Deducting a Mattress

The plaintiff purchased a bedroom set from the defendant, but when she went to the defendant’s house to pick it up, she was told the mattress wasn’t included. She claims the defendant changed her attitude about the furniture, so she’s suing for a refund and lost wages. The defendant argues the plaintiff demanded her money back at the very last minute. She refuses to return the deposit.

Something similar actually happened to me! Not a full set but I was selling a full wood sleigh headboard and frame for $150. Great condition and made it clear it was just the frame in the post. A woman wanted it, showed up, and asked where the rest was. I was confused. She wanted the frame, box spring, mattress, AND bedroom blanket set that was in the photo of the listing. She ended up taking it anyway but her and a group she brought sat in front of my garage a good 30 minutes after not leaving and acted like I was scamming them.

However, I do think she has a point on the hardwood versus particleboard thing because there is a clear distinction. $300 is a steel for all of that regardless but if she claims that it is something that it's not then that is problematic, however I also think the plaintiff was kind of just nitpicking because she wasn't happy with other things to which she was not entitled.

The Defendant can't require them to hire movers. I have heavy furniture & when you're dealing with stairs only 2 people can move it anyway. It does help to have a few people to load & makes it quicker & easier.

That's what I was thinking. I'll be moving state soon I'm probably selling my bedframe so that I can get a smaller one which will take up less space in the new place, but I don't expect anybody will want my mattress. If they want it, they're welcome to it, But I don't imagine too many people would. That being said though, it's actually quite surprising how many people do buy used mattresses. I never would.

What took so long? The ad said mattress not included. Case closed. It seems like the plaintiffs didn't read it carefully. And who brings 3 children to pick up furniture? The judge stopped it, so she took a chance and continued her crying in the hall. I know her husband died, but if you can't handle getting rid of things that evidently belonged to him, then for Pete's sake, don't even bother trying to sell it. Work on yourself first. The furniture isn't going anywhere. Of course, it did in this case because she sold it to one person and said she gave it away to someone else.

My husband and I recently moved and were getting rid of furniture… we asked family and friends if thy wanted anything…the conditions were must pick up and transport yourself..if it was not picked up by XYZ date it's being thrown away…. SOMEONE needs to watch small children, and you know it isn't going to be the parents while they're moving a room full of furniture. I don't think it was unreasonable for the defendant to tell them to bring some extra help - neither of the plaintiffs are of the age or in the physical condition to move a room full of furniture down a flight of stairs and out of the house without help - you KNOW they're going to be banging into stuff, scuffing walls, hitting corners and door jams and then leaving the damage for the homeowner to clean up.

Alot of furniture IS solid wood vaneer over particle board. This actually makes it more stable over time with humidity. It is rare that it will be all 100% solid wood. Draws might not open and close right if it is- over time and with humidity. Both were a mess but the judge got it right. The SELLER definitely SOLD the furniture. The ad was clear- mattress is not included.
