He is not their grandson. Biologically, he is the fathers. So as painful as it is, the grandparents entitlement is distorted.

@@Nyotakikora1 Yeah technically, the egg and sperm are not hers so not biologically her kid, but those two cells fed off her body and strength for like 9 months, caused major bodily changes, and she even died from the complications of rearing him... So genetically not her child, but yes it is her pregnancy and she is a mom in her own right. Moms carry and bring babies into the world.

Right, but grief isn't practical. None of us really know how we would handle a situation like that until we're in it, so we can have a little sympathy for both parties involved.

Surrogacy or not, why would the grandparents have more right than the biological father?

Because most of the laws written are from before all the surrogacy stuff was possible. Most laws assume if the baby exits your body you are the mother. Fathers get complicated. My Husband and I where not married when our son was born, we both had to sign a bunch of paperwork to get him on the birth certificate and was relatively easy because we where on the same page, just not married. In our state if we had a bad relationship I could have completely bared him at the time, he had no inherent rights. Ironically we could separate and i could have a baby with someone else, if we did not divorce husband would legally be the father no matter the situation. Eventually everything could be cleared up in the courts with DNA tests and stuff, but I would bet you would be celebrating the kids 1st b-day first. (I was entertaining the idea of being a surrogate years ago so I studied the laws.)

@@jamiea9634 Its not even about surrogacy lmao. If he wasnt biological father thatd be one thing, but in this case the writers just fckd up. I dont live in usa but even where i live (a shitty 2 world country) if you want to be a legal parent like if you knocked someone up, no one can stop you if you go to the court and say "hey judge, im the father of that cabbage". Married or not doesnt matter. One dna test and thats it basically. Yes, you might not get that cabbage to live with you but that depends on the circumstances. If the other parent died and youre not some low life like a criminal, no one will stop you from taking it with you basically

Why NY is so different from the rest of usa where most parents have equal rights to that? its still a biological parent which is easy to prove with the dna test. Its biologically closer to the child than its grandparents like in this case. Like. Freaking wot.

I’m sorry, but no. I work in child welfare. Fathers have right to their children before grandparents. Even if the child is older, has never met the father, and has a relationship with the grandparents. We make every effort to find fathers and give them every opportunity to be with their kids. In this situation, the child would go to the father without question.

I don't see how the surrogacy part has anything to do with it. Since SHE is in no way the babies actual mother, her and her parents wouldn't have a claim on the child. HE is the childs biological father. It doesn't matter if his name isn't on the birth certificate. All he'd have to do is get a DNA test, same as with any other biological father trying to get visitation rights or fight for custody. Whoever's eggs were used could have a claim to the baby, but that isn't addressed in this clip.

Nope. This is unethical. Those “grandparents” are acting completely selfishly and unethically and THEY made it clear they WERE willing to put their “grandson” in foster care just to spite his biological father. This doesn’t make me feel bad for them this makes me sick…

How? It was the JUDGE who decided to put kid in foster care not them. They were in grief. They were struggling with accepting their's daughter death and her illegal/immoral decision of being a surrogate. We are talking about bringing a baby to the world, not making a tree house. Surrogacy should be illegal as it is already immoral. It is a difference when you want to give a child for adoption. Surrogacy creates dangerous shadow land of so many unethical disasters, that you could write book about that.

She even said he was the father as they were wheeling her in... smh. Her parents are NOT the grandparents but the father is the FATHER. Such a messed up scenario. The "grandparents" make me the most angry though. They are trying to replace their daughter by taking away someone elses child.

This is heartbreaking. This is not just some stranger who pays girls to carry babies. They were best friends and clearly she wanted to help him with something that was very important to him. Being a surrogacy between friends, he probably bonded with the baby already through touch and sound. The baby is not biologically related to the grandparents and is not the last piece of their daughter they have left. She was still alive and they speak like she's already gone

Legally, the bio father should have automatically had custody before the "grandparents"? Like it's understandable that she can't sign away her own custodial rights, but that doesn't mean the father was any farther than a paternity test away from having parental rights himself.

With no way to tell which was which, king Solomon offered to cut the child in two, so that each mother had half each. 1 cried out against this, and was willing for the baby to go to the other woman as long as it lived. The other woman instead agreed to the bisection. The baby went to the first woman.

@@OrWhatWeHave her daughter was not dead, just dying, for all we know she could have gotten better and they took his son away from him even though the daughter made it. what if it was biologically both of their child and they were in a relationship? would they still have stolen the child? feels kind of gross to separate a family to fit your own wants, perhaps if they took the time to speak to their daughter they would have known what was happening, instead they didn't speak to her at all, show up not even knowing she was pregnant then demand the child because their daughter's womb carried it.

Which is honestly kind of worse because they knew the entire time she was pregnant that they wouldn't have a connection to this baby. So they should've been prepared for that already.

For people who are confused, in surrogacy, people who use their gametes (sperm or eggs) are usually treated as a donor until parenthood is passed after birth. So even though he is the biological father, he is treated like a sperm donor

@@jesse5658 doesn't matter that it's not her eggs. The person giving birth is the legal mother. Getting a DNA test just proves that his sperm caused the pregnancy. Sperm donors don't get visitation rights.

What's unbelievable is that in the US people believe you can pay for a baby and it's ethicaly and morally correct. No, human trafficking is not ok, you can't pay for babies or organs and the mother is the one who gives birth to the child, not the ones who pay for it. Capitalism anyway.

My sons grandparents fought for custody for ten years...draining all our funds, even kidnapping him once. Eventually they lost and by then my son had seen their horrible behavior and abuse of me and him. He refused to ever see or speak to them again. They wanted my son taken away because I was 17 and his dad and I had broken up. The bio dad gave up custody so they fought for grandparents rights. They ruined so much by their horrible attacks on me and my son. Theyve passed away now and my son is 26...he dropped them and never looked back.

That’s not the reason. He wasn’t listed as the father. Even if he’s biologic, he isn’t the actual father yet. Think you have to get the mothers permission, because she’s the “incubator”.

This show was made in 2018. Surrogacy became legal in NY in 2020. However, he is the father genetically, proof of which should make him the father legally. With or without surrogacy contract. Still, I enjoyed the story. Glad the child won't get stuck in foster care.

Surrogacy in the uk is different the legal parent to the baby is the surrogate until she signs the baby over so if she she’s married and she dies then the baby will then go to the surrogates husband

Now with surrogate vs. biological mother, that might be more complicated. Hats all of surrogates though, I know it’s not an easy thing at all. Even though they get paid, it’s still an incredible thing to do for someone else! Especially those who have cared for the baby for longer periods during covid,

@@kilianhufgard1035 But that makes sense in a case like this, where the baby has just been born (I would agree with you if it were about a child who is not a newborn, to some extent), and IF it were mother versus father. I don’t think some men realize just what pregnancy is. There is a reason why mothers have more weight. As we see here, it can literally kill a woman. It’s not a walk in the park and at the end, a baby just pops out. The mother carries the baby for 9 months and deals with months, perhaps even a lifetime of after effects. No way around that. A father biologically just has to show up at the beginning. But the surrogate made it clear what she wanted- she wanted the father to have the baby. This doesn’t make sense because her parents act in their interest, not in hers. But it is not mother vs father here. The issue here is that somehow the *grandparents* have a right to the baby and would rather it be in foster care than give it to the biological father, yet the father doesn’t. And this is a surrogate case. I know for a fact that if for some reason, I wrecked my body to have my own biological baby (not as a surrogate) and the father tried to take it away, I would not be happy. It’s like taking all the credit for a group project you just typed the title for, but much worse. But fortunately that’s not what’s happening here. He’s a great guy, as we can tell (and imo, would be a better parent than the grandparents for making such a selfless decision for his baby). The father imo should be 100% in the right to be the caretaker.

Find it interesting that with other shows if the surrogate mother decides to keep the baby (aka violating the contract) shows how out of their way to show that the surrogate is in the right. But whenever shows deal with the biological father wanting his child they either shows he’s in the wrong or they says he’s right but then try to make him change his mind.

Ive actually seen it different. I've always seen shows deal with surragote mothers who want the child as selfish, manipulative, and sometimes even mentally unstable as the disperate bio parents hold each other crying. I have seen a few shows take a more sympathetic look at the mother but she's still never right but we are still allowed to feel a lil sad for her.

you do know that when the woman is single, only her has the custody of the child. If they were married, both would have. This has been that way since forever and just because the baby by dna is his, does not mean he should get the baby. I think few people who use surrogacy would be this naiv and think they can have the baby in any state and it will be fine. In Europe e.g. suggoracy is allowed in some countries, so when the surrogate birthed in the country where it is not allowed, it is her baby so you must make sure, that wont happen. They always portray the dumbest people in these series.

First of all, contracts are rarely involved, people are stupid. Second of all, in the eyes of the law the mother is the person carrying the child, therefor even if there was a contract, the surrogate can't be forced into giving away her parental rights, aka civil case over the contract at best, there is no way of legally obligate her to give the child away. Now, in this scenario, I do not see why they are keeping the dude away from his child. Yes, the grandparents can technically seek custody since legally their daughter was the kid's mother, but there is no reason to keep the dad away, unless there is a suspicion of abuse. In conclusion, highly unrealistic scenario, irl the dad would have automatical custody and then if the ''grandparents'' wanted the kid they would go to court but the kid would stay with the dad until the trial (again, would be a bit different if there was abuse involved)

First of all, surrogacy contracts are enforceable in New York. But even imagining a world where they are not, there are so many issues with this. 2. Why is the doctor in court? (and in scrubs). 3. Why is the doctor speaking in court from anywhere other than from a witness stand? 4. WHY IS THE DOCTOR SITTING NEXT TO THE PARTY AT TABLE IN COURT!? 5. Why is the doctor advising ANYONE on legal matters? 6. The judge says there is an interstate issue, so it needs to go to a higher court, but state courts are free to hear cases that cross state lines and even if the case needed to be handled in a federal court, that is not a "higher" court, and it's not her decision which venue suit is filed in, unless venue is improper. 7. Remit? Appeals courts are the only courts that would need to remit a case (unless you're dealing with a jury verdict). Assuming that they are talking about appeals later in the clip, this was a trial court so how is this judge going to "send a case back" to a lower court, but to a higher court? 8. Also wouldn't you say Remand, or was there a whole trial with a jury that we missed? 9. Why is the doctor acting as if he knows the law and how court appeals processes work? 10. Why is the child advocate openly taking the side of one party? 11. Why are the only people missing from the court the attorneys?!?!?!?!?!?!?!?! 12. How is it a surrogacy contract if he is the biological father? 13. Absent additional facts, and regardless of any contract between the mother and the father, if a child has a living legal parent willing and wanting to raise that child, the grandparents have literally no say. The only way this scenario would be an issue and the only way I've seen it become an issue is where the surrogate is married, and the spouse is claiming parental rights. But also surrogacy contracts are enforceable in NY so maybe if there was a single lawyer involved and the doctor shut the hell up and stuck to medicine all of this could have been avoided.

The “grandparents” were horrible. Like it’s not their biological grandchild. The father loves the child and will take good care of it. The child would probably rather grow up with a father rather than grandparents. And like… if they kept in good contact they could have still been grandma and grandpa. No laws against how to call ppl. Instead they wanted to take away the baby and the father had to give it up in the first place for them to realize it. If it went to court and the father won, they would have never seen the child again I guess.

My heart breaks for all three of them. The girl's parents are grieving the loss of their daughter and this father has gained a son, but the cost was very high, indeed. Why couldn't they have reached some kind of compromise....like the couple gives the child to his father, after his beautiful speech to them, and he tells them that they can be surrogate grandparents for this precious child....so they could ALL have the baby.

I’m sorry but for cases like this I believe the grandparents are horrible and selfish. They already had their child and yes they are going to lose her, BUT this is the father someone who WANTS to be with the baby and I am only (enter age) but I’ve never had a baby so I have never that loss before. But just ask if they can be in the baby’s life it isn’t that hard 🤦‍♀️ I mean they were prepared to rip a baby away from its father and I don’t know that just rubs me the wrong way. And again I’m not mad mad and yes I know it’s just a show and I know actual parents grieve and wants to hold onto their child regardless the age for as long as possible, but they didn’t have to rip a family apart. This is a TV show. The court ruling would not hold as she is NOT the egg donor. If she was the egg donor, then the grandparents would have claim in a state where surrogacy is not legal. This is a typical bio ethical case often used in medical bioethics and legal studies. This baby has no genetic material from the woman or the elderly couple. If the egg donor came into the picture and was also suing for custody she -the egg donor-most likely would get the baby boy especially if surrogacy is illegal in the state.

This speaks a lot. I’m a mother of two (one is front my fiancés ex, though we have been fighting for custody as she literally left the state and hasn’t made effort but won’t give us full custody). So I understand how the government treats single fathers and it isn’t fair. If a mom wanted her baby she would 100 percent get the baby that easily. But to treat the father as if he is below the mother, is despicable.

No. Surrogates have spent 9 months and beyond with the baby. You should not talk lightly abt severing the bond between the two. The surrogate mom should be given time to at least say goodbye. Imagine you took care of a stray dog bonded and given name. After 3months+ owner came saying they lost their dog and want the dog back. Surely youll feel upset, youll feel lost. Saying surrogates have no rights over the baby is selfish of you guys. I know this reply doesnt have relation to the video but have mercy for someone that sacrificed their womb for a baby. I don't get it. The baby is still technically biologically his child. It's not like he used a donor, it's his biological child. This is why a will is so important asap you find out you are pregnant and/or while you are trying. Please note that Native American or other status can further complicate these issues. A non Native may not legally have the same claim on a child in those circumstances.

All they have to do is go to court show them the contract. And he can demand a paternity test to prove he's the father. The law in ALL 50 states says that the child goes to the remaining live parent. Which he is.

Terrible storyline. Started with a headache and now her heads gonna blow, a c section to a 3 month old, nurses taking a child from its biological father because there’s a contract but if there’s no contract it’s his?, terrible characters in grandparents who want nothing more than to grasp at their dying daughters legacy after being so out of touch they didn’t know she was pregnant and on top of that think the father is somehow pimping out women into pregnancy, then a shit decision from the judge with the worst excuses ever, then the only good part a grown man giving his son to his friends parents hey what about the real mother the one the embryo came from? Where’s she at?, then the grandparents call him back to one up him coupled with the worst acting I’ve seen in a long time and again a fucking toddler playing a 3 day old newborn

I know right?! If there was no contract and the birth mother died like that the bio dad wouldn't have his baby taken from him. Even if she was the bio mom (making the baby actually genetically related to the grandparents) and he was just some guy she had a fling with the baby would still be his (biologically and legally). The way too old baby "actor" isn't really avoidable though. Who wants their newborn on a film set with a bunch of stranger germs Lol.

hard to acquire a newborn for filming considering even healthy ones are on the immunologically weak side. Even so, there are scenes where it seems like they're actually using a life-like silicone doll.

Confusion i see runs through the comments on this episode. Father isnt a danger soooo he has the rights. Also, that is what daughter wouldve willed? Obvious intentions with the contract.

Everyone commenting obviously didn’t watch it all the way through. I understand where you want to be mad but they understand their wrong in the end and gave the father his baby back. They couldn’t get over the fact their daughter is dead so they wanted a piece of her that they knew wasn’t hers but came from her. That is grief and in the end they understood they were wrong and did the right thing.

But he’s the biological father… Anyway you slice it, he would still be the legal parent. Yes surrogacy isn’t legal everywhere but, the father will have rights to the child first before the “grandparents”.

I don’t get why this isn’t open and shut. If this was a sperm donation maybe??? But he’s the biological father, every single state would have him sign the birth certificate and he would have the option of custodial rights unless he waived them on purpose (and sometimes it is very hard to get them to waive those rights) on what planet does he have no ability to take the child home?

The parents thought this guy was the equivalent of a bystander who caused their daughter's death from a contract/exchange of money, they didn't know he was so personally involved. When he came in and started saying goodbye to his son and his friend, even willingly giving up his son so he could have a better life? The parents realized their daughter did this for more than just money and decided to respect her wishes.

Yes, since she did not sign her rights away, she is the mother. Anyone can say they are the father, so a paternal test should be performed. Since legally she is the mother, her parents can file for custody. Now, there is absolutley no reason for keeping the child away from their dad, unless abuse is involved. Is the ''belong to the mother'' thing real? In my country both parents have paternal rights unless the court decides one of them or both are unfit to care for a child. Do fathers have no rights in the USA? Like I am all from protecting people from abuse so if, for exemple, the father is a woman's rapist, then fuck him but normally shouldn't paternal test be enough for him to be able to take the kid home in this scenario?

Surrogacy contract aside, why wouldn’t the court issue a paternity test to confirm that the man is the bio father, then give him custody of the baby? That should supersede any claim made by grandparents, right? This doesn’t make sense.

I'm sorry but what legal right did the grandparents have in the first place? This isn't their child at all so I'm confused why their needed to be an injunction in the first place. There is usually contracts made with surrogates so what the grandparents wanted doesn't legally matter. Hopefully dad will be nice and give them visiting rights, that's what I would do
