She might have been able to send a letter to her ethics board. She could get her license suspended for this. It gives lawyers a bad reputation to just say “I’m a lawyer. I will sue you unless you do what I say.” It this way was more satisfying. And she can still send the letter.

@@Alexagrigorieff an offer of settle excuse only works of if your have an good faith underlying legal tort. the standard is even higher for a member of bar as officers of the court the have a duty not to bring the integrity of the court into question. Unfortunately the statutorily damage for copyright infirned do have a group of "copyright troll" that are doing the cheaper to settle drag netting as the underlining tort, especial if to an adult entertainment copyright the appears to be violated. (see prenda law)

"The sweeping under the rug" is done because the investigation is never finished.... by resigning, they never search everything in the computer, and as such would never find the illegal files. It's not that they'd be willing to ignore the material because he resigned, it's that they'd never find it.

Usually it's true, but companies do it also to avoid cost & additional work (eg: giving statement, shout down for investigation, &ligal follow-ups)on an ex-employee & to prevent further impact with other employees. Note: the hr team can even bring up bs stories, to frame it as something else bec no formal investigation was done.

Management often have whats called a golden parachute in their job contract, its to carry them over until they get the next job. Its often written in such a way that they get it even if they sink the company or anything right up to but not actually commiting illegal acts.

The coupon story reminded me of something that happened long time ago, my family is not well off by any means. But a news paper company kept delivering a Sunday paper to us that we did not order. We kept trying to give it back and or find the person it was meant for because we didn't feel it was right to keep something we didn't pay for. We did eventually get it straightened out and the person was so grateful they gave us free movie tickets and voucher for ice cream shop that was enough for us all to get a treat.

so when somebody quits or resigns from their job they don't get severance if it's on bad terms. If they retire or the company let them go well that depends on how the company let them go if they retired they get their severance package and or retirement package. If they are let go on good terms I believe they still get their severance package as the severance package is when you are severed or released from the job/duty.

So that story about the sleazy mentors reminded me of a story of one of my mom’s first job when she worked in a legal branch of her company and female employees started complaining about a manager harassing them but the guy was bringing in a lot of money so the uppers ups told them to ignore it. Latter it was revealed the guy was stealing money from the company and he left. Now my mom works in Human ressources and she always take harassment reports seriously.

The second story is exactly why companies monitor employee work email and usage of work computers now. The company can be held liable and even criminally responsible in certain situations if it is found an employee is using company resources for that stuff. Being in IT I am sorry to say I have no problem believing this story is true. Even if they aren't doing anything criminal I tell all my client's employees to keep work and personal completely separate. Do not put any personal emails, cloud storage, messaging or social media on a work device. The company has every right to view anything on their property, even if it's personal.

I had a tenant -- let's call her K for short. She was on assistance because of a "disability." After moving in, she kept making demands -- like changing the locks and wanting BOTH sets of keys. Ah... NO! So, when her lease was due for renewal, I sent her and the department who paid for her rent a letter stating that due to her behavior, I would NOT be renewing her lease and why. When it came time for the walk through, she wanted her deposit back in cash. Yeah, NOT A CHANCE! I wrote her a check and the dumb**s cashed it! Then she tried to sue me for not returning her deposit, but of course I had proof. She said that if I paid her (I forget how much she asked for), she would drop the suit and I told her, "bring it on." I'd rather pay a lawyer than giver her one penny. She lost her case. One year later (around Christmas time) she calls and says she's suing me... again. I told her "go ahead." Never heard from her again.

I think the OP means in the second story that they'll never finish the investigation and therefore not see the CP stash. Also for the severance pay, depends on the director's employment contract. There may be things like unused vacation and unvested stocks etc that would be paid out even if the director quits.

The damage to the reputation of the company if something like this happens might be large enough that even a company that isn't sleazy would sweep it under the rug rather than risking the jobs of hundreds of employees. That said it is more likely that they just stop the investigation before they even find the images.

14:39 Sadly this is the standard operating procedure for many companies and institutions. They would rather tell the person "if you leave quietly we won't call the police" and wash their hands of it than admit they had someone like that working there. As lawful as it is to report criminal activity they find, it's impossible to hold the person accountable without also sullying their own reputation for having hired the person or associated with them in the first place.

Many big companies will stop investigations on an employee if they put in their 2 week notice. OP is right, in the companies mind, the problem is gone & not their problem anymore. The main reason why the usually continue with one even after the employee quits is when embezzling has occured & they want to press charges & recoup the money.. It's a shame but, many companies don't have a moral conscious when it comes to doing the right thing & doing it just because you should. If it's more work they don't want & don't have to, they likely don't!!

Answer to severance pay: The rules of severance pay for CEOs and directors are different than a normal employ, even his/her salary is different, they get pay for goals that the employs achieved. Some times they negotiated their contracts where he/she can get a severance pay even if they quit. Unfortunately some con get those jobs, not the best people, but the ones that are willingly to break the laws one way or another, this jobs are easy to sociopaths and psychopaths. The question is why big corporations don't make a psychological evaluation of their CEOs, their responsibilities are similar to an airplane pilot, the lives of people depends on his/her decisions.

Considering how the CEO was awful (not D level awful, but still bad), it wouldn't shock me if they'd try to sweep the situation under the rug because "he doesn't work here anymore, so it's not our responsibility". Also, D getting severance for quitting wouldn't be surprise, especially if he knew some company secrets that CEO didn't want out (more hush money than severance).

To answer DF's question at the end. If they were investigating someone for accounting irregularities and the person resigned... Work might stop because the guys already gone and why waste money and time investigating someone who's gone. It also would look bad if they brought him to court with the clients. This is VERY typical unfortunately. Were talking major fortune 500 company having a director in I.T. sleeping with his "admin assistant" while married...(and I deleted the rest...) lets just say both were fired for more reasons than that...and it was JUICY!

Thank Christ OP in the second story did what they did. They most likely got Justice for the coworkers D was harassing, they took down a toxic and scammy company, and most importantly, OP saved so many children, including D’s own daughter, from the horrific treatment of both D and his wife. SWEEP IT UNDER THE RUG IS STANDARD PRACTICE. They do it for malpractice, incompetence, and embezzlement, just to name a few examples. Anything is fair gain as long as the individual is gone. Anything goes as long as it saves the company from the embarrassment of having any form of malfeasance made public.

The pics of the kids, nothing to do with the company so they would not have to worry about it even if it was a company computer. As for his severance, depends on if he had a contract. At least that is how I understand all of this and it was 20yrs ago.

second story, the supervisor/Boss was hoping that they (internal search) would ignore the CP if he left the company, However I don't think that would work, as the IRS/Tax and other government agencies would be involved, seeing how the CEO was screwing the State, so that would of likely resulted in a second look through the records and backup. however the Boss likely wasn't aware of the CEO finance re-management.

Sweeping under the rug is actualy pretty common in big corps. They would rather sweep it under the rug than deal with the black eye they would get over it. The resign thing is in part because he was one of the higher ups in the company. The contract he had with them probably had a clause where he would get big bucks for walking away, also, they would be willing to throw money at him to make him go away, to sweep the whole mess under the rug.

Story 1. The karen being a defense attourney is NOT the reason why she hired an attourney. It is co sidered a very bad thing to do in the legal world to represent yourself, even if a licensed attourney. You will never see an attourney representing themselves in something they even have the smallest care about.

Unemployment rules vary from state to state, so depending on where you’re at you can quit and get unemployment. In regards to the other, most businesses have to focus on their product, and anything that makes that product less valuable is generally avoided. So, if you have an employee who has been there for years and has made money for the company then they don’t want it to come out that that employee was a child abuser who stored that abuse on company computers because that hurts the bottom line.

My husband is in IT, has been in all areas of it since 1986. Put it this way, his first computer, in college (graduated in 1978 with a BS in Chemistry), was a TRS-80. When I first met him 30 years ago, he was a tech from a small firm. He had been the first tech hired in 1986. This incident happened just before I met him. The company had grown and one of their clients was a big education group, one of several education groups that they did service for. They had the computers in to do service all the time. He got a computer of one of the instructors. As he worked to find out what was wrong, he was checking the file setup. He tried to back up the hard drive to an external and it wasn't all going over, like it had files that were too big. I should mention this was in the old DOS days, so things like that happened occasionally. He went looking and found a folder that was hidden. That's very unusual to find, especially on a computer from a school. He opened it to check the files and....he shut it down immediately and went to talk to the boss. That had police coming in and seizing the computer. He had porn in that file, on a school computer, at work, and there was some that didn't look like they were of age. The teacher was arrested (and fired). We don't know for sure how the sentencing was handled. My husband still remembers that one. So that last story had a VERY familiar ring to it for him.

Last Story: hey. What do you expect from a company that is specialized in sales? Of course they sweep stuff like CP under the rug! Because first: it's not their children. Second: it would cost them money and they love money more than protection kids. And third: If they are willing to ignore multiple SA / SH claims from multiple women just because their "best salesman" earns them tons of money you BET that they would ignore CP as soon as the culprit quits in their own terms! In the last story, OP wasn't saying that the company would ignore CP but that they hadn't discovered it yet. OP was the only person who knew about it and didn't want to report directly for fear of retribution. So, if the boss had quit, the company probably wouldn't bother to do a full investigation, they'd just delete his files and move on. As for severance, we're not talking about low-level jobs here. When you're a manager earning six figures, it's common to have severance and other benefits as part of the contract. The only way not to pay them is a severe breach of contract. Again, that breach did occur here, but the company would probably just pay rather than investigate.

Severance packages depends on the clauses in your contract. Bring in enough money and you can very well be able to get a clause in your contract stating that you get a severance pay as long as the termination of the contract is amicable.

How does she expect the store to just magically know her new address? We all know, or if we're stupid are told, to put a change of address form through for everywhere when you move. Or, if you don't want to write to everyone, or you're too lazy to do so, then all you do is get your mail forwarded to your new address for a fixed term and fee (on the UK at least) The store aren't mind readers and she cannot be that idiotic to sue over a $10 coupon... but apparently she WAS that idiotic. story 2 is completly possible, a crooked ceo of a hospital resigned under these circumstances. another hospital hired him right away, thus he got away scot free. the new hospital knew he was a crook, hired him anyway. 7 years, 7 bentlys, 7 vacations to foreign countries with his family and one new unnneeded building for the hospital. he finally ran the medical facility into the ground. from all appreances he knew what was going to happen, staff workers found out and spread the news that he had created an amazing nest egg. meanwhile the whole nursing staff lost their pensions, the ones that had been there long enough. the union was unable to stop it, boy did they try.

The executives have custom salary packages that are done by their lawyers and the companies. They get guaranteed wages even if they are no long working for the time of their contract (you can find this online where someone gets paid a fortune after working a couple of days even if the bank failed or whatever) so that explains the severance pay on quitting. They get special medical, special bonuses, special club memberships, cars, vacations, stock options, etc. the list is very extensive. Expatriates who go overseas get really complex packages specifying things like moving expenses, housing, where the kids go to school, the car, medical and a ton of details. It has to be in writing because these people are serious Karen's demanding everything. If normal employees had a contract we wouldn't get screwed as often by companies, but they just make sure you sign their legal documents when you get hired that says you are an at will employee and can be fired at any moment. We are considered interchangeable cogs despite education and experience. I have been promised a bonus to not quit and never received it, but if it isn't in writing you find out some people get the bonus and some don't. It is ok because I got them back financially and they couldn't do a thing about it. I like to hit them in the pocketbook as revenge when they get really nasty, but you have to be sneaky and not get caught. Hmmm wonder why they were not making much profit? My current revenge is going to take years but I enjoy it.

We’re talking late 80s early 90s in story 2 and for peons like us CP is a huge deal but for those money makers it’s a totally different ballgame. We would all like to sit here and think we would all think and react to gross and nasty shit the same way but it as sad and as unfortunate as it is it’s just not true. We don’t look at human beings the same way.
