There should be NO suspended sentences for anyone. He should serve 8 months. Also what also winds me up is when a headline says...Man given life sentence,then it says he will serve a minimum of 12 years. THAT IS NOT A LIFE SENTENCE. All sentences should be a minimum term of X .
@paulharper419610 ай бұрын
Yeah the term "life" needs to be reserved for the rare cases where it actually is for life.
@captainfantastic923810 ай бұрын
It is a 'life sentence' with a minimum tariff before being considered for parole. There is no guarantee that release will occur after the minimum sentence is served, only that release may be considered. If release under license occurs, the life sentence is still valid for life, and recall to prison may occur if the terms of the licence are broken.
@thefakewitchdoctorАй бұрын
As others have said already, but I just feel like repeating it in a different format Whole Life Term = no parole whatsover Long sentence/life sentence = no automatic release at half-way mark like shorter sentences. Instead there is parole which is not guaranteed. A convict who behaves himself impeccably while on parole can still be returned to prison with absolutely zero notice. He wakes up a "free" man, and the cops are at his accomodation ready to transport him. Obviously I've simplified it quite a lot and I don't understand it all, like extended license for long-term sentences.
@andyhaslam9231Ай бұрын
@@thefakewitchdoctor There was a story on BBC News the other day and the headline was attacker given life sentence. Second paragraph said...he will serve a minimum of 8 years. It is Farcical. That is not a life sentence it is an 8 year stint inside. All prison sentences should be served in full. Now if you get a 24 month sentence you only serve 12 so give them a 48 month sentence so they actually serve the 2 years. Then of course we would have more prison overcrowding.

Fifty-five years ago I successfully avoided an RTC when a driver pulled out in front of me at a T-junction. The driver of a police car, parked on the forecourt of a local pub, asked me if I’d got the rego. I hadn’t, and the PC breathalysed me, and arrested me. In those days the limit was 80, and I was 84; I was guilty. I was fined seven weeks’ pay, and I had to revert to normal duties, losing my parachute pay - twenty per cent of my pay in those far-off days - for a year. There is no mention of any fine or costs in this item, nor in the Daily Mail article. This clown was more than three times the limit, wrote off two cars, injured the other driver - broke his hand and wrist, according to the DM - and was uninsured. He got a suspended sentence for failing to provide a sample, dangerous driving, and driving uninsured, but no penalty for causing injury. It seems that when there is an actual victim, there is no victim surcharge! Doubtless a woke magistrate is responsible for this mockery against British ‘justice’. @CambridgeshirePolice Well done for showing this video, as well as naming & shaming the suspect! We never usually get to find out who it was, and only occasionally hear what the punishment was. For various legal reasons, offenders are normally always anonymous, whether that’s on social media, or TV documentaries, which honestly isn’t a right that offenders should be offered. It might also act as more of a deterrent if the system changed & potential offenders get used to the fact that (potentially) ‘everyone/anyone’ will know their name & exactly what they did. There’s probably hundreds of thousands of previous drink driving offences where the name of the offender is only known to the police & the courts. The media obviously can’t write a story about every criminal offence, so some people probably like the fact that very few people know about what they did. Sadly, not everybody seems to realise that the easiest & safest solution by far for everybody, as well as themselves, is to have *zero alcohol* if they are going to drive. If a taxi is a last resort, that’s still cheaper than the fines, court costs, and the price of much higher future insurance premiums, let alone the cost of getting around while they are serving bans. They could lose their jobs as well, meaning they lose their income. Is the cost of a taxi to prevent all of the above, as well as death and injury, still too much? Clearly not. One of alcohol’s effects are that it lowers inhibitions & affects judgement, so how do drivers know that once they have consumed less than, or up to the legal limit to drive, that they won’t be persuaded by others or the ‘moorish’ nature of alcohol to have more to drink?! They may very well have never started out with the intention to exceed the legal limit, but how do they know that they will definitely be able to stop drinking before consuming too much? If you have no alcohol at all, you don’t have anything to worry about, except perhaps other drunk people driving cars (!) Personally, I would also change the law so that the calibrated Drago breath machines (used at the roadside by officers) can be admitted as evidence (instead of just a ‘guidance’) especially when suspects fail to provide back at the station. While they might not be quite as accurate as the extremely accurate custody intoxyliser systems, they are still accurate enough & calibrated to be used on members of the public at the roadside for officers to determine whether they are suspected of being above or below the 35 microgram per millilitre of breath limit, so if they are deemed accurate enough to enable officers to arrest someone, then surely they should not just be treated as an irrelevant ‘guideline’ that is not evidential?! Just because the custody intoxyliser machine happens to be accurate to an even higher degree, in no way does that mean that the roadside Drago machines are ‘not’ accurate at all. Speed cameras can be fixed, or they are carried onboard police cars, but we don’t start dismissing the portable speed detectors saying that we can only trust fixed speed cameras, so why is this any different? Roadside Drago machine evidence should be able to be used in addition to/instead of the intoxyliser if the subject does not provide the ‘evidencial’ sample. The Drago results should at least be allowed to be admitted at least as a ‘ballpark’ figure if someone blows 40 or over (and yes, I know the legal limit is 35 micrograms of alcohol per 100 millilitres of breath), because it appears from watching documentaries that suspects are only actually charged if their custody result is over 40 micrograms of alcohol per 100 millilitres of breath, or the blood test equivalent which is 80 milligrams of alcohol per 100 millilitres of blood. When a driver blows 40 or over on a Drago roadside machine, that result was captured at the roadside which is very shortly after the suspect was driving, making it relevant. By the time suspects try to waste as much time as possible before being admitted into custody & then blowing on the intoxyliser, it just gives them more reason to hope that by the time they are in the intoxyliser room (which is always at least 15/20/30+ mins later) the lowest of their two results will be under the 40 microgram limit, however, that’s not a true reflection of their alcohol levels whilst driving, due to the time elapsed before the only admissible sample is taken. That simply cannot be right in this day & age! Safety for all road users & pedestrians is the paramount issue here, nothing else. The more people that stop dying as a result of drink driving, the better off society as a whole is. At no point during anybody’s driving lessons or test are they ever required to consume alcohol, far from it. So why is it acceptable for some people to feel they ‘need and/or deserve’ their allowance of alcohol before driving?! All it does is cost lives, and money from written off cars & road furniture damage. There is absolutely no benefit whatsoever of having alcohol in your system whilst operating a vehicle that probably weighs at least a tonne, it just massively increases the odds that one lapse in concentration, one poor decision, or one misjudgement could end in death, serious injury, or vehicles/property to be destroyed or rendered worthless by insurance companies. Yes, while products like mouthwash & some foods may contain alcohol which could lead to accidental/unintentional consumption of alcohol, we are an advanced enough society to be able to ensure adequate labels & warnings are mandatory on such products. I simply never have any alcohol at all if I’m going to drive, it’s really not difficult. You can’t also get drunk at night & expect to be sober in the morning. If you can’t calculate how many units you have consumed & how long your body will need to process & remove all that alcohol, leave *at least* ‘12 hours between the bottle & the throttle.’

So the guy had no insurance and was that lathered he had a head on. Why would anyone think he's going to listen to a ban? This should have been no insurance, drink driving, causing harm (be that property, injury or both) by dangerous driving and you can throw intent in with any or all of them depending on where/when he was drinking. There are probably some endangerment ones that could be thrown in the mix aswell and there is no way he should have got away without prison after that. But its a ban. Pathetic.

Call me harsh, but if you cause a crash while intoxicated, 25 years in prison. If you're caught driving intoxicated even if there's no crash, 15 years in prison. There should be no leniency, period. Driving while intoxicated is basically intent to cause harm, or attempted murder, or even murder. No excuses.

He got away with it then. Three times over the legal limit, uninsured and an utter danger to road users. The person in the red car was totally innocent and was the one who paid far more than this jerk (been wiped out myself by drunk uninsured drivers, it took months for the MIB to pay and even then the total costs were not covered). The MIB takes around £30 off every PAYING persons insurance every year to cover uninsured drivers like this jerk. Whilst he has paid nothing because, of course, he’s above paying insurance and the law. When are we going to have proper laws that treat these criminals with a hard sentence. People writing things the elites do not like get three years!

Years ago l saw a small car cut in two by a drunk Mercedes driver...he careered off the road and hit a tree, he stepped from the wreak with a minor wound to his head..The lady diving the other car had her leg smashed. When l walked to the smashed car l mentally prepared myself for a shocking sight, However, she was still conscious but her legs were a mess...l was first on the scene but was never called as a witness..which l thought was strange at the time.
