All things are poisonous when you have too much of it, water will kill you if you drink too much and oxygen will kill you if you breathe too much of it. You can survive in a high oxygen environment for a while and how long depends not only on the oxygen level but also on the barometric pressure (the pressure determines how much of the oxygen can be absorbed by the lungs). At sea level with 35% O2 you will likely last about 24hours before you start showing the signs of dying, but at high altitude it is possible for a human to survive indefinitely at 35% O2

The first animals lived under water because there was no oxygen. The land was completely barron. Not even dirt just rock. Creatures called stromatalites then evolved. They derived energy through photosynthesis so after a very long time they created the oxygen needed for animals to survive on land. Once the atmosphere was OK animals started to move onto shore. Evolution went wild and all these guys showed up...basically.

But until the Devonian all animals were indeed confined to water as were many plants, During the Cambrian I doubt anything in the way of plants had evolved to live on land.
