Sir , If an unidentified dead is found by police they will register a case under section 174 cr.p.c and the FIR under sec tion 174 cr.p.c has to be sent to Mandal Executive Magistrate concerned and police will enquire in to the matter to elicit the identity and cause of death of the deceased. During the enquiry if the identity and cause of death as murder is established whether police has to issue FIR or they can file memo altering the section of law. In this connection I would like to bring my opinion to your notice that the provisions contemplated under section 174 cr.p.c is not applicable to 154 cr.p.c and 157 cr.p.c hence the document prepared in the shape of FIR can not be considered as fir . Hence an altered fir is required to be issued for the offence under section 302 ipc

Pranaam sir, I have one query about the confirmation of Death Sentence by the Honable High Court.....When trial court confirms to accused that he is found guilty and quantum would be death sentence, and now Learned Trial Court will send the matter to High Court regarding the confirmation, Now the matter is pendig with the High Court which means the Learned Trial court cant pronounce the final judgement to accused, the How the accused moved to High Court for an appeal against his conviction???? Can you please guide on this
