He did what he thought was right; I've yet to hear any evidence that indicates otherwise, and I have no problem either with the verdict or that knocked back a few beers in celebration. I don't think he's hero, however; in the end, his chosen method of restraint resulted in a death. Insisting that he is one seems unnecessarily provocative. This is a win for Penny and good sense. It was a loss for Neely's family and NYC.

From a root cause analysis perspective, Penny *share* of the blame (of which he owns far less than NYC) is restricted to how he conducted the hold. I.e., right idea, botched execution. Kids, don't try this at home, etc.
