The idea that these decisions should have been made through law is fair on its own, the problem is that the reason these decisions don’t happen through law is that the senate is designed to favor conservatives. That's the brick wall that Destiny runs into so often with these guys. It's a question of ethical prioritization. When Destiny exposes a pattern of blatantly unethical and illegal actions on the conservative side, what they really want to say is "so what? We don't care about that. It's not as big a deal as you think," etc. Because they don't place the same amount of value in the criminal malfeasance of Trump and his cronies. It means that even getting these guys to admit that something happened or didn't happen ultimately doesn't matter and it will not move the needle for them on what is ethically acceptable.

I think Destiny and Pisco did their best countering the “Biden in 1992” talking point, but they were still too charitable towards the conservatives on this panel. it was incredibly frustrating hearing no one clarify the fact that Biden never said the SCOTUS nomination had to occur under the next administration. in contrast, that was McConnell’s *explicit* goal. The context of a situation may demand the undertaking of what may be considered "bad" actions. "I don't like jailing my political opponents, but when my political opponents attempt a coup of the government I think they should be jailed." In my reading of the conversation, the conservatives are not able to distinguish the difference between immunity and innocence. Just like everyone else, even if you are innocent of a crime, you have to demonstrate that in the courts. And the president already had protections and safeguards from frivolous litigation. Between executive privilege, the Federal Torts Claims Act (which substitutes the federal government for lawsuits against civil servants), the lack of ability to compel to testify for the executive and immediate advisors, not to mention the same kinds of pre-trial motions for dismissal that are available to everyone. The president already had more than adequate protection to perform his duties without the immunity ruling. edit: fixed misspelling of "Torts"

An Ivy League Professor had the absolute best idea to reform the SCOTUS. Leave a majority of seats vacant and for each case being reviewed they are filled by a case by case lottery from a pool of Federal Judges. You can't control if the case you bring will be majority Dem or Repub nominated judges. The lottery winners may even act more neutral because they may be vetted later for a permanent seat, and it can be thrown back in their faces if they attempt to pull a partisan stunt.

William Rehnquist, who engaged in voter intimidation of Black Americans, strongly defended segregation during his early up and coming career and disdained almost every civil rights landmark case, was made The Cheif Justice of the Supreme Court. Castle Rock vs. Gonzalez, where you can't sue the police for gross and extreme negligence. A woman called the police several times about her ex-husband, who violated a restraining order and kidnapped her children. She even went to police station to beg for help, and the officer on duty ignored her and went for lunch. Clarence Thomas defended a Texas AG who made it policy for his assistants to bar any person of color from a jury and even called them slurs in his policy guide. This is just the first time people started paying attention.

First of all 1:46:20 we all can agree now that stabbing kids is wrong, and lucky for us we live in a society with institutions that will intervene on our behalf to stop a kid stabber. But you go back far enough and that is exactly what we did, eye for an eye. The simplest way to make someone understand how what they did made you feel is to do it back to them, to send a warning to them if they should try and do it again. This was our morality because this works, because this is effective. We don't do it anymore because it causes unnecessary harm and further greviousences, because we have better alternatives. 1:47:39 In the soccer analogy if one team cheats should the other team ignore it and fight on 1-0 or should they cheat to even the score. Your concern is that if they cheat it ruins the game because now both sides trade cheating. But that's not how it works. If one team cheats first and then the other team cheats to even the score, neither team is disadvantaged, neither team is morally harmed because the first harm was addressed. For the cheating to continue a new first case must occur. This is the real optimal game theory play. You even the score, and then you go back to playing fair. If one team cheats and there is no other recourse, then you must even the odds and then go back to playing fair or they will win as far as the game theory operates with simulating tit for tat. I truly appreciate the concern about a race to the bottom, but that only happens if the side that cheats first cheats again, or if you choose to "preemptively" cheat again. If they are willing to cheat unprovoked why do they need a justification to cheat at all? They don't need a justification, which is why you do not need to fear giving them one, you only need to fear being wrong about them and closing the door to good faith actors. The reason mercy and forgiveness is a virtues is because it allows good faith actors to reconcile and work together. This cannot be done with bad-faith actors. Going back to the stabbing thing if the Democrats offer an alternative solution to resolving greviouses and it is rejected with no alternative, which I remind you was the preset condition to trigger court packing as stated by Destiny and Pisco(i think pisco), if the alternative resolution is rejected then what other choice is available but a return to the tit for tat philosophy. Morality is a luxury for the powerful and power takes many different forms. If they refuse to play fair, to play by the rules, then the rules no longer serve their purpose of preventing foul play and only serve as a rope tieing your hands behind your back. Maybe we are so much better than them that like an anime protag we can win with that constraint, but when the stakes are high I for one always got annoyed at Goku risking the fate of the world on honorable death matches. I do apprcait which as a moderator, but I think he doesn't fully understand the optimal tit for tat strategy and why it is sound, at least he did not demonstrate that understanding in this stream. Veritasium did a great video about it, I'd encourage people to watch it or watch it again if you've already seen it.

Typically, though, the other team gets an empty net goal. So the team can sometimes turn a one goal lead into a 3 goal lead because of two empty net goals. There is literally no difference between the losses, they count the same.
