Fuck proof of it not being his kid - he is also literally holding proof that 1) the kid's mother knowingly committed perjury, 2) the judge is ignoring evidence, 3) the prosecutor is pushing for convictions when they have evidence to the contrary, and 4) the process server lied on an official document DAMN!

Well, the mother did not commit 'perjury' - she didn't testify that he was the father. She was forced to give a name to get welfare and so she just pulled one out of a hat. I've heard of instances like this where the mother wouldn't dare give the real father's name because he was ganged-up and would kill her and the child in a heartbeat. So what is she supposed to do? Live behind a dumpster with the baby or pull a name out of a hat? It is the welfare system that is to blame in cases like this.

Or the education to defend themselves! Let's be real. Not everyone catches these issues as quickly, or even has the understanding of the paperwork to know that they're being hosed in the first place.. Steven Avery & Brendan Dassey come to mind... Such an unjust system for those without the tools to fight it.

Lamar Cox Welfare, ironically, doesn't care if their policy puts you in danger. How, exactly, is a new mom with no cash going to 'leave the state and start anew?' She is, after all, applying for welfare. Please specify the elevated ethical standard up to which men are held in this situation?
@HeatherSpoonheim
@HeatherSpoonheim 8 жыл бұрын
Lamar Cox First - she did not commit perjury. You should look that word up - it doesn't mean what you think it means. Secondly, she was forced to provide a name in order to provide her child with a roof and food. She did what she had to to put a roof over that child's head while the father wasn't held to account at all. The father of the child wasn't held to any higher standard at all - so there is no 'double standard' here. All you have is bureaucracy that victimizes an innocent man - but you seem to think that a single mother should be held to account for that bureaucracy rather than the state. So really, you are holding her to the higher standard - why the double standard?

And he would probably wind up paying more in court and lawyer costs than he could ever hope to recoup. That's the built in injustice in our courts. If you're poor, you can't seek recompense or just settlements. The wealthy can. So guilt or innocence, responsibility or injury, they're irrelevant. Assets and wealth matter.

Many states preclude that from happening. The child support order is signed by both father and mother, and include no provisions for fraud or misrepresentation included in the agreement. There are also little to no requirements that child support recipients spend the money on the child. My friend paid support to a child who lived with him for all of high school. I paid support to my ex when my son lived with me for the six months before college, and her husband withdrew all those funds and spent them on prostitutes for himself for several months or years. There's no way my friend or myself could sue either woman, per state law pertaining to child support orders. And this was told to em from a prosecutor sympathetic to our situations.

@Brian Mino Maybe, but the server will never be served over it. They do this all the time. Just find any old address, say refused to sign, done. Least amount of work. If you are working abroad, these days they are sometimes allowed to serve digitally if getting to you is difficult. That means just a message or image to any internet account that they claim is recently used, bam, served. Or just go to your mother's address or a distant cousin. For the least amount of work, they can just list a bunch of names by means of public announcement as it is called. Just a call in a local crappy newspaper. If you cannot or do not read it, your own fault. If you were working a Kazakhstan oilfield for your employer, well should have read the paper in bumfuck Michigan to stay on top of any possible paternity suits.

@janlockhart2846 7 жыл бұрын
david perkins Every country you mentioned has problems, but that's not because of liberal policies. Did you know that Michigan is the only state where elected officials can have their authorities taken away by the governor...a policy put in place by the Republicans? It's a violation of the Constitution, and yet, the only thing you seem to care about is not helping people in need. The majority of people who need assistance requires it because of greed. It's ironic that you say liberal policies ruin economies when California is the most liberal state in the US and yet, its economy is one of the largest which proves your theory wrong. In contrast, the poorest states which require the most assistance are under Republic leadership which translates into more Republicans receive government assistance or as you say handouts.

I know a guy who married a girl who had a five year old. The dad never paid any child support. They had a kid. Three years later they divorced and not only did he have to pay child support for his kid, the court mandated he pay child support for her kid. That just isn't right. There is no recourse against public servants that exhibit bad behavior. There was a case where a guy was accused of robbing Walmart. They compared the theif on security tape to the defendant and they were clearly not the same person. The prosecuter said he didn't care and pushed the case through anyway. The guy went broke staying out of jail. And there was nothing he could do to the prosecutor or judge that allowed it. We need to make some changes.

@@great159 No need to marry her. I looked into it and it is quite fascinating how that works. Marriage simply makes it easier for them to make you pay. For example, in Quebec, you can be held financially responsible for any child you paid toward for a period of 6 months or more, but nowhere does it say that 6 months has to be uninterrupted. So you date a girl from your past, she has a kid, father absent. You admit to taking dinner home every weekend during dating, leave after say 4 months, and somehow you end up in court and are unaware and admit way back you also had expenses the kid benefitted from for 2 months or longer, well too bad, you can be made to pay your full share. Did you also know if you divorce your wife, you are named father by default for a minimum term of 1 year after divorce? So if she has a kid with some dumb dumb, pops out a kid 10 months after divorce, decides that deadbeat is no good, she is set. Ex husband is the paypig. Kids born during a marriage are also usually presumed to be by the husband, with often 0 legal recourse. Another trap, getting married or getting engaged during a pregnancy. Often enough it is as solid as an adoption, old French law. No need to get married, common law or getting engaged or even having the kid benefitting from your presence can get you on the hook.

In the interim you're stuck in a sort of limbo where you can't hold meaningful employment, you're fearful that any minor transgression will result in your arrest, and you lose social relationships because of the taint of guilt unfairly applied to your name.

For those who think this is a freak case: THIS IS VERY COMMON! Talk to a few people online. I have shared this video on a couple of pages so others can chime in.Although this particular case deals with 1 child who truly was written in as a dependent, the blanket problem stems from the courts typical decision to ignore requests for 50/50 shared custody and responsibility.

You are right! Baby men are being held accountable for children that are not theirs! All because the mother "said" he is the father! Laws have got to be changed.

The state should give him his 33K back and pay some sort of damages! Or at least, give that money to his actual daughter as he tried to do originally! The system is broken, as he said!

The state determines paternity early on and it's nearly impossible to reverse it. For example, a husband is presumed the father of a child in a marraige, no matter if he knows she cheated and accepts it or he doesn't. They say it's for in the best interest of the child to not question paternity later in life of the child and cause havoc but it's obvious that it's just about collecting money from someone who is most convenient. The jail stint does matter in this case because the state could look that up and see and shouldn't have accpted the process server who obviously perjured.

The law says they can make you the father because in their eyes your past pay check had more income then the bio father. The law says they can make a father for a child if it can provide better for the child even if its not your child.

My mother did that group rate when she went to court to get my brothers father to pay up. She added my sister's name to the order and because the dad didn't go to court he paid support for all three kids. But what made it remarkable was the fact he treated my sister like she was his! He never threw up in her face that she belonged to some other man. He was her father until the day he died!

I emailed MI Governor Rick Snyder. This is what I just got as a response: Thank you for your recent email sent to Governor Rick Snyder regarding your concern with the process to determine paternity in Michigan. The Governor has asked me to respond on his behalf. He believes it is important to listen to our constituents and I appreciate the time you took to comment. While we can all take pride in our achievements so far re-inventing Michigan, it is not a license to become complacent. We appreciate your thoughtful remarks and should this or related legislation reach the Governor’s desk for consideration, he will keep your comments close at hand. Again, thank you, for taking the time to share your concerns with our office. Please let me know if I can be of assistance in any State of Michigan related issue. Sincerely, John D. This happened to my friends brother. He was married and she cheated, got pregnant, and didnt tell him. When they go divorced a dna test was issued and even though the kid wasnt his, he still had to pay child support because he signed the birth certificate and took care of him for 5 years. What the fuck is wrong with the system that this is happening!?!?! We are from Illinois too btw. So its not just a Michigan thing.
