It's currently unknown about the season 3, but as the manga just ended, there may be a chance. And that's episode 24 of season 2. But it's only in the DVD release. It's during Gyokuen's long speech before Sinbad shows up.

Magi is a very popular manga, so the chance that they will make a third and maybe even a four season are indredibly high. Considering that the manga is in it's final arc leading up to the climax, maybe season three will come out in 2018.

I don't think you can, as it is done by another studio. If A-1 Pictures had made Sinbad no Bouken/Adventures of Sinbad, then yes, calling it season 3 is justified, but as it was made by Lay-duce, I don't think it can.
