Detained For NOT Taking Photos (I'm Suing Merseyside Police)

During the Conservative Party Conference in Manchester I was unlawfully detained under Section 1 of PACE by a Merseyside Police Constable who used the excuse for reasonable suspicion as having a camera and NOT taking photos.
I therefore intend to sue Merseyside Police in the County Court for the following causes of action:
-Battery (physical contact)
-False Imprisonment (insufficient reasonable grounds to detain and search contrary to the 'objective test', see PACE Code A, Paragraph 2.6B)
-Trespass to Goods (unlawful forced unlocking of smartphone and photographing IMEI number under threat of seizure)
-Breach of Data Protection (data processed unlawfully because it was obtained through means of an unlawful search)

You probably know already, but make sure you make a Subject Access Request for his body cam footage of your interaction and video footage from an cop accompanying him in his unlawful actions. I’d also advise not to carry. ID.

S.1 pace is related to stolen or prohibited items. What reasonable grounds did he articulate. S19 gives powers to seize items where there are reasonable grounds for believing the items were obtained by the commission of an offence, or which is evidence of an offence which is being investigated, and the seizure is necessary to prevent the evidence being concealed, lost.

You don’t get any change from £100 k for a High Court legal case. You guys need to rake a reality check. The case would likely be dismissed as groundless and possibly vexatious. Which would result in a costs order against anyone daft enough to bring an action in the first place.

It is likely the Merseyside officers are part of the MATRIX unit (formerly operational support division/group). They are noted for their aggressive attitude and cavalier regard for following the rules/laws. Back in the day when I was a police sergeant in Merseyside the OSG's forte was stitching up harmless intoxicated students leaving the clubs on a Saturday night. For the life of me I don't know why all the specialist units in Merseyside are called MATRIX but I'm sure some Super who's never left headquarters for years got a pat on the head for dreaming it up.

Appalling. It's a difficult situation to be in but on balance I think it would be better to hold your ground and deny the unlawful orders. They may arrest and or seize your property but payout would be much higher. Do you know if a Section 60 order was in place,

I will find out. Unfortunately I couldn’t let my phone go as it would cause a major disruption. When conducting a Section 60 search the detainee must be informed of this. I was searched under s.1 of PACE.

Make sure you sue, technically they are under Greater Manchester Police under as mutual aid request from GMP, to Merseyside Police to supply additional officers, but i think would sue Merseyside Police as they are badged by them, HNK Solicitors will be able to advise, look forward to video updates
