My own take is that the Usman and Yaya somebody who called to beg Hajiya Talatu to relinquish the house and even say that Ana barin halal don Kunya, I do not agree with them. They are saying this because it does not involve them. There is nothing shameful about disputing over what belongs to you. The divorced wife had no right to forcefully enter the house whatever was promised to her as she claims. She is very bitter because she never got to get a share of the deceased property, and that is because she was not married to the deceased as of the time of his death, so she was not entitled to anything from him and this is also true whether the property has been divided according to common law or shariah law. According to common law the general could leave a will disinheriting her entirely because it looks like he was not happy with her when they were man and wife. In the Islamic law of inheritance, the deceased can only bequeath a third of his property voluntarily. For the other two thirds, it has automatically been configured by Allah SWT how it will be shared out amongst those who were to inherit him. If she had been his wife, I believe she would have inherited him automatically despite her being a christian simply because Islam allows men to marry women of Christian and Jewish faiths. So her non entitlement was simply because she was not married to him not due to her religion as some people may surmise. If someone barged into my house without my consent, I don't think I will be able to give up my rights over the house until it is proven that I am in the right then maybe I can be magnanimous and decide to give it up, especially if I have others. The bone of contention here being the house is not so much the house as how it was possessed by the divorced wife. So these two gentlemen shouting over the phone that it ought to be left to the former wife are entirely in the wrong. Like I said, if it happened to them, they would be singing a different tune.
