The National trust have updated their information on drones 4 days ago. It now says that drones can be flown from public land over National trust land. DJE has certainly made a difference 👍

And, National Trust land IS public land. The NT is publicly funded and is there to purchase, manage and preserve sites for the nation. They are not a private corporation owning anything.

NT Central Office in Swindon is well aware of the law in respect of public photography, and airspace regs, as proved by its written response to a FoIA request in May this year. It has had 4 months to disseminate this to those on the front line. It's abundantly clear it has failed to do so. Probably deliberately.

@@youtubeanalyst-l3z I'm well aware that the NT is not legally obliged to respond to a FoIA request, but the fact remains that it did. WTF do you think the request was about? I would have thought it was pretty obvious. Q. Can a member of the public fly a UAV over your parks if they take off / land on public property? A. As the landowner, National Trust can stipulate which activities we permit on our land but have no control over access to airspace for those flying from outside of our ownership.

Agree @cypeman8037. The lady with hair tied back did point to the obvious for me in that Dan had entered NT land to access the public bridleway and in addition he parked in the NT car park. To be fair Dan did offer to pay for a ticket at the kiosk and he repeated this offer on the bridleway. We didn't see if he honored his promise. I hope so because that would be right thing to do in this situation. Of course, he could have accessed the bridleway from the village or other areas that was not the property of the NT so overall the point was a bit pedantic.

The rule is that you have rights to the airspace that is necessary for the ordinary use and enjoyment of your land and buildings. This is often interpreted as the airspace up to a "reasonable height," which typically means the height needed for normal activities such as repairs, maintenance, or the operation of chimneys. I believe this is in common law and case history. Bernstein of Leigh v Skyviews & General Ltd (1978) was a legal case in which the plaintiff, Mr. Bernstein, sued Skyviews for taking an aerial photograph of his property without permission, claiming it was a trespass to his airspace. The court ruled in favour of Skyviews, establishing that a landowner's rights to airspace are limited to what is necessary for the ordinary use and enjoyment of the land and buildings. Any airspace above that reasonable height is public, and the landowner cannot claim trespass over it. This case set a key precedent in defining airspace ownership in English law.

Their attitudes to drones were enshrined in policy about ten years ago when state of the art was phantom 2 a relatively large and noisy thing. Best way to get around it is fly in from nearby and outside opening hours. As a 'landowner' they are allowed to stop you using it from their grounds and to be fair taking off and landing is when there is a slight risk of someone or something being hit.

From what I’ve been told the National Trust estates are the result of government policies that made it very difficult if not impossible for the landed gentry to afford to keep their estates at which time they “donated” them to the Trust to avoid confiscatory taxes and such. Rather disgraceful origin and the disgrace seems to continue. Not to worry, the nation won’t last much longer with the way the politicians are making it worse by the month. Just hope the new British nation returns to its roots of the rights of man.

The sheer spite, pettiness and stupidity of these people. The woman was so ignorant about where she works that she did not know how old the monument was and the man refused to tell the auditor how long the rail tunnel was. The woman said that the railway line was "on our land" until corrected by the auditor. They probably spent the whole night at home crying after their performances in public that day.

I was on a airbus a380 flying over this area, and I remember the pilot had to divert 20 miles around any national trust sites, apparently its ring fenced regardless of what the CAA say 😂

I don't know that place but if the only way to get to the public area is via their land then they can't stop you from going across. Using that as a reason is very very tiring to hear from them. If there's another way to the public path without going across their land then yes they could perhaps argue you can't do that but they can't prevent you once you're already on public land. They really have absolutely no idea of what they're harping on about. It's totally laughable. 😂

Institutionalism is sadly VERY English, and is one of the reasons why I don't miss the old country! England is ALL about institutions, it is almost as if one-quarter of the population have become one single entity where independent thought is verboten, which for me reads like the plot of a horror novel. shocking how many businesses are clueless about the laws regarding drones, they seem to think saying "you cant fly over here" its the law! they all seem to think they own the air space, so does that mean every plane that flys over this estate etc have to get written permission from the land owner? Absolutely clueless, best thing these so called experts can ASK is "we would prefer you not to fly over our estate even though you have every right to do so" instead, they go all plastic police mode with zero clue!

@@DJEMEDIA I think what you’re doing is great, but are you actually right, because on multiple legal advice sites(I’m not going to advertise them) They say this The lower stratum This is the airspace immediately above/around the land. Interference with this air space would affect the landowner’s reasonable enjoyment of the land and the structures upon it. You can prevent people from interfering with or intruding on this airspace. The upper This is the airspace which exists above the height which is reasonably acceptable and necessary for the ordinary use and enjoyment of the land by its owner - around 500 to 1000 feet above roof space level (Section 76 Civil Aviation Act 1982). A drone limit is 400feet so you come under the lower stratum?

@@DJEMEDIA Ok keep yer hair on, I’m only asking because it is what legal representation is quoting JFC The Law: The general rule is that property owners typically have the right to control the airspace above their land. This principle is based on longstanding legal doctrine “cuius est solum eius est usque ad coelum et ad inferos”. This recognises that property rights extend to both above and below the surface. However, the extent of the airspace ownership may be limited to what is deemed to be a reasonable height above the land.
