If a mother can't support her child with her own income she shouldn't have custody. Period
@KarlSanathos
@KarlSanathos 3 жыл бұрын
No. That would put any mother in the dependency child support was invented to prevent. Every parent has a responsibility. She is taking care for his child. If he does not want to see or deal with his child that puts the whole task on her shoulders. Living on 1k/month does only work because she has a free space to live in. You can not punish every single mother for the sins of some.
@potatoes402
@potatoes402 3 жыл бұрын
@@KarlSanathos that doesn't make sense. People shouldn't make a living for taking care of their own child. That's your responsibility, not a job. And if you can't even feed your own child then giving the custody to the other party who is financially stable should be the fucking right thing to do. Don't let the kid starve when there's a better option.
@KarlSanathos
@KarlSanathos 3 жыл бұрын
@@potatoes402 What the better option is depends on more factors than financial status. Forcing unwilling or endangered caretakers to stay with their partners just because they would lose custody enables all kinds of really bad situations. I do not deny that the system can be exploited. But combining custody and money while a child needs a caretaker which is at least for the first 3 years a full-time and then until the child has a job a part-time job puts the caretaker at the mercy of the money provider. Having to provide for one's offspring is an accomplishment not a burden. It gives freedom to the caretakers.
@potatoes402
@potatoes402 3 жыл бұрын
@@KarlSanathos lol, the topic is about the custody, so if there's a fight for custody, the one who can provide the best for the child should win. And clearly a mother who can't even feed her own child isn't suitable.
@KarlSanathos
@KarlSanathos 3 жыл бұрын
@@potatoes402 So the one who has a job and has the money but isn't available at least 10h/a day should win custody but the one who has the experience and time should loose? Not all caretakers are gold diggers. In my opinion no one should loose custody as long as there is no clear indication that the child is way better off without that person.

He said he's getting 90 on a GOOD year. Meaning that's not a normal case. This is still the sum the judge issues on and notes that it's a very slight increase over reported. Yes, If I had the chance I would make the child support upper limit to still be a percentage of the dads income, but to also be based on the moms income. Say up to 50% of the moms income, not to exceed 30% of the dads kind of thing(numbers are just an example). Then, mothers would have to work to receive support and if they don't, they should risk losing custody.

In Theory I agree but the reality is (though not in the fake case presented as she lived with family) is for most single parents man or woman receiving child support its very easy to justify it going towards rent alone. Dude was paying 600 a month. Im guessing they would be in Houston or DFW area if this case was real. 600 is approximately half the rent expected on an apartment with the child having their own bedroom. She upped his support to just over 1000. That kid almost certainly eats more than 200 a month in food and 200 in incidentals like hygiene products and growing out of clothing etc. What you want is an itemized receipt. News flash. you do that then someone in the government has to audit it. Guess what that means? Your support is going to go up for overhead costs or our taxes are. Are there deadbeat moms who go get free clothes at the church and salvation army cheese etc so they can spend that support check on themselves? Yep. Its not going to be most of them for the same reason most people follow other social norms. So what you want is to raise my taxes because you stuck your dipstick in crazy? No thanks.

Well, first of all, this is scripted and these are actors. But let's assume this case is real: First of all, even though she is being portrayed as incompetent and arrogant, being a full time parent is not an "I do nothing" job. A stay home mom is celebrated when she's married. Why is she not when she's divorced? Most women do wanna have a career and a baby and people always assume they can't/shouldn't or even accuse them that they will be bad/ neglectful mothers. And that's when they actually do have a partner to share the house chores and parenting. But when they're completely on their own, with full custody, then the world expects them to pursue a career, cause otherwise they're taking advantage of men? I don't get it. Also, when a parent, regardless of gender, is making more money, they would want to spend more on their child as well, exactly because they can afford it. Why is it that divorce parents view child support as "giving my ex a salary" and try to avoid paying it? These are money they should be gladly spending for their child. Besides (again this is scripted, but for the sake of the argument), he couldn't have his career and shoot those thousands of porn videos, while being a real full time father to his own child. Thus his ex being a stay home mom and having full custody is actually helping him to make more money. Personally I believe both men and women should be independent financially and pursuing careers but, still, they should get child support if they have full custody. Child support exists for the children, not for the adults. Whoever gets full custody should always get it.

That was weird. So even though the two have been split for 9 YEARS and the dad got paid more (Presumably people will get paid more throughout their career choices) he's still liable to get a child support payment modification not in his favor? So it's a punishment for doing better. With the other crap going on... and people wonder less young men are willing to get into a relationship.
@JeffEshom42

In theory the courts are there to ensure the kid is taken care of. They do usually allow padding-they consider a percentage of say fuel costs or rent is reasonable as the child does benefit from those-gas for example to take to school. This is why there is usually say 1k a month (made up number for the made up scenario)-they modify based on inflation or additional costs. This case sounds like she hooked up with him to get leverage and try and bilk more money-but yes, support payments can be modified and are modified based on *need of the child* not greed of the parent. In theory.

@@JeffEshom42 That theory goes right out the window when you know that the courts are not allowed to do an inspection of your ex's and child's living conditions without giving the mother notice. As well as you not being able to demand receipts for what the money was spent on. I tried this once in Wisconsin. I knew my ex was not using the money I gave her for our child. I demanded that child services do an inspection and I was told they had to give the mother 2 weeks notice. As if she could not clean up her shit in that much time..... Child support is just wealth redistribution from men to women for doing nothing. Because, if it were about the health and welfare of the child, the vast majority of women would not get custody of the children to begin with.

This is why I would support a system where all child support be monitored and refused if the item does not help the child in question. Clothing for children or uniforms, yes. food, yes. bills, yes. schooling, yes. Approved computer for schooling, yes. hobbies, unnecessary. parties, unnecessary. unnecessary means limited if at all. handbags? no. Designer adult clothes, no. a phone, no that is a privilege even for a kid. I mean my mother never got a cent payed from child support for my sister, and when he died his current gf at the time lied and said he had no family. They were going over the money at one point years later, found my sister in the records and called my mother. Long story short, she didn't get nearly as much as she was entitled to but did get some. Know what she did? Only spent it specifically for stuff that my sister would use, like schooling. When she turned 18, all that money was given to her to use freely, rather than being in my mothers possession. That is the responsible way to do it.

She spoke about it in figurative sense. He lied, by law both parents have to release their income and exchange tax returns. He under reported his income and didn’t pay the amount he needed to pay. This has nothing to do with her working or not, child support collected from a high earner.
