The notes from Diddy's cell WEREN'T excluded. The prosecution was ordered to destroy their copies, until the judge has had time to read through the originals to determine if anything is confidential or not. If it is determined not to be confidential, then new copies will be issued to the prosecution, and they will be admitted into evidence.
