In Q 29, it is asking about MLA, so even if we consider the indirect relation that eligibile to vote as a criteria for being an MLA, he needs to be registered as a voter and also for MLA/MLC he needs to be registered as a voter in the same State & NOT any other state. Hence this also gives the answer as D

Mam,Q.26: the option might be D....bcz preamble has no legal effect independently alone but,has effect when it is supported by other parts Eg: secularism, federalism... which has its legal effect when it is supported by Right to all religion,dpsp, schedule 7 etc....
@shubhraranjan4 жыл бұрын
Secularism, federalism comes from legally enforciable part like fundamental part and Center State relations. Option D is irrelevant. Look answer from Supreme Court judgement.

Mam i think the answer for the judicial reviee question is none of the above, because in the option its given " to preserve the ideals on which contn is based" N in what i understand the art 32 and 13 is given to preserve the FRs only.

If there is any doubt in interpreting the provisions of the Constitution, then preamble can help in that. This was said by supreme Court. Directly given in lakshmikant book

question 24 is wrong i suppose. here is a excerpt from young india, july 2 1931. focus on last line To me political power is not an end but one of the means of enabling people to better their condition in every department of life. Political power means capacity to regulate national life through national representatives. If national life becomes so perfect as to become self-regulated, no representation becomes necessary. There is then a state of enlightened anarchy. In such a State everyone is his own master. He rules himself in such a manner that he is never a hindrance to his neighbour. In the ideal State, therefore, there is no political power because there is no State. But the ideal is never fully realized in life. Hence the classical statement of Thoreau that the government is best which governs the least -is worthy of consideration.”

Mam, Judicial review is implicitly present but there is no explicit provision by Constitution as such, whereas in question it asked "Constitution Provided"! Can you please clarify on this Mam! Thanks!
@shubhraranjan4 жыл бұрын
Read the content of Article 13. It says that any law inconsistent will be void. Judicial review is implied in Article 13, 32, 131, 132, 133, 134, 136, 142 and so on. It is inherent in consitution, in US, it is declared by Judiciary.
