@@chrishall197 They same byelaws MAY apply, they make no specific reference and it seems it's just an easy get out of jail free card for the CAA. In addition the National Trust website says: In addition, any unauthorised use of a drone (either flown ‘over’ or ‘from’ relevant land) may constitute a trespass, nuisance or harassment depending on how it is flown and the impact of the use. These are civil claims which landowners, including the National Trust or other affected parties may bring, and which fall outside the CAA (Civil Aviation Authority) guidance. I am not a solicitor but the wording of that seems to suggest that they are extremely ambiguous in that is MAY constitute a trespass, nuisance or harassment depending on how it is flown and the impact of the use. It doesn't specifically list any offence and suggests that its a civil matter like common trespass. More interestingly, they quote "In accordance with the UK CAA (Civil Aviation Authority) Drone Code 2024, which states that byelaws can restrict drone flight, the National Trust Byelaws, constituted by Acts of Parliament, clearly express that an unauthorised person shall not operate an airborne vehicle or machine over National Trust property." The latest Byelaws they quote on the National Trust website were constituted in 1965, and only refers to means of conveyance when in reference to any flying machine, on the documents made available on the National Trust website, I can't find where they have quoted that from. Happy to be correct though, I only had a fairly quick look.

I live in the US and I had some vague ideas about the fact that these sites exist, but I never would have had a chance to see them if not for your effort. Therefore, and you might be surprised to hear that, castles are build to withstand attacks. Things like arrows, pikes and stuff. So i guess, and it's a wild one, a drone would have quite some problems to "damage" such a structure :)

Where you took off from is owned by a farmer. We had the authority to film (not with a drone just on the ground) on his land. The representatives from the castle came over and said we can't get the castle in the background. Not sure who these people think they are and what power they have.

Surprised to see so many negative comments here to be honest... They were trying to enforce their policy which is understandable, and when they realised their policy couldn't be legally enforced they backed down and tried to compromise. They weren't rude or aggressive and the manager handled the situation well... This was WAY better than the average National Trust site.

A few points on this. 1) There's a point at which the air around land/property ownership becomes Airspace - clearly it can't be below roof height otherwise you would genuinely enter into enjoyment and utilisation of that land for your own activities 2) EH can have any policy they wish - even if it isn't legally enforceable 3) I'd love to see this tested in court. My suspicion is as long as you take off outside of their private land, maintain VLOS and fly above roof height at all times you're fine. You don't always do this though ;-)

Next NH, just tell them you're legally allowed to do it, and therefore you will: but that you're willing to negotiate how low you go provided they allow you to use it on their grounds. If they refuse, fly it as low as you feel is safe. Teach them a lesson please.

There are two issues here. The first, and most easily sorted is the flying of a drone being controlled by the CAA and providing you conform to the rules as set out by the CAA then there is nothing preventing you from flying. The second issue though is much less clear cut, that is to do with take off and landing. If you are on private land then you must adhere to the land owners wishes, this includes public rights of way because the footpath or bridleway that cuts through the private land is still on private land. You have a right of way, not a right of takeoff and landing. There is also the issue of possible byelaws that may prohibit model flying (or more precisely take offs and landings) from public land under the control of the local council. Drone assist will NOT advise you if such restrictions exist. DJE never seems to consider these possible restrictions. You need to be absolutely sure you know about these restrictions before you go antagonising these people who represent the actual land owners. In this example it appears DJE took off from the field quite possibly without the landowners permission and if so, it was an illegal flight (and he has posted it up on KZbin).
