@@TheScoops82 I think it took me a bit over a year. My military background is in the Special Operations community. When I went before a judge for my SSN disability, I already had my VA. I think I was 70% Va at that time. Now there is a state advocate at your court hearing that will try and find a job for you. The judge I had was very kind. He asked her if there are any civilian jobs I could do with my background. He said I don't want to hear he can work at fast food or this or that he said with his skill set. Basically, knowing I can't, and she wouldn't be able to find anything. He said no your honor. After that he said OK, I'll give you, my ruling. A few weeks later he gave me full SSN disability. So don't give up, don't quit and as long as you have everything from your service record documented and you are disabled according to the military you should get it. For me it's an extra 1550 a month. It's worth it!! Good luck too you!!

@@doomkid1331 yea, you will be denied probably the first 2 times. Just have to go through the process but once you get a court date hopefully that will be your time. However, it's never a sure thing.... that's the sad part. If you get a good attorney, you should be fine.

I am a 100 percent P and T veteran and I work for DDS. DDS is the state agency that approves SSDI/SSI claims at the initial and reconsideration appeals. My job is to make initial determinations on initial child and adult claims. Basically, to get SSDI/SSI in most cases you have to prove that you can’t do any job in the national economy that’s found in the dictionary of occupational titles such as a Walmart greeter, movie ticket taker, security systems monitor etc. The rules get a little easier for applicants over 50 via the grid rules/medical vocational guidelines.

My cousin has 100% for PTSD and has social security disability. He said where VA has left him alone, SS every couple years do a re-evaulation and the last time they tried to discontinue is disability. He had to get statements from family and neighbors to keep it.

You have to have enough credits or file with in ten years of getting out. If you lost your legs and then were homeless for 11 years after getting out of the military.. Denied forever for Social Security

I took all my medical paperwork and had social security make a copy of it all for my claim. Like 4 months later, I was a go at that station. Then I did the long battle for TDIU.

I got 100% P&T as a Veteran; my civilian job’s HR filled my SSDI claim once I was unable to work there and was awarded SSDI two years later. It takes a while, but it can be done!

Why would they ask? It’s money that you paid into social security. That’s your money and that’s what it’s for. If you’re unable to work you’re only paid an amount that’s your primary insurance amount it’s not like the Va where you get the same amount per percentage. The more you paid into it the more you get. Some people will only get 400 a month. Also, you are subject to SGA, if you work and make more than 1600 a month your benefits will either stop or result in an overpayment. I think you’re referring to Title 16 SSI in which you wouldn’t qualify for if you’re making more than 914 a month.

I am 100% P&T and received it with a year after I retired. I also submitted my claim for SSDI at the same time and was approved first time up in two months. Combat Craig is right about medical evidence but I would also add make sure it is medical evidence relevenet to what you are claiming, not just your entire medical record.

As a young veteran on ssdi I can tell you one has very little to do with the other…this man knows what he’s talking about , however you are allowed to work on while on ssdi in a limited fashion assuming your are able to do so

I'm at 90%, but I get paid at the 100% rate due to the unemployable rating I have. I applied for SSDI and got denied 2 times. So I guess what my question is if the VA said that I'm unemployable, why can't I get SSDI?

After a 2 year process with a social security lawyer. I was approved back in September of this year. I must say, it nothing like the VA process at all. I STRESS - YOU MUST HAVE PATIENCE DEALING WITH SSA. The reward, if you are approved. You do recieve back pay from the date you filed, you get medicare and plus your monthly SSDI check. You have nothing to lose - GO AHEAD AND FILE. SPECIAL NOTE: In most cases you will be denied on the first two steps of the process. If you are denied on the first two steps, then you will get the opportunity to have a conference call with a judge. At this step in the process, you will get the chance to discuss your ailments and how they affect your everyday life.

I would amend your special note. More than likely, you will be denied on first application and first appeal. I only say this because I won on my first appeal, so it can be done.

That’s false. You only get Medicare beginning with the 25th month after approval. Medicare isn’t automatic as it’s normally given at age 65.

When applying for SSDI what is the initial process? Is it like the VA, you have to submit documents proving your disability when you first apply? How does it work?

@@livelife8739 yes, there is a stack of forms you must fill out and turn in (either at your local office, if you can get in, or online (I don’t recommend this). My recommendation when you go to turn in those forms is to also, right at the beginning, have every pertinent medical document in hand, and hand those in also, in person. When I say every pertinent document, I mean shotgun them with paperwork. This should be a giant hardcopy stack of DOD medical records, VA medical records, comp and pen records, records from the time you went to a walk in clinic at such and such place, documents from this other place, documents from a mental health provider (if applicable), documents from the chiropractor (if applicable), ect ect. On the top of this stack of papers should be a copy of your VA disability summary sheet, showing your VA % disability and for what things. The whole point of this is if you hand them 800-1,500 or more pages of pertinent medical files, and include a nice little one page summary on top from another federal agency, what do you think the typical bureaucrat will do? Read all 1,500 pages, or go “Good lord, I don’t want to read all that, I don’t have the time to read all of that.. what’s this summary on top all about? Oh, looks like they have all the documents to back it up. Seems like an easy decision to make in their favor, let me go mess around with someone else’s case and mess it up.” They (the SSA office workers) won’t want to take them. They will tell you that they can’t. They will tell you that they don’t want them and that they will just send requests to all the locations you listed on your provided forms. That is utter BS. They will get stonewalled by organizations that are wary of HIPAA and not get your files in a timely fashion. If they won’t take your stack of medical documents, then tell the person that you want a written letter, signed by them or their supervisor as to why they won’t take your medical file that you are providing right now. Either they take the stack, or you take a letter and your stack back. Once you turn in your forms and ALL medical files… time to wait. And try your best to keep your patience. OP is correct, most people, including veterans, typically are denied on initial application and first appeal. In my case, I won on first appeal, but that is very uncommon. As soon as I lost initial application, I hired a lawyer that specializes in SSA and SSDI. The fees for the lawyer are not paid up front, but is conditional upon you winning your case. You don’t win, they don’t get paid. The fees for the lawyer don’t come out of your pocket, they are paid out after you win from your backpay, directly by SSA to the lawyer, in accordance with the law, 25% or $7,200, which ever is less. Don’t worry about the fees quite so much for the lawyer, focus on following their legal advice, that is what they are going to get paid for eventually. Make sure it’s a lawyer that you have a good rapport with, just like finding a VSO that you have a good rapport with. If things go well, you will eventually get called about scheduling some exams (similar to VA C&P exams). More waiting afterwards, but once exams are done, decent chance it won’t take more than a few months after the exams for an answer. Hopefully it is a positive outcome, and if not, then your lawyer will know what to do next, probably dealing with a judge at that point. Start to finish, my application, including initial denial through appeal/exams and winning was 1.5 years, as a vet under the age of 50 with 100% P&T. They will use your age against you if you are under 50 or 55, don’t remember which one. Good luck, and go for it!

VA disability is a compensation for something the military inflicted onto you. Its not like SS which is a citizen given benefit for the disabled. Its important to remember that VA disability is doing what it does in order to prevent legal results. If a veteran were to sue, legal fees could more than triple the cost rather than just giving the money outright. This is why the VA really fights lawmakers that want to remove VA benefits. For example, the law that lawmakers were trying to push that said if you make over 120k a year you can no longer get your benefits. All those people could just sue and they would be perfectly within their right ESPECIALLY since the VA already cleared them.

I am 100% TDIU (80 schedular) PTSD/TBI, for 2 years. Filed for SSA Benefits at the urging of my Attorney that did my TDIU. After 11 months of waiting, got an SSA denial (waiting for letter). I was told that its very common to get denied the 1st time but not explanation why its common. Was told my appeal will likely get denied, though no reason given. This sounds like a long and constant game that definitely isn't right for those of us that earned this benefit. This is very frustrating.

I disagree with the assertion that social impairments have no impact on SSDI claims. When we look at listings Part B for multiple mental conditions, let's take PTSD as an example, we find that social interaction is indeed in play. One of the four paragraphs of Paragraph B reads, "Interact with others (paragraph B2). This area of mental functioning refers to the abilities to relate to and work with supervisors, co-workers, and the public. Examples include: cooperating with others; asking for help when needed; handling conflicts with others; stating own point of view; initiating or sustaining conversation; understanding and responding to social cues (physical, verbal, emotional); responding to requests, suggestions, criticism, correction, and challenges; and keeping social interactions free of excessive irritability, sensitivity, argumentativeness, or suspiciousness. These examples illustrate the nature of this area of mental functioning. We do not require documentation of all of the examples." Emphasis on "...Understanding and responding to social cues...keeping social interactions free of excessive irritability...."

Good info Craig, but, did you know if a service member who goes for a period of 60 months without working and putting into social security is not eligible for SSDI? This is regardless if you worked 5 years or 40 years. You can have cancer, a missing leg, 100 percent PTSD, unable to work, etc, but if you go a period of 5 years of not working and not putting into social security, you cannot collect SSDI! Youll have to wait until you’re at the minimum age to collect the full social security benefits if you’re entitled to do so or start working again until you meet the minimum social security requirements to collect SSDI if you’re under the age of 62. Research it.

If you’re not currently insured or worked enough for 50 credits then no you will not qualify. That’s called a non medical review. They will let you know that first but u can basically walk into a social security office and ask them are you currently insured or what’s my Disability primary insurance amount And they’ll let you know if you’ve worked enough.

SSDI is based on an inability to work in the workforce. After 5 years you are considered out of the workforce.

It depends on the severity big disability and what type of disability. Did u even watch the video? There’s a whole list of acceptable disabilities and every Va disability isn’t on the list.

Well I guess my story goes completely against the grain of the video and the comments. 1. I filed for SSDI while in the military after being told that I would be medically retired at 30%. 2. Never hired a lawyer. 3. Completed exams during and after I got out. Approved the first time within 4 months. Received 2 years back pay for me and my daughter. 4. I received 60% VA Disabilty rating shortly after and it was not for what I was medically retired for. I’m still fighting to be rated for that condition. So if anything the VA are the ones being difficult. Stating that my condition isn’t in their scheduler, so they can’t provide a rating for it… 🙄. Anywho, I digress. 5. After 5 years SS said I was good enough to go back work. So I tried for 5 years. Condition got worse and worse to where I finally received my 100% P&T in 2021. I continued to try to work full time for the next two years but my condition continued to get worse until I was hospitalized for it last month. 6. I’m working on reapplying for it again and no I will not hire a lawyer because you don’t need one. I went through the process the first time without one and I’m going to do it again. As SSA claim specialist put it, hiring a lawyer is a waste of money, and they can care less about you. I did it before without their help, I’m going to do it again. 7. Who can represent you better than you??? I know people will find my story hard to believe but it is all true. You don’t need a lawyer. The process doesn’t have to be long and drawn out. You don’t have to be denied two or three times before you will get approved. You don’t always have to go to court in order to be approved. And you don’t have to be older to get approved as I was around 29 the first time I got approved. I’m just Not sure if receiving it before will have any impact on my second application. I hope my story is helpful to someone and that I shed some light on this topic. SSA is not as bad as how many people paint them to be. Have faith, and follow their instructions. Thanks guys…

Hi Craig. I have some questions. I’m at 80%. 1. I’m trying to get a Nexus letter before my next C&P exam in 15 days, I was diagnosed by a C&P Doc and denied when I filed presumptive for planters. The VA said that my flat feet did not prevent me from going into the service, however my feet have gotten considerably worse to where I had the VA Podiatrist write me a letter on my medical records and I’ve been given insoles, they’ve scanned my feet and have given me custom made insoles now and a few other things. Is the veterans resource center a good place to get a Nexus letter? The VA Doc won’t write me one due to conflict of interest. 2. Before I got out of the active component I was diagnosed with severe spinal stenosis, and it has gotten worse I’ve been going to all my appointments and have medical notes on my records regarding this. Would it be wise to file for TDIU? Thank you

I have 90% disability with the VA, I was quickly denied by SSDI. Medical issues with joints, hearing, some mental health meds still functional. Seizure disorder and multiple sclerosis are a major issue why I’m not working. Not employed steadily since 2013. I have 2 years before I can collect my pension from a previous job

Once you get your regular SS, you can no longer get SSDI. SSDI is disability insurance, just to pay those 100% disabled, but are still too young to collect their retirement social security..

I could be mistaken, but I believe that once you have SSI because of your age, you can’t get SSDI. But don’t take my word for it, contact a local to you lawyer that specializes in Social Security Administration law and ask. I just got approved on the 26th, and I believe was told by my lawyer that once I hit 65, it will automatically convert over from SSDI to SSI.

I tried once for the SS. Even took it to a judge. I’m 90 w P&T and the judge looked at me and said you are too young to get SS and then asked me if I had social media. Hmmmmm

Okay, I hear you. I'm that 100% T&P with heart failure and brain damage, two of the larger physical disabilities I was left limping away from service with. Meds are literally keeping me up right and they denied me, even after appeal just a couple months ago so...whatchya got I can use lol?

I’m not Craig, but I did just get my first appeal approved, so my advice might help. I’m 100% P&T also. Start shopping around for lawyers that are either local to you or in your state (DO NOT sign on with one of those large national law firms, they don’t care about you at all) that specialize in Social Security cases. Preferably speak to a few of them. Ask their background, training, do they know the judges in your area that see these cases, how long have they practiced this kind of law, ect. Once you find one you feel good about (very important!!), see about getting the lawyer hired. It’s on a conditional basis, flat rate $7,200, paid out of any backpay you may receive, and the lawyer gets paid from SSA directly before you receive your backpay. Yes, sounds like a lot, but it’s worth it. DO NOT HAVE, GET OR APPLY FOR A JOB ONCE YOU START THE PROCESS OF APPLYING FOR SSDI!!! It will be used against you! Next, once you have the lawyer hired, listen to his advice and do what they tell you to. They have a vested interest in you winning, so they shouldn’t be advising you poorly (this is why you vet them before signing a contract with them). Your lawyer will need all your medical documentation, so get your DoD AND VA medical records. Your local VA hospital should be able to provide you a copy, and if you go in person, you can request a hard copy. If you have other questions, feel free to reply here. Mine just got finalized on the 26 of December, so now I’m waiting on monthly entitlement payments and the backpay. Good luck!

Have you got disabled lawyer? If not, get one. I was 70% from VA, for lower back and other. First time I filed by myself but got denied lol. 3 years later, hookup with disabled lawyer from San Diego and 7 months later got approved with back pay. NOT FOR 3 YEARS BUT 7 MONTHS. Well worth the 30% of backpay. And then 3 months later, I got 100% p/t.

Jesus they sucked, they asked ME questions about claim "Have you heard anything?"...for real, thats YOUR JOB VA ADVOCATES🙄I'll find another group and reapply next year

And when you hit 66, they'll change you from SSDI to regular Social security thus causing you to lose access to some disability programs and now subject to income tax. When I told Social Security that my body parts did not grow back and I was still disabled, they said, "sorry, those are the rules"...

Both its different programs. SSDi is from your PIA/ paid into social security and what you would normally get at your fulll retirement age which is a different amount for everyone and u have to had worked a certain amount within the last 10 years and be insured (40 work credits) to qualify. Va benefits is based on a degree of disability that is service connected or secondary to a service related disability or illness. Please research this stuff and not just ask cc a simple question because these processes are long and will eventually force you an appeal which could cost in lawyer fees and losses through waiting to get paid and inflation ruining your dollar value.

Okay let's reverse this this. I am 100% SSDI. Now will that help with my VA claim? Do I even need to bring that up? With everything that's wrong with me it took the social security administration all of 5 months to disable me and it usually takes at least 2 years. @CombatCraig I’m 100% P&T and was Retired as an Employee from the Social Security Administration as an employee through Office Of Personnel Management (OPM) for PTSD. Since then I’ve been fighting with Social Security to get SSDI and have denied three times because they do not accept VA diagnosed disabilities and VA Providers will not write anything in regards to any of my care. I’ve printed and provided over a 1000 medical proof documents including numerous emergency room visits. Currently pending judge hearing. Can you provide recommendations on how I can better prepare for this?

Full disability doesn’t even put a dent in someone’s rent/mortgage, especially in the Bay Area. 2 bedroom apartments can be $4,000/mo or higher. A veteran with 100% and one or two dependents cannot even afford that. So what are you saying? Disabled veterans should only find places to live that fall UNDER their benefit amount? Give us a break.

You can’t collect both SS payments. If you are 100% & ssi then you aren’t getting that Ssi payment since they consider your va payment for ssi which would zero out that pay or close to it. Better off on ssdi

You are too old to be considered disabled for employment purposes by SS. That's the reason for the disability check. SS converts all SSDI checks to SS retirement at around 65. The VA will compensate disabilities for life.

My lawyer that I hired after first denial said to not have, get or even apply for a job while going through this process. Said that SSA can and will use that as evidence against you. So, I’d say no based on what the guy I’m paying told me.

If you're 100% P&T and you also get a retirement check from 20+ years of service you will not get SSDI. Senior enlisted with 24 years plus 100% is over 8K a month after taxes.....

Stop trying to be stoic about this. Squeaky wheel gets the grease. If something hurts or bothers you, you can show it was due to military service (nexus letters), then you are entitled to disability pay. Don’t have the mindset that if you apply, you’ll be taking money out of another veteran’s pockets and food off his table. It doesn’t work like that. If you don’t ask, you don’t get.

It was always looked bad upon of you went to sick hall or complained. So here I am, trying to figure out why I’m broken. Got to figure it out the long way I guess.

@@Beardedaxe94 I was in the same Army where you was shamed for going to sick call etc, but I took care of my self. I knew of vets who refused filing with the VA because they felt it was being weak getting dissability from the VA. I saw this kind of feelings all through the 90s but after the war in Iraq and Afghanistan starting kicking off and soldiers were coming back injured, things changed. When I retired in 2015, the Army made all retirees, ETS, chapters, etc attend the VA briefing. It’s now call the Soldier Alumni part of getting out of the Army. Big Army was tired of soldiers saying they didn’t know and blaming the military for not helping them out. I blame the E4 mafia and the military shit house lawyers for bad info. Sorry you missed out on some good info while you was in the Army. All you need to do now is get a VA rep and start filing claims. It’s going to be a long road but worth it in the end.
