Depends on what the contract says but I have alot of Royalty Free kits I collected over the years and usually the person that made the loops write something like this: "Free to use but have to split 50/50 if you get a placement" Basically saying that if you make a beat and it gets a couple of thousands views on youtube then you don't have to pay anything or even if you sell a beat with that loop, you don't have to give the person that made the loop anything but if you get a PLACEMENT then he has the rights to a % of the split, even if a beat you made with that loop and sold it to an artist and THAT artist gets a placement then he has the right to a % too! Even by LAW the person has the right, it's just that for all small stuff then don't care because then maybe nobody would want to use them and everyone dreams about a case like this, that one of their loops gets a major placement so if you let thousands of producers use your loops then maybe you will hit the jackpot

If it’s royalty free in all regards and says so, then it is what it is! I actually had a situation recently that you would find interesting Pain : an up and coming artist (not going to name names) had a viral TikTok clip on one of my beats, it reached about 800k views in the first couple hours. He reached out to me to purchase the exclusive and while we were negotiating he ghosted. He had the beat remade and it went crazy. 1M, 2M, 10M, 20M+ views!!!! It was even featured in a movie. The remake was extremely similar to my original beat, with little variation. I eventually contacted my attorney - and we got everything you’d get in a typical producer agreement - master, advance + pub! Goes to show that even if you don’t necessarily “play” on the track, if the remake is so close to your copyright, you are a songwriter. I also obviously had the paper trail to prove that my beat was an influence. Wild situation. Thanks for another great video here!

He was saying if KYLE’S loop was 100% royalty free (which allegedly it was) then he messed up and it is what it is as far as getting PAID. I believe that was totally separate from his own personal situation in which the beat was NOT royalty free… Which means he had a right to every penny, and could go after them for infringing on his clearly stated terms. I can send you a loop or a beat for “free”, but you still owe me royalties and writing credit if that song gets placed… What happened to this guy is not what happened to Kyle beats. Loop kits, beats and leases have TERMS. Kyle’s mistake was releasing the kit 100% royalty free so even if they still get credit as a writer they don’t get paid on the backend, because they gave up that right by releasing the kit 100% royalty free. So to answer your question, no I can’t release a Melody 100% royalty free and then go after you for MONEY if the song blows up. You really have to read the terms though and make sure what you’re using is actually royalty free.

Some sound kits are even “100% royalty free” until they reach a certain amount of streams, in which case you have to contact the original creator, register the works and handle the business w them according to to terms you agreed to by using the pack. It’s really not hard. And before beat makers go and cry about it, the whole point is you use my loop for “free” make 1 billion beats really easily and quickly using my free loops and then when one of them gets placed, we BOTH get money and credits. Not. Hard. Too many small time producers don’t understand how any of this works and view it as some type of war where every man is fighting for themselves. Literally shooting themselves in the foot. Just read the terms and build relationships with people lol

As a creative, who is going through the proper channels to establish a business, it was always my number one priority and still is my number one priority to continually learn and be aware of my own ignorance (pertaining to all aspects of life) of the information needed to launch and perpetuate a successful music business. On the point of sampling, labels usually own the sound recording while publishers own the underlying composition which means: you'll be paying 2 entities for the clearance of a sample (unless the sample was recorded under a 360 or 270 contract, in which case you'll pay the label for both copyright clearances)

@therealraginggun I think the people who release ""royalty free stuff" that do it because deep inside they know they can break that rule anytime since there are laws regarding original copyright ownership I think they do it to make the artist think it's all there's and they can do with it whatever they want with it without risk so they have more chance to have a hit song because if they make it difficult than the artist might be afraid of using it and the chance of making a hit is less. I do think That having a simple contract or licensing terms in a written file within the sound pack and metadata is even better, that way you can give the artist peace of mind to use the samples but with a limit cap. That's atleast what I am planning to do when I release mine.

Nah you're right and if people did invest the time needed they would actually understand all this. It may not make the most sense in the beginning but once you wrap your head around it yeah its basic copyright law. Labels submit takedown orders all the time for crap like this for their artists when companies use music without the proper license like this in commercials, social media posts, movies etc... (Like you mentioned with Spotify or the Car commercial) it's all business at the end of the day when you're operating at a scale like that. But what do we expect? Look at the majority of people who use loops, they can't even invest the time it takes to learn the basic skills to program in their own melodies or learn an instrument but want to call themselves producers and cry when its time to split the equity generated?!? Unfortunately there's too many of them out there but I agree 100% with your last statement that it may not be as saturated of a community as we think if there's a big amount of "producers" but only a small percentage of people who actually understand what it takes to succeed long term. And I don't even produce lmao I'm strictly an audio engineer but there's many parallels like this in the music business overall. The problem isn’t that he asked for credit, it’s that he double dipped. He released a free sample pack royalty free and gained whatever benefits at the time, then years later with no legal standing he pressured that team and sold a narrative which was compelling, but damaging to OG producer. Interview that guy… I would be pissed personally, unless I’m chopping it up with them, I only fw royalty free loops… This the type of ishh that make sync cautious

In regards to your comment about rappers feeling like they are paying a producer twice, I agree that they definitely didn't fully understand copyright ownership. I can also see why there is frustration on the rapper's side though. If we step back and look at the creation of a song as a venture between two businesses - Business R and Business P. Let's say both businesses equally use their talent to create the song, but Business R initiated the project and hired Business P to provide their talent for $300. Business P requires 50% ownership of the song via copyright law. Business R then goes out and pays $300 for the song to be mixed/mastered, $1000 for visuals, and $1000 for social media ads. In total Business R spent $2600 with 50% ownership while Business P was paid $300 with 50% ownership. Financially speaking, Business P comes out ahead in this venture. Business R is the rapper and Business P is the producer. Artists get frustrated because after it's all said and done because they realize what has happened in business terms. Producers are not at fault for wanting their equity. If artists accept this scenario from the start, they shouldn't get buyer's remorse after the fact. As music creatives, we must consider the business first, look at the big picture, and understand what's going on.

The problem is that if you say it's "Free" you need to say it's free to download and let people know they don't have a license to use it commercially and if you do allow for commercial work then also mention clearly that you will have to give splits for use of their work. The biggest problems is that they don't make this clear... they say we giving something out for free to get people to give them their email but if they use it commercially they want to get paid and get splits... that sht makes no sense. No you shouldn't get anything other than credit if you give something out for free. This is similar to open source if I give away a piece of code for free on github and someone makes a million dollars building upon what I gave away as free then I shouldn't ask for a payment. This is also why I don't use loops or bs melodys from anyone and no one should. I don't get why all these so called producers need 7 other different producers to make 1 beat...

Yes, kits should contain clear terms. I’ve said this many times. The problem is that kits and websites DO contain these terms and producers don’t read them or complain that ‘free’ downloads should be royalty free because they’re free and also that paid kits should be free because they already paid. We hold ourselves to low standards and expect high returns.

The person/company who can set up a system that tracks loop/melody/sample owners, and calculates the fair splits so that they don't have to chase that down, and the beat maker doesn't have to have a huge spreadsheet to track all of that, and then provides that tracking service for a reasonable fee....that's someone who is going to make good money, and provide a game changing service.

I actually had a situation couple of months ago. Released a song in 2021 using a "royalty-free" loop from looperman. Tried contacting the producer via email, ig etc. No response. We released the song anyways (since it´s "royalty free", right). It blew up (10m streams and 200k tiktok videos, which is a lot in my country haha). I got like 500 dollars in advance and 50% of the publishing. All good right. Then 4 months ago. Some dude messages me/the label saying i stole his clients loop ya-da-ya-da. Demanding like 3 grand and 5 points on the master (royalties). The artist ended up paying out of his own pocket and the dude got what he asked for...He ended up getting more money and procentege than me. The guy who made a 10 second snippet. Whilst i traveled to different cities, made the beat, recorded the artist, mixed, mastered. It´s a joke. Learned my lesson, be hella careful with using loops and samples. Now i make everything myself

To me it's the royalty free designation that's the issue. If something is labeled as royalty free, then it logically follows that loop creator wouldn't be entitled to credit on the song that sampled it. This is because getting credit would invariably lead to receiving royalties as an official writer or artist on the song. A "free" sample pack wouldn't be the same situation. I personally think it would be a little misleading, but it's not the same as saying it's royalty free.

You're not paying anything. You're registering the producer as the co-writer because that's the legal and morally right thing to do. You aren't writing them checks, sending them cash, nothing, I have a whole segment in this video to explain this.

As far as i know 1500 streams is equivalent to one sale not 150. So for a gold certification youd need about 50 to 70mil total streams, otherwise everyone and their dog would be going gold everyday if it was 150streams

So many people in this comment section don’t even know how to network. I’m a hip-hop sample maker with several placements and even I use NON rotary free loops sometimes. I see everybody crying about this like it’s some type of scam to post loops for free but have terms. Anyone who says this is instantly outing themselves as having no credibility. So, let’s say a producer like Sharkboy who has 1 billion streams sends out a “free” loop pack and I decide I’m gonna make a couple beats with his loops today because I have a session coming up and I don’t have all day to make my own samples. I know for a fact that, although I received these loops for free, they are not royalty free and that he has terms. No problem. This allows me to essentially Collab with a billboard producer, literally put his name on the beat, give him credit, and then send the beat out to relevant artist with a huge producers name on it. First of all, there’s a good chance that that producer has had more success than you and is better than you at the thing you are trying to do. So for example, I’m probably going to make a better rage beat using a Sharkboy sample then if I made my own (nobody is saying we couldn’t). I can then send that out to relevant artists and theoretically have a much BIGGER chance of getting a placement than if I made the whole thing from scratch. I can even send the beat back to the loopmaker and if it is actually good, there’s a chance he will send it out too. Are you guys starting to see where this is going? using non-royalty free loops is not a scam or false advertising. It’s an EASY Way to Collab with much bigger producers and expand everyone’s opportunities a hundredfold. You guys need to stop shooting ourselves in the foot and build some relationships with people.

The comments of this video makes me 100 times more frustrated than the “issue” itself. Kid released a royalty free kit, and then the song blew up. He was destined to make exactly zero dollars off that song the day he released a 100% royalty free loop kit. Of course he deserves writers credit but he was actually lucky to still get a plaque. And then after you explain the whole situation so well, this comment section is still filled with crybabies who have never accomplished a single thing in the music industry, whining about how they can’t steal our intellectual property for free without any consequence. Don’t people realize if they use a “free” loop that ISN’T royalty-free, and the song blows up….everybody wins? Maybe they would if they had literally ever made a loop or a beat that got placed. But instead, they just get bitter and complain about something they don’t even understand. My first placement ever was off of free loop that was not royalty-free and I had a clearly stated contract. I send these loops out for free and if one of them makes it on a record they hit me up and they have my ascap number. Everybody’s happy.
