RBI भारत का केन्द्रिय बैंक है जिसके कार्यों का सीधा प्रभाव देश और नागरिकों पर पड़ता है । अत: RBI की यह जिम्मेदारी बनती है कि वह बैंकिंग नीतियों की दशा और दिशा को RTI कानून के तहत नागरिकों के साथ साझा करे । हालाँकि ऐसी सूचनाएँ जिससे देश में निवेश एवं आर्थिक क्रियाकलापों पर प्रतिकूल प्रभाव पड़े और उन सूचनाओं से आम जन का कोई सरोकार ना हो , ऐसी सूचनाओं को साझा ना करना ही बेहतर है ।

Supreme Court in in it's judgement said that RBI cannot deny information on Annual inspection report of banks to RTI. RBI position is that under Section8(1)E - It shares a fiduciary relationship with the bank and hence cannot disclose information. However, RBI needs to explain what's the fiduciary relationship here. Why Disclosure is essential? - RBI provision which overrules RTI: RTI supersedes every other section in RBI Section 22, RTI: this will prevail over any other legislation other than official secrets act - RTI Act, 2005 - RBI has fiduciary relationship with people as well. In 2016: SC - RBI & banks don't have fiduciary relationship - If needed in public interest . PI can be determined by CJI, speaker LS, President/ governor, Administrator of UT - Macro level - bank health not revealing private individuals Effect: - Can be an impact on economy. - real state of banks. - Capitalization, share holders should fund money to save depositors in public interest It is very important for institution like RBI to have disclosure & transparency to build public trust while maintaining confidentiality & fiduciary relationship with its banks. RBI & RTI can exist together.

RBI की स्वायत्तता पर भी आँच ना आए इसलिए जरूरी है कि अपनी सूचना साझा करने के समय क्या RTI को अपनी सूचनाओं को बताया जाना करगार सिद्ध होगा ये तो आने वाला वक्त ही बता सकता है!

The concept of a 'fiduciary relationship' especially between public institutions which maintain a large interface falls short of any 'credibility'.However, the associated risks of bringing into light the financial relations which the banks maintain with their customers,their financial position in terms of the loans which they lend 'except the retail ones' does require wide ranging deliberations. Equally, let's not forget,that various SCB's do come out with their list of wilful defaulters in the public domain and do submit their annual performance reports highlighting their achievements and the downside risks to their business. Therefore,what is required are readjustments in the system wherein the crucial aspects which tend to bolster the larger 'national interest' are given the top most priority.
