Do you need an attorney for a work injury? California workers' compensation.

In this video, I walk you through the factors to consider when deciding if you need an attorney for your workers' compensation claim. It is kind of like a scale where the more factors you have in favor of no attorney, the more you may want to proceed with your claim alone. The more your factors point to hiring an attorney, the more you may want to hire a lawyer for your claim.

Thanks for your question Chrizzy, I am not sure I understand. You are asking what happens if the QME and PTP agree? If they agree, your settlement is easy. Just Stip to your PD or settle out everything together. Take care, Naomi

Frank, I'm sorry that happened to you. It is against the law for an employer to terminate you for hiring an attorney. I hit my head on a glass at work really hard , my supervisor took me to the urgent care here in Valencia California I was a little bit confuse cause the Pappers the clinic gave me said that I can go back to work but the same day clinic send me to the ER at Henry mayo hospital I got an CT scan I have a scalp contusion head injury the ER doctor gave me ibuprofen and norco and some other medice por the pain and vomiting . Today I had a appointment at the same urgent care and they send me back to work she told me that medication the doctor gave me in the ER is too strong and that she can switch it for Tylenol! I still not feel good to go back to work my head hurts and I have nausea she sent me back to work with restrictions so I can be sitting all day but I work in aerospace and sitting im a asssembler the urgent care didn’t care about my pain they just want me to get back to work

That might possibly be both work comp and personal injury. Work comp against employer and personal injury against the dog owner. Can usually have case at the same time.

Thank you for the question CC. If you fire your attorney and represent yourself, you can speak directly to the defense attorney on your case. I am not sure if that is the employer attorney you are referring to. Just file the attorney dismissal and send the defense attorney a copy so they will start talking to you. Another great video thank you I have a quick question on Friday I was released to go back to work I'm 13 weeks and my Lombard laminectomy today I called my employer telling him that I was released with some hard restrictions no lifting more than 10 lb and no bending stupid crawling or anything like that right now I am receiving lost wages benefits disability will my benefits continue even though today they said that they don't have work for me

Thank you Edward, Whether you get benefits depends on if you were just released to work or released from care or P&S as well. If you were just released to work, your attorney should demand TTD continue since they cannot accommodate your restrictions. If you are P&S, then your attorney should demand PD advances begin and the SJDB voucher and you need to look for another job within your restrictions asap. Here is a video on that subject. @@GonzalezLawEmpower so today I was released from care with restrictions I still have physical therapy and I still have doctor's appointments my job couldn't accommodate me I wish I could have hire you as an attorney there's a communication barrier between my attorney he has three paralegals working for him and when I asked to go a question they seem to answer with the different answer it's very stressful
