I have a theory about mean drunks. When I was young and stupid I got intoxicated in public more than once. However, I was a happy, loud and silly drunk. I was never mean, hateful and aggressive. Alcohol does not make you into a terrible person. It just allows the terrible person to come out.
@Angel-pg7nm11 ай бұрын
Exactly! Although I've never gotten drunk (alcohol isn't good to me), my mom would come home on a rare occasion drunk from being with her friends and having a good night. She didn't make it. The driver drove right off but thankfully they did find him. If any friends drink with me I really push them to stay over if possible or get a ride or call a cop/uber/whatever. I used to have a hard time doing that but once she died so young because she was doing the right thing and walking home, it really made it easy for me. In Australia we have what’s called the “Paddywagon”. It’s a police vehicle that basically has an enclosed caged area at the back. Where the arrested are kept, completely separate from the front where the police officers are seated. So if people kick, punch, scream or get out of their cuffs. They can continue on to the police station with no harm coming to them. And they don’t have to listen to anyone verbally carrying on. There’s a camera to keep an eye on the arrested. Usually if you can fit a joke somewhere in there and get them to laugh it breaks the combative attitude. And, if it doesn't, at least the people in earshot all get a good laugh and realize that you are just doing your job and not intentionally harassing someone over nothing. What's wrong with field tests? Unless you know you're gonna fail I guess. Then yeah don't take them 🤣prolly just admit at that point
@ostlandr11 ай бұрын
Thing is, in most states, if you fail the FSTs and blow over the legal limit, you get your license suspended for six months. But you can apply for a conditional/hardship license that restricts you to driving between home and work. But if you refuse, it's an automatic, immediate 1 year suspension with no conditional license, even if you blow 0.0 later. Any SOBER lawyer knows their state's DWI laws backwards and forwards, and whether or not they're an Implied Consent state. In those states, when you sign for your driver's license, you also give your consent for FSTs in the future.
@ostlandr11 ай бұрын
@@Neebooneeboo in Europe and the UK, they don't bother tying up the police with that nonsense. They don't even pull you out of your vehicle. They politely walk up to your car with the portable breathalyzer. Makes the police SO much more efficient.
@kellylewis71977 ай бұрын
@@ostlandrI’m with you - get a preliminary breath test and go from there. Save us all some time. The ONLY purpose of a Field Sobriety Test is to gather more and more evidence related to their level of impairment. People can claim the breathalyzer was faulty or was measuring the alcohol in your mouth from a very recent drink. Breathalyzer has to be done at least 20min after last drink and FST helps pass the time from the start of the police encounter. Sober people can “fail” the FST and there is zero benefit to the driver for submitting to it. If you’re actually not impaired, insist on breathalyzer or blood test back at the station. If you haven’t added resisting charges, etc, THEN you can go home. Refusing the FST doesn’t add to your charges.

Hey, in NYC those illegal aliens (that is the term codified in Federal law under Tile 18, United States Code, Chapter 12) beat up a couple of NYPD officers the other day, in broad daylight, in front of security cameras.
