Wasn’t threatening, abusive, obscene or offensive language or behaviour by Charlie. So there’s no breach of byelaw 6. In addition, Charlie appears to have been on public land and not within the station or station property when the security staff accused him of breaching byelaw 6. As such, the byelaw is irrelevant in this situation in any case. Bit of an overstep by the security staff and rail staff here. There’s a common theme here however. If you are stopped by the police, they’ll often use common sense and discretion. They’ll talk to you and normally leave you alone. But when you get people acting under designated powers, such as these security staff or litter patrols working for the council - they all want to move straight to enforcement or prosecution. A little bit of power, or perceived power, seems to make many individuals act in an extremely authoritative way that isn’t fitting or proportionate to the situation. Compare the reaction of the construction worker to the reaction of the station staff and travel safe staff. The construction worker knows Charlie has done something he wasn’t meant to, but it caused no harm so he’s not fussed. He’s friendly and leaves Charlie alone. Now look at the station and travel safe staff. Approaching with an air of self assumed authority, the verbal and body language is different and the intention of their conversations are different too. They perceive themselves to be powerful and of course expect Charlie to submit to them. At the end of the day, there’s a chap with a camera. He’s not bothering anyone, he’s filmed a few walls and a heater. But how much work have the staff put in to trying to get him to stop, leave and give his details. How much did that cost the company in staff time and what about the reports / intelligence and processing of images afterwards? Perhaps that time and expense would be better spent looking out for people there with hostile intent, looking to harm others - instead of the guy with a camera making a KZbin video.
