Exactly! Grabbing at straws and trying to deflect. They should have worked out a deal with the prosecution because her testimony on the stand showed she was being untruthful. Now she will have zero chance of ever getting out. Life plus 60 years. She’s there forever. Unfortunately because she lied twice on the stand IMO she would not benefit the prosecution. CA's defense attorneys will tear any testimony she tries to give apart.

This male defense attorney is a real quack to say the least. This FBI agent made him look so stupid during the cross examination. Katie is so guilty and the fact that she was found guilty is such a blessing! Katie = Life in prison! Charlie = Life in prison! Sigfredo = Life in prison! Donna Adelson = at least 20 years in prison! Wendi Adelson = at least 30years in prison! Harvey = living out his life at home very lonely.

I also kind of agree with your line up here, but I believe Harvey the dad was complicit as well. He may have been informed of more details after the fact, but there is evidence he knew what went down and knew at least Charlie was pulling something off for them. Back then, Donna AND Harvey were both concerned that Dan was trying to limit their visitations. He had motive to help.

from 31:58 to 32:39 the camera goes close up on the 3 women at the defense table. I can see why the camera operator chose to. Their expressions and head movements are, well, not very lawyer-like. They look more like 3 not very nice girls from middle school saying not very nice things and then crowing about being not very nice. A kind of smug "group think"... As someone who was bullied by "more popular" girls in middle school, I recognize the manner of speaking, and the expressions well. (btw...no bitterness on my part. Even then I knew that getting straight A+s in AP classes was the way to an interesting future, rather than just thinking about boys and clothes. Cause Ivy League colleges have that darn habit of caring more about grades than they do about how many guys a girl has fucked before she's 17. So unfair, but what can you do!) But back to the Kawass. It's a strange little tableau, strange and off putting. And it makes me think about why and how the case went so badly for all three women. They look too snidely smug, the expressions of dim but self arrogant girls saying "ooh, she's so gross" and re-inforcing each other in, well, being stupid. And word is that Kawas talked Magbanua out of doing a deal, she was so sure of herself she'd win. In Kawas' opening & closing she shouted and demanded. Waved her arms about aggressively and hectored the jury. Almost shouting at the jury that they would be stupid if they didn't believe HER. And that the prosecution were corrupt and lying. They look like arrogant over grown girls who think that by saying nasty things about the prosecutors and stamping their feet, that they'll get their way. Ooops. They really screwed up Magbanua's case and life. Not that I'm sad about it.

Katie's innocence explained: Charlie can never ask Katie if Sigfredo has told her about the murder, because, in asking, Charlie is admitting to arranging a murder-for-hire using her children's father as his hitman So, Katie, does she know, does she not? It's a guessing game for Charlie, from murder to bump But after visiting his mum the day after the bump and hearing such things as "you've been helping Katie out", Charlie made the incorrect and deadly assumption that Sigfredo (Tuto), must have indeed told Katie about the murder at some stage Charlie heads into the meeting with Katie at Dolce Vita, convinced Katie has found out somehow.. In fact, Katie knows nothing. Everything Charlie says flies over Katie's head like a fighter jet at high altitude. She has no clue what Charlie is talking about Unfortunately, state attorneys followed Charlie into the assumption trap and Katie paid with her life In the minds of state attorneys, catching flights and day after (the murder) money talk, both from Charlie's mouth, are evidence of Katie's involvement. In reality, they are only evidence of Charlie's assumption How does Charlie know to call Katie initially? Charlie's mum uses the TV $5k code, so Charlie knows the bump is related to the murder. Sigfredo was Charlie's hitman and, obviously, Katie is the ex-girlfriend being referred to $16k of paychecks over 18 months plus other extras was Charlie keeping Katie onside in case she ever found out about the murder. It also kept Sigfredo happy - Charlie helping his hitman's family State attorneys misinterpreted the money trail, considering monies and favours to Katie as her payment for acting as "go-between" The spike in Katie's August, 2014 bank deposits was possibly, partly, Sigfredo sharing some of his payment from the murder without Katie knowing it was blood money. The majority, maybe all; night club earnings - Katie told the truth What proves Katie's innocence beyond all doubt is, up to and including the very last phone calls in the wire taps, Katie does not know if the Undercover is talking about her. If she is involved, Katie knows without even thinking, that the Undercover is talking about her Katie (from wire taps): ¨I don't know the rest of whatever it is, or if my name is really on anything, or if they're even talking about me ...¨ ¨... and I don't know if it's me they're really talking about¨ ¨ ... and I really feel bad if they're not even talking about me ...¨ It cannot be a ruse, it cannot be Katie feigning lack of knowledge for law enforcement's benefit. If Katie is involved and thinks law enforcement may be behind the bump, she is staying off the phone, not having multiple long phone conversations on the who, what and why of the bump A ruse is extremely complicated, dangerously risky, ridiculously stupid and completely unnecessary - why not just stay off the phone? Which is what she would have done ... if she was involved As for Luis Rivera; his money drop story was laughable, and not surprisingly, he made Katie the central figure in that story. Even Luis can't believe how completely The State bought his lies. He made a fool of everyone, except Katie, who stood strong in her fight

Innocence In A Nutshell What a nightmare for Katie - The Undercover drops her name, Charlie unwittingly pulls her into his mess and the FBI mistake concern for her friend's family with complicity in a murder - Nightmare! In the wiretaps Katie tells us she wasn't involved: ¨I don't know the rest of whatever it is, or if my name is really on anything, or if they're even talking about me ...¨ ¨... and I don't know if it's me they're really talking about¨ ¨ ... and I really feel bad if they're not even talking about me" You can throw every other piece of evidence for and against her in the trash. If she doesn't know if The Undercover is talking about her, she isn't involved And you hammer this point home to the jury in closing: "Deliberation should only take you five minutes because there is only one question to ask yourselves: "Why does she not know?" But surely it's not that simple!? Yeah! it is! The FBI planned The Bump meticulously. Its first goal was to make sure that anyone involved knew The Bump was about the murder. And Katie doesn't know The FBI asked the question, set up The Bump and wiretaps, then totally ignored the answer - truly unbelievable! Katie not knowing acquits her outright, just as DNA evidence has done in other cases Katie talks to Sigfredo: "I don't feel secure because you take care of everybody else. Where's my security Tuto? When are you going to step up for me? ... ... because I feel like everybody else gets the special attention. And then Katie you go figure it out, you go figure out the kids, you figure out life, you figure out your apartment" In Katie's eyes this is not Sigfredo's problem. Why? Because she wasn't involved! She has no idea her two 'boyfriends' have conspired to kill someone. She is oblivious Look at it from Katie's perspective: random strangers extorting money from Charlie's family, possibly using her name to do it. That's terrifying for her. She tells us exactly why she wants Sigfredo's support: "Look, can you do me this favour? Because it's like, I'm not a guy and I don't know if it's me they're talking about" Do we listen to her? Not a chance! We fall into the trap of assuming she's talking to Sigfredo as a co-conspirator. That's inexcusable She tells us why she is helping Charlie: "Look, you gotta understand, like someone doing this to my mum, someone doing this to your mum" "But the mere fact that I don't like anybody disrespecting your family, scaring your family ..." "I'm trying to get whoever's threatening your family, and helping you guys out" Unfortunately, like complete idiots, we ignore her. We refuse to believe the truth staring us in the face Katie simply can't understand why anyone would be using her name to extort money from Charlie's family: "Why am I being thrown into something?" "... imagine, like, look at this, I'm picking up somebody else's, you know" You would think these two sentences alone would be enough to rubber stamp her innocence. Alas, we choose to remain ignorant Katie continues with super clues for us: "For all you know, it's a patient. Maybe they've seen me in the dental office in the beach before" "Did you take his teeth out or what? ... Is he a patient? You run across so many people every day" If Katie is involved she knows it's not a patient! Evidence of innocence everywhere, and we continue to deny, deny, deny! Sigfredo to Katie: "... the less you know the better ..." Katie is alleged to be the "go-between" in this murder-for-hire. She would know a lot more than Sigfredo about everything. The above is something you say to someone who has no knowledge of the real situation and you want it to stay that way Charlie to Katie (Dolce Vita): "When everybody was there the next day, did any of you take any money? ..." This question must be taken in context. From murder to bump Charlie wonders if Sigfredo tells Katie about the murder. But Charlie can never ask Katie because, in asking, he's admitting to murder, using the father of her children as his hitman After the bump, all bets are off. The Undercover drops Katie's name, confirming to Charlie that Katie knows. Now he can talk to Katie semi-freely - she a witness to Sigfredo's involvement You start to see how insidious the name dropping is. It is everything in this case because it allows Charlie to use an innocent friend in his investigation of just who is behind The Bump Katie's innocence is established further when we compare the conflicting stories of Charlie and Luis regarding the day after. Charlie talks of people taking money, whereas Luis tells of Katie distributing money. Charlie's candid words to Katie decimate Luis' lies It's heartbreaking to see Katie in court being double teamed by the equally blind FBI and state attorneys. As Chris DeCoste, her attorney, so aptly described it: "They can't see it, they can't understand it, that she's innocent, she wasn't involved" They can't see because they don't wish to see. They had Katie pinned as guilty and tunnel vision crippled logical thought The only thing standing between Katie and freedom is state attorneys being humble enough to admit they missed crucial indicators to her innocence

Katie's Innocence Unpacked: Charlie knows Katie wasn't involved, but always wondered if she knew; if Sigfredo had told her about the murder at some point "You've been helping Katie out" This insidious statement by The Undercover confirms to Charlie that Katie must indeed know about the murder Charlie to Katie (at Dolce Vita): "If they had any evidence, we would have already gone to the airport" "When everybody was there the next day, did any of you take any money? ..." Charlie fell under the influence of confirmation bias - he thought Katie might know and The Undercover "confirms" it for him. State attorneys follow Charlie into the trap - they thought Katie was involved and Charlie "confirms" it for them Not only was Katie not involved in the murder, she had no knowledge of the murder. Tragically, name dropping by The Undercover set into motion a chain of misconception that eventually led to Katie's wrongful conviction "When everybody was there the next day, did any of you take any money? it's not like you're driving around in a Bentley ..." In Charlie's mind, if Katie knew about the murder, she knew about and could have easily been involved in spending the money, and he's keen to know if anyone left a money trail for law enforcement to use as evidence Important to note that Charlie's question above proves that Luis' money drop story is a pack of lies, i.e., there is no money drop; not in the way Luis described it

You’re wrong. Theres plenty of evidence that confirms Katie’s guilt. Heavy phone communication between her and the murderers. Their cell phones ping together at key locations including car rental. Call log confirming flow of information to Charlie with Katie as the middle man. The murderers did not know Dan Markel and had no motive to kill him. They literally drove over 5 hours just to murder him because they were hired …by Katie …on behalf of the Adelsons. The spike in cash deposits for Katie courtesy of the Adelsons following the murder. It is very obvious what happened here. And without Katie it wouldn’t have been possible.

Ironically, the proof of Katherine's innocence is in the wire taps. If Katherine doesn't know the undercover is talking about her (and clearly, she doesn't), then she isn't involved The case is that simple. And if I am her counsel, I drive home this one fact to the jury in my close - it saves her life "If she doesn't know, she isn't involved. I'll say it again. If she doesn't know, she isn't involved. Throw every other piece of evidence for and against her in the trash. If she doesn't know, she isn't involved" The one thing we know is that if Katherine is involved, she knows instantly, immediately, without questioning, the undercover is talking about her - it is not a puzzle she has to solve Judge, Jury, Prosecution ... no one has another explanation for why she doesn't know. If she doesn't know, she isn't involved

Law enforcement's goal for the bump was to generate conversation between two co-conspirators in a murder-for-hire, but they achieved exactly the opposite What law enforcement get, what we hear in the wire taps and restaurant recording, is two people never once talking about the murder or related topics. Katie, obviously, because she wasn't involved, so has no knowledge of the murder, and Charlie thinks this is just people extorting his family for reasons he can't work out Because Katie's name is mentioned by the undercover during the bump, Charlie has no understanding that the note, this guy (the undercover) is actually related to the murder of Dan Markel Law enforcement unknowingly framed Katie for the murder. It's a classic case of confirmation bias - create a theory and use corrupted "evidence" to fit that theory, thus convicting an innocent girl

The irony of "The Bump" ... is that neither Katie nor Charlie knows that the note, the guy (the undercover) is related to the murder Katie because she wasn't involved and Charlie because none of what the undercover says to Donna Adelson during the bump, and to Charlie, when Charlie calls the number, links to the murder in Charlie's mind Katie wasn't involved, so mentioning Katie doesn't help him. At the time of the bump, he has no idea who his hitman is because Luis was solicited anonymously through Charlie's drug dealer. He knows Sigfredo is called Tuto, but doesn't know Tuto was mixed up in the murder through being friends with Luis Mentioning Katie, Tuto, Tato, a brother incarcerated up in Broward, you've been helping Katie out ... none of this gives Charlie any clue that this is about the murder Both Katie and Charlie can only take the guy at face value: someone is extorting money from Charlie's family, but who and why? And of course, neither of them can work it out Law enforcement's goal for the bump was to engender conversation between two co- conspirators in a murder-for-hire. They got two people, one not even involved in the murder, talking about nothing but a very scary random extortion
@ladycymbeline
@ladycymbeline 2 жыл бұрын
Again I say Adelsons, Katie, and Sigfredo knew very well that the undercover's note was related to Dan Markel's murder. Not only is it proven evidence as it was generated by law enforcement so details about it are known, but after the note is received, Donna calls Charlie and reluctantly says in code that the "TV" would cost about 5. "TV" was a code word linked in other communication to refer to the murder. The undercover told Donna specifically that this note was about her family not taking care of his brother after he "took care" of their *FAMILY PROBLEM 'UP NORTH'* and to make it even more clear for Donna - the undercover hands her the note with the 5 thousand dollar amount written on the outside and it was directly on a printout of an article about Dan's murder (!!!) Then, on that same call between Donna and Charlie, referencing the $5,000 asked for the "TV", Donna also says that they mentioned an ex-girlfriend and that it has to do *"WITH THE BOTH US."* Implicating herself and Charlie in exactly what the undercover is asking for - more money for the "TV" (murder). At one point Donna calls the undercover's number herself and says "I know my son in law passed away, but what does that have to do with this?"- "I don't know these people" i.e. playing dumb. IT WAS CLEAR from the get go, to all the Adelsons (all them huddled poolside at the condo that day known via discovery docs), that the bump was their first public contact who seemed credible and knew they were connected to the murder and they were freaked out. Charlie knew full well someone was "harassing" his family to get the cockroaches to crawl out (his own words on the Dolce Video). But he wasn't sure if it was a legit demand from someone involved, or if it was the cops planting something, or if someone in the public was just messing with them. Nevertheless, Charlie 1000% knew the purpose of the note- that someone was antagonizing them and pointing the finger at them solely about their involvement in Dan's murder and more importantly, that they still owed money to someone else involved. Scary, sure, but not random. They thought this was long buried behind them. Charlie's entire side of the conversation in the Dolce video supports him knowing this was about more money for the 'job', even though he is vague and naturally suspects Katie of selling him out. After all Charlie, Wendi, and Donna didn't talk, so it was someone on Katie's side that leaked info. Charlie tells Katie on the Dolce video this guy is 'big problem' and demands she get rid of him or I will- But, alas, a surprise. Charlie's also a freakin' coward and pressures Katie to make a call to the undercover and says let's give him a charity payment just this once, but then tell him to go away! He thinks this is a genius solution, and if Katie makes it go away she's still on their side. Win-win for Charlie boy. Believe me, after Charlie talked to Donna (and heard later about her terrible toilet troubles all night) he knew full well what the note was for and could keenly work out the purpose of the extortion. So, Charlie heard from Donna directly, and then Charlie told Katie in more careful terms that someone is screwing with them. They were purposefully dancing around each other because for all he knows she could have already flipped on them. Katie later tells Sigfredo on the phone that the note is from someone who knows something *"from the inside."* She un-ironically keeps calling him "that guy" and when Sigfredo finally says, Who? she says Tato. (I will comically add... you know, Tato the friend who drove you up to murder someone for hire?). SHE KNOWS exactly to a 'T'(ato) who and what Charlie was talking about at Dolce and she stonewalls him and later says almost word for word to Sigfredo on the call: *"They know too much."* She totally suspects Tato of being the rat and for now making their lives miserable. Law enforcement also reports Katie never calls the number herself even though she is telling Charlie she did. She is stonewalling him, and they are all LYING like crazy to each other, because they know they are in deep and dirty with each other and there isn't a huge amount of trust there (obviously). Of course, if Katie believes the note, she can't let Charlie know who Tato is and that Tuto brought Tato for the murder and now Tato's family is stalking your parents. She's quiet and puts her head in the sand because she had to. These aren't innocent actions and admissions. It is so clear to many of us that the bump got the family startled into finding out about who dared to verbalize their dirtiest secret, and go back to them for more money when this was over and done with. PLEASE, kind sir, review more of the evidence freely available online! What I've written here is only the highlight reel to your response. There is much, much more to study.

Law enforcement was so desperate for its clever, complicated conspiracy theory to be correct, it interpreted the wire taps under the influence of confirmation bias Katie not involved in the murder, so she simply takes the note, this guy (the undercover) at face value - extortion of Charlie's family. But, who, why, she doesn't know. And, to Katie, it seems unbelievable that the guy is referencing her in all this Because Katie is mentioned by the undercover, Charlie also takes it at face value - "who is extorting money from my family and why?". He doesn't realise that this is related to the murder. He's concerned that his family is being threatened, as any of us would be So, you have two people, neither of whom is talking about the murder or related topics, completely negating the whole point of the bump, which was to engender conversation between two co-conspirators in a murder-for-hire
@ladycymbeline
@ladycymbeline 2 жыл бұрын
I'm afraid you need to do more research on this case. There is a mountain of evidence that places Katie squarely within the organized hit on Dan Markel. It's really not that clever or complicated of a plan: A disgruntled brother constantly vents to his girlfriend about his mom and sister and their relentless problems with the sister's ex. Brother says he wants an ultimate, final fix to their family woes. No more jokes. The real deal. His mom gives the blessing ($$$) as she's now mentioned in sister's divorce motions (as a persona non grata with her grandkids). Whole family feels wronged and like sister/daughter's ex is trapping them. So, back to names, Katie hears what Charlie was willing to do, she sees dollar signs, upwards of 100K at least, and convinces her kid's father (Sigfredo aka Tuto) this would be a great "hire" for them, just do it and get it over with. Luis Rivera (aka Tato) says Katie pressured and badgered Sigfredo to do it. Apparently, she also desperately wanted to move to a better house and had expensive therapies to pay for with one of her kids, and there's even more motive for her involvement the closer you look. She very obviously tasted the money and wanted the 'bad boys' in her life to pull off this 'job' for her, quick and clean. Katie was ready and willing to cooperate with prosecutors several times over these years, but her lawyers talked her out of it giving her false hopes she could win at trial. She's had TWO times to share her story on the stand (and countless opportunities off stand) and in this latest retrial she comes across as purposefully vague, forgetful, and even annoyed. This was no impassioned fight for her innocence and wrongful arrest. Think about that and wait and see what happens. She's being sentenced later this month.
@ladycymbeline
@ladycymbeline 2 жыл бұрын
Also, Charlie *does know* that the undercover was attempting to extort the family because of Dan's murder because the piece of paper handed to Donna had an article about Dan's death it. And the undercover specifically tells Donna that this was about taking care of Tato (Luis Rivera) after he took care of the family problem up north. What else could that mean? The bump was successful, even if they people involved in the plot were muddled and not forthright (distrustful of each other), they still talked about it in their own way. Read between the lines. Why else would Donna call Charlie and say she got approached by someone on the street (who handed her a piece of paper with a price tag and article about Dan Markel's murder) and say that it involves "the both of us?" If the Adelsons via Katie were not involved with what was being presented on the paper, this would be a suspicious form of harassment or blackmailing and they would have gone straight to the police to report it.
