or Supervisors. I believe Chauvin was an instructor at one time too? I wonder if the Peter Principle is relevant here?

I really want to see statistics for how often any of these officers actually do spark tests every day. If most of them do it all the time, then you may have a point. However, my suspicion is that she actually does it fairly often compare to other cops and that no one gets reprimanded for it. I mean this lady volunteers for multiple different positions and training courses she wasn't required to attend. To me she would be the kind of cop more likely to do the test than others. I think the spark test thing is a bit of a distraction, the taser was demonstrated later to work, but that's just my opinion.

@@deaj8450 I honestly do not think it had anything to do with the spark test not being done. I personally think it was bc her whole career she had never pulled her gun! Correct? Pretty sure that's what I heard. And had only ever pulled her tazer a handful of times. The new look of the tazer being all black on top and she was the ONLY one who had the new tazer 7.
