Ak don’t hire this law firm because this is a very badly crafted suit where the allegations don’t even meet the definition. It’ll never survive a motion to dismiss. Hart probably wanted to file it to scare the blogger & force her to waste money defending it, which is unethical & borders on a tort called misuse of process. Imagine the policy implications if you could SUE everyone who ever asked you for money & threatened to release dirt on you. That would be absurd. Everybody would be wasting the court’s time. So you can only sue if you actually PAID & extortion occurred. There’s more to it, of course, but just as a baseline, you should remember that generally in civil law you’re suing to get money when you’ve suffered money damages.

Legally, in California there are both civil & criminal types of defamation. Hart is bringing a civil case, but his allegations do not fit the definition. In California law, civil extortion requires that the plaintiff have actually PAID money to the defendant. In Hart’s case, a blogger just asked for money, which he never gave her. He called the police to allege that she was extorting him. However, the police decided not to arrest her nor did the DA press charges for criminal extortion. So, now Hart is trying to sue civilly, which doesn’t work due to failure to meet the definition. The case will be dismissed & I’m surprised an attorney wasted his money on this frivolous suit.
