I think I get what he's saying though. He recognized them as neighborhood children, knew where they came from in general but couldn't have identified which was which girl.

to be fair, JJ is splitting hairs with the witness. How many groups of 3 little girls of the approximate same build and age are playing together in that neighborhood? It's not a huge logical leap to say "hey you might want to talk to defendant's daughter (and friends) because I'm fairly sure I saw them playing around your car earlier."

@@nora4981 No, she is indeed splitting hairs because we have children in my district and I can identify my neighbour's children from far even if I can't see their faces because they all move in a group and there's no other group of children that fit that configuration in the district. So I might not be able to tell you which individual child did what but I can tell you that I just Mr. Thing's children going somewhere or doing something.

@@DanielleA2023 It is but Judge Judy is not a judge, despite the name of the show; she's an independent arbitrator. She herself has told litigants before that the burden of proof required in her "Courtroom" is less than in an actual court. That's one of the reasons shows like this exist; for cases which would be too difficult to prove in a normal court. Here, you just have to convince Judy, and she says often that her "life experience" has taught her what things are likely true and what things are likely fibs, so let's not pretend that these cases rely solely on law and not on Judy's common sense and judgement as well.

As a black woman I have to agree. He’s tap dancing around how he identifies them because he probably thinks if he identifies them by their race he’ll be crucified for it and there’s no reason to do it. These little girls are black and if they’re the only little black girls in their area it is what it is 🤷🏽♀️. As long as he’s not being disrespectful or rude about it I personally don’t see what the issue would be with that.

So three OTHER little girls blew into the neighborhood and decided to scratch up a car right next to the house where the 3 little girls of the same exact height/weight/hair live? He may not have clearly seen their exact facial features--but come on, you can tell who a person is by their height/age and weight, etc. If there was another group of 3 little girls in another nearby house(with the EXACT same description), I could understand not making the stretch. I don't think that is the case though. You can positively identify someone without being close enough to see "the whites of their eyes".

I haven’t watched the rest of this parts to this case, but I think what the witness to the plaintiff meant was he couldn’t see their faces as in he could tell which of the two girls were leaning against the car; not that he couldn’t see who they were, period. Also, he looks like he’s holding back trying to say the REAL reason why it had to be those girls 🙄
