Noone should have to take any abuse over the phone. Most abuse never reaches the decision-makers, typically complaints only reach the secretarial/admin support staff. It's always best to ask questions first: how can I get a copy of my file? how can i correct / delete data? who had access to what data when? how can my patient file be transferred to a different doctor? can I block access to my data if it cant be deleted yet? how is my data protected?.... it's perfectly ok to hang up on abusive callers. Annoying or inconvenient requests are a completely different issue. Everyone loves the brave staff members who stand up to VIPs, celebrities and politicians and reminds them that unless they obtained a special privilege in advance, they must follow the same rules and join the end of the queue.

Sounds like he wants to get some dental insurance and needs some work doing. The Xray may show he already knows that there is a problem with his teeth.

Reading between the lines, I think he was registering at a private dental clinic for an initial assessment & price quote, for extensive dental work. He probably didn’t like the price or the proposed dental work, so he declined the dental work; & now wants his information deleted. The clinic probably declined his phone calls because he was being a bit weird & argumentative on the phone!

Or the ICO will tell them off and nothing will happen. Your data will still be there and if it gets abused or mishandled it will then be up to *you* to claim damages, assuming you can identify them as the source of the leak. Pro tip though: try to treat service providers with some respect. If you do you'll find most of these sort of problems then don't happen nearly as much if at all.

No, you can't insist someone deletes a health record - not until you can argue that the surgery is holding it longer than necessary. Otherwise, when you came to sue the surgery for malpractice, they would have no defence, because they had no records on which to base their defence.

My theory is that he went to register with a dentist and they gave him a x-ray so that they had a record of them, he didnt realise it would cost him money to have the x-ray done, and didn't want to pay for it. so now he wants them to delete x-ray so that they cant take him to court to make him pay for the x-ray.

I created a few systems that handle medical info. I've always been told by lawyers that we have 90 days to delete the data upon request. Daniel is spot on: do it written, ask for 7 days (even if they can argue they need 90), tell the ICO, the ICO will be useless. Fun fact: the EU could be scary when taking action on this. The ICO... much less so.

Can they make money from the NHS by claiming he is registered with them, when he doesn't want to be? They may have said they are NHS and then start quoting private fees, in which case you would want to leave.

It's mine. I don't know what they can do about it. They can sell my dental records to an insurance agency and show that my teeth used to be a disaster? Idk... doesn't matter why. It's mine.

EU didn't pass laws. EU passed frameworks (with unanimity). All frameworks were used as minimum parameters to implement LOCAL laws by member states. GDPR applies, until UK decides it doesn't. Either by lowering protections, or by not incresing them when the EU increases them.

@@HelloHello33333 Friend, I'm a lawyer in the EU. GDPR, as a regulation, applies to EU member states. If a member state creates an internal act following the GDPR, leaves, and maintains the act, the act persists, but GDPR does not.
