You click deny - your cookies are still being used, cause this thing was basically made just to calm the business owners down

This happened to my mom. She has celiac, and she went to a restaurant. She saw they had gluten free bread, and ordered it, she asked the staff if it's gluten free, they said. She received the bread and it did not look or smell gluten free. So she asked the staff to ask around back the cook if its gluten free. She once again got a response of, yes it's gluten free. She didn't trust it so she gave me the bread. A staff member saw and asked. She told she knows it's not gluten free. I confirmed that it doesn't taste gluten free. Finally they called the manager and he confirmed that it was in fact NOT GLUTEN FREE. Luckily my mom is smart about these things, but I find it insane that at this world if you have an allergy, you simply can't trust the staff.

This case is also kind of important. This clause that you cannot sue the service, its parent company, or affiliates is present in nearly every single terms of service you have ever signed. If the court rules in favor of Disney, then a precedent will be set which will make these companies essentially immune to litigation even in the most extreme of circumstances such as the death of a loved one through extreme negligence or even willful ignorance. It will be a huge win for corporations that will place them even further outside the bounds of the law. They will no longer be obligated to have any quality control or safety standards. They are too large to compete with and now they don't even have to make sure that say, the food they produce is safe to eat.

My wife is a lawyer said it is unconstitutional to withhold someone’s right to a jury trial. Disney+ has nothing to do with their theme parks. The other month I reinstalled Star Wars Knights of the Old Republic, only to get a phonebook sized Disney EULA shoved in my face to agree to for a game I bought before Disney even owned Star Wars. Searching through it reveals that you, too, give up your right to present any case before a judge if you have any claims to make against Disney when you agree to it. For a game that came out 21 years ago. One of the most revolting companies in the world.

I have severe food allergies, and have had to go the ER several times for them because of cross-contamination or other mistakes on the part of restaurants. I HAVE NEVER had to sue any restaurants, every time I had a severe reaction, the restaurant owner was extremely apologetic and willing to pay for the ER bill. Disney is genuinely evil, why wouldn’t they just pay for funeral expenses quietly and avoid all the public backlash? This hurts them more than helps them.

As someone with severe nut allergies, restaurants in America have always been such a nightmare. I have fully stopped going to any because of how many bad experiences I have had. One time they put nuts on top of my food, when I asked them to remake it, they just scraped off the nuts and gave it back to me still fully contaminated. It's truly horrible how bad allergies are treated in the US

There is no penalty for piling 50 laughable arguments on top of one core decent argument. But not doing so *could* result in some technicality you didn't see coming, or bad luck & a nutty judge / jury, and then you lose the case. So you throw *everything* you can think of - including absolutely laughable trash tier nonsense. It's a complete waste of everyone's time, yes, but it's very common. People can get penalized for entirely frivolous filings, but not for adding bucket loads of frivolous crap to one halfway decent argument.

This is so damaging for the reputation of Disney, a multi-billion dollar company. I hope the husband keeps up the fight and a judge dismisses that stipulation that has NOTHING to do with their case. That clause should not even be legal in a Disney Plus subscription. Clauses should only apply to what you are signing up for. Not all of their subsidiaries. I hope everyone hears this story. It's both heartbreaking and appalling. And I hope people boycott Disney and cancel their subscriptions to stand with this family. Also for their own protection to get that clause removed from Disney Plus subscriptions.

i think another point that’s i haven’t heard anyone mention is that large parks, such as disney, do NOT allow you to bring your own food! disney is hot, lots of walking, it’s exhausting and you need to eat. it’s devastating to see people say she chose to gamble with her life when she was probably in fear of a health issue due to LACK of food. disney can act as much as they want like they “cannot prevent cross contamination”, but whether you chose believe that or not… it should be acknowledged that the option for her to safely bring her own food was also taken away from her!

No contract should be able to sign away a human being’s rights. That is inhuman and disgusting, any contract that attempts to pry away the signer’s rights as determined by a judge should be irrevocably null and void. Being paid your due by someone who has wronged you is, by law, our rights as a citizen of this country, and a Disney contract should never be stronger than the consumer’s rights outlined by the law. And I don’t think it would hold up in court, regardless of what the Supreme Court had to say about it.

You can't enforce terms that are unreasonable to a certain degree. The husband is allegedly unable to sue Disney because of the Disney+ free trial. Imagine if specific people on a police department were unable to investigate Disney because they had used Disney+. It would be absurd. Edit: Charlie brings up a good point in the video. The husband had used Disney+, but the now passed (respectfully RIP) wife never agreed to any arbitration clause. Because the damages are to the wife/the husband is acting on the wife's behalf, the arbitration clause is even more unreasonable and would no way hold up in a court of law.

Even so it would still be unreasonable, don't quote me but I've heard of cases like roblox where is the person hasn't read it or smth or are a child where they are knowingly unlikely to read it, the contract is null and void. So even so it should not be allowed, another thing to add is gross negligence - massive bodily harm or death ignores there contracts so. They are still able to sue based on those two precedents set by previous court. Also for disney saying it's not their fault their system is very similar to mcdonalds and someone still is able to sue mcdonalds due to how they all train from mcdonalds thingy,

I’m a bartender. When someone says it’s an allergy I make sure I tell the manager and kitchen so the kitchen does allergy protocol and the manager observes. I’ve sadly had a lot of people fake allergies and I feel like it makes people with actual severe allergies (including me) sound like we are making a big deal out of nothing which sucks. No matter what even if the person says they have a gluten allergy and need gluten free bread while chugging down blue moons and wheat beer I make sure the kitchen follows allergy protocols.

I was hit by a firework from Disneyland that fell out of the sky. I was on Ball road, next to Disneyland when the fireworks started raining down from their nightly fireworks show. They chose to do the fireworks show on a windy day. I was hit in the back of the leg as I was running away for tree cover which sent me to the ground. The back of my leg was black for a week and it hurt to walk. I inquired about doing a lawsuit to get money from a lawyer but he told me Disney lawyers fight absolutely everything tooth and nail and it would cost me more to sue than I would be awarded so it wasn't worth my time. I complained to customer service at Disneyland and they offered to give me a free park ticket when I showed them the firework canister and my leg, but I had to sign away my right to sue them to get it. I don't know if I signed away my right to sue for anything for forever or just for the firework hitting me, but after seeing this story, I assume I signed away my right to sue about unrelated things in exchange for a disney park ticket. They own so much stuff at so many properties now, signing away the right to sue for everything for forever would kinda suck. It's evil.

my friend worked for Disney and dislocated her knee while working. they wouldn't give her workers comp and fired her. they didn't compensate her pay for her appointments and her possible if needed. surgery. I found out that it was illegal to do so but they said" we are Disney. we have a lot of money you don't you can't sue us"

I remember reading the story when it came out. My first thought was something along the lines of "Holy shit I can't believe legal counsel had the absolute balls to try that as a strategy in open court", especially when you consider that the restaurant (Located in Disney Springs) does not even require a ticket to enter in the first place, making the ticket purchase and disney+ arbitration clauses they're trying to convince the court with an extremely hard sell if not outright moot since you can enter without a ticket or a disney+ sub, even if you somehow buy into the **CATEGORICALLY INSANE** idea that negligence leading into a wrongful death is something that should be sent to arbitration in the first place.

Corporations behaving like their contracts are law is why people think “well, you signed the contract.” There’s no contractual cover for criminal negligence, it’s just not how that works. Disney could have a contract that says “if you watch our shows then you agree to never sue us” which you sign in front of a dozen lawyers, and it would not matter because it doesn’t give them carte blanche to then break the law by killing people. These companies will throw money at stuff to bully people into believing they’re unassailable. I hope this guy gets as much as he possibly can. Disney are unashamedly evil.

Okay but really they aren't. The decedent bought a ticket; tickets also have arbitration clauses. The attachment to disney plus is just padding for the executor himself, it has very little bearing on the case, its included as a catch all to predefeat any argument they try to use that says they shouldn't have to arbitrate because of other agreements... Crazy how protected some people are too. My mom died because of a doctor who prescribed her migraine medication without reading the labelling. My mother had high blood pressure, and the medication label warned about serious injury or death if taken by those with high blood pressure. The doctors slowly killed her and were found innocent in court.

Random KZbinr with 2 law degrees here. Just want to say that terms and conditions (at least in UK law) are not solid legal documents and protect companies from everything. For example, there was a successful precedent set here in the UK where a person purchased a train ticket and on the back on the ticket was listed T&Cs in tiny writing, there was an incdient and when the individual tried to sue the train company said he couldn't because by purchasing the ticket he would be aware of the T&Cs on the ticket he was carrying. However in law you are compared to the 'reasonable man' meaning, would a reasonable, sound of mind person read those T&Cs and assume this, and the courts found no, most people would not read the back of the ticket after purchase. The same would apply here, this is not reasonable, and therefore this case would apply. Again, this was a UK case, US law I am uncertain of, but just wanted to share my two cents on the matter! I hope the husband can find some peace after this tragedy. It is all very heart breaking.

Suing someone isn't a human right though. What needs to happen is arbitration needs to be banned and court systems need to be reworked to reduce the massive load on the legal system. Currently, 1% of all claims actually go to court, and the court system is already overloaded.

Contracts don't protect against being sued for wrong-doing. They clearly state consequences of breach of terms. In this case, the contract was voided due to negligence, resulting in loss of life. The disney corp can't say a party signs away their rights to sue for loss of life due to negligence. They can only prove that no negligence occurred. And since the woman involved died, negligence very obviously occurred.

I have a dairy allergy just like her, and I have always had to be super conscious of eating out at places where I don't know how the food is prepared or what's in it, so getting the very rare "we'll accommodate your allergies" to completely ignoring them is such a slap in the face of trust to the consumer, it's terrifying and Disney needs to be held accountable for this.

I’m a bartender and I always make sure it’s taken seriously. I feel like the rise of people saying they have an allergy but don’t because they don’t want to eat a certain thing or don’t like it has made people take allergies less seriously and that sucks for people like us with allergies. I have a severe bee allergy and when I get panicked around bees some of my friends and coworkers roll their eyes and it’s like Karen I will literally die if I’m stung.

This exact thing actually happened to my sibling - and at the very same Raglan Road to boot. They have Celiac Disease, which makes them severely (nearly deathly allergic) to gluten. We had eaten here before, so it was one of the few places they trusted to prep the food safely. We checked the menu carefully and asked the waiter several times to make sure. The food was good and all, but as soon as I started driving me and my sibling home... the vomiting began. I was up until 3 in the f-ing morning at their apartment trying to make sure they were stable before I was able to go home. I was doing my best not to panic while checking on them constantly, making sure they weren't passed out, making sure they drank enough water, helping them stand, helping them get dressed, literally anything and everything I could do. Thank God it didn't go far as me losing my sibling, but sitting here now and seeing this whole lawsuit pisses me off because now I know that God forbid had something happened, Disney would've been trying to screw us over just the same as this poor man. To hell with Disney.

Im pretty sure punitive damages isnt often or ever to the amount a suit is filed for, its actually the jury and then the judges discretion on how much to actually award As such whilst it could be a start of $50k, the jury could say "20 million" and then the judge could just further overule that and say "thats far too low, 400 million" or even say less than 50 grand. Pretty sure i might be paraphrasing a legal eagle video, but regardless the ammount sued for is often just there to eye grab if its like...1 billion

I am a firm believer that TOS cannot be legally binding. Minors can agree. You can agree with the intent of sharing your account with someone else. Not to mention the worst a company can do if you break a TOS is ban you from their services because it's not a legal contract it's just an agreement. I'm not a lawyer but I'm pretty sure assuring someone that the food is allergy free 100% is considered gross negligence, which even a life waiver won't save you from. But even if it was just regular negligence, surely you can't waiver your life without a big fat IF YOU DIE WE ARE NOT LYABLE in red with a skull on a physical sheet of paper so you know what you are getting into.
