IMO, your best bet is to keep your bongs, weed and anything else like it, at home, where your privacy is much more protected by law. If you must travel with illicit goods, like when getting weed from point of purchase to home, keep them in the trunk, preferably in a locked, opaque container. Also, try not to drive while black, or while being any kind of young male (especially in groups), as this seems a surefire way to make a cop itch to search your car! ;-)

Bostick, in which Justice O'Connor wrote, "We have consistently held that a refusal to cooperate, without more, does not furnish the minimal level of objective justification needed for a detention or seizure." In other words, refusing a search not only fails to create probable cause for a search, it doesn't even justify a brief detention.

You are correct in that refusing an s&s does not give probable cause but cops will often say that it does and will attept to convince you that agreeing to it is in your best interests. They will then, ask you again. This is where people make the mistake of thinking that being cooperative will make the cop more likely to overlook that roach in the ashtray. The police depend on this trick more than you'd think. Be nice but be firm and record, record, record.

Ask "Am I being detained? Or am I free to go?" If you're not being detained you have the right to leave. If they change the subject or don't answer the question, keep asking it. If they say you're not being detained then walk away.

Obviously, this guy has never been to Arizona. The LEO's (Law Enforcement Officers) in AZ practice what's known locally as "The Old West Mentality", meaning "I have the badge, I'll do what I want". Cops in AZ constantly violate 4th Amendment rights. You do not consent to searches, they arrest you and search anyway. It was done to me for not allowing a search of my vehicle. I was arrested, my truck searched and impounded, and I went to jail. What he did NOT know was I had a camera recording video & voice and sending off-site to my girlfriend 1/4 mile behind me. The video captured me refusing consent. I brought the video to court, case dismissed. Said officer wound up driving a desk for a year. Be prepared to record!

Scott, these are all interesting and informative videos that you've done and we are thankful to you for taking the time and making the effort to help us in our dealings with the police. Don't be offended by the claims of some of the viewers of a previous video that you looked high. It was just good-natured fun. Many of those people were also having fun with each other about drug use. I think that many of the people were taking a silly attitude towards many of our silly drug laws and how they're ridiculously enforced. Keep up the good work and don't forget to take the time to have a good laugh about all of this once in awhile.

@TheHe11ion2012 Officers can legally ask you to exit the vehicle. When it comes to pat-downs, they technically need at least a vague reason to suspect you might be armed (i.e. you're in a high crime area). So yes, you have a right to refuse a pat-down, but courts are very permissive when it comes to police frisking people for officer safety reasons. In many cases, police will just do it without even asking. Any evidence could then be challenged in court.

I was stopped for a so-called called traffic violation a few years ago. He asked to search my car and I told him no, he had no probable cause search my car, even though I didn't have anything, he said well I was just going to give you a ticket but now I'm going to arrest you. Because after I arrest you I'm allowed to search, so he made up a charge, arrested me and searched my car which he found nothing but I got taken to jail, in there for 11 days, they towed my car, put my dog in the dog pound. Cost me almost $1,000 to get my dog out, my car out and me out then they dismissed all charges. All because I said NO! I wasn't being mean or anything! So what are you supposed to do when that happens? Oh, BTW I am an older blue eyed blonde white woman, never been in trouble.

@Thrashaero It's not something that you argue with the cop, it's something that your lawyer argues in court. You don't have to worry about "what is reasonable cause" and if the officer has it. All you have to do in your police encounter is say, "I consent to no searches." If the officer attempts to say that he has reasonable cause, you say: "I am not resisting, but I consent to no searches." If he still insists on searching, then your lawyer can potentially throw the evidence out.

As many have stated before it depends on how you phrase your response. Different jurisdictions have laws pertaining to the size and type of knives you can carry. For example, regular pocket knives, box cutters ect. are as normal as any other tool, however if you claim to be carrying them for protection there could be issues. Switch blades, spring loaded knives and Bowie, machete type knives are normally not considered legal to carry on your person but not illegal to own either.

I am digging this channel!!! 2 quick things, not arguing here, first, sheriffs, local and state police were allowed to enter homes w/o a search warrant until the 1960's. Second, The Supreme Court of Indiana, has recently ruled that police do not need a search warrant to enter homes, whether an emergency or not, which takes Indiana folks back to the 1960's!!! I watched a related video that got me thinking: does turning away from, or avoiding a police checkpoint in which searches may be conducted really constitute a "probable cause" case? I mean, private citizens should be afforded the right to simply avoid an area where they may be searched randomly if they wish to retain their privacy and rights to privacy. Is that how the law views it, or would avoiding a police checkpoint really be considered a valid reason to be searched?

I was pulled over- a police officer asked me if he could search the car. I promptly said "No, you can't" . (keep in mind I was pulled over the DAY before, and they searched my car and found nothing, even after a dog "indicated"). The officer then told me "we'll, by the way your acting nervous, and by telling me I can't search your car, gives me reason to believe you have something to hide, and that's all the probable cause I need". He searched and found pot. Pub. Defend wouldn't fight it for me.

#1 you are correct that refusal does not add to probable cause. #2 cops do not need a warrant to search a person or a vehicle under certain circumstances. #3 If stopped by the police either on foot or in a vehicle and you or the vehicle smell of marijuana, the police can search your person or vehicle with out a warrant. #4 In any vehicle stop police may order the occupants out of the vehicle for any reason for the duration of the stop.

I've always wondered that too. I was watching a cop show the other day and they set up a check point on a known drug highway. The purpose of the checkpoint was not to check drivers who passed through the checkpoint but it was to pull over the people who turned around before they got to the checkpoint. That just seems to wreak of underhanded and unjust tactics. That can't possibly be justification for probable cause, is it?

@sabreyow "Am I being detained, or may I leave now?" This question forces the officer to answer think about if he has clearly articulable and specific facts to provide reasonable cause to detain you. They are not allowed to just hold you there while they wait for the dog to arrive, and if they had cause to hold you until the dog arrived, they would have cause to search you without a warrant. Stand up for your rights, and question constantly if you have the right to leave.

WRT the guy claiming that he heard it in Law School, I find that to be perfectly believable. The reason being that I have found a number of state statutes which violate the respective state's constitution. The response I get, when trying to bring these up is the only way to proceed via the legal system is to violate the statute... which means that I would have to acknowledge the legitimacy of that statute in the first place. Things don't get like this because of good & solid teaching.

@TheRSChickenTV I got a charge thrown out because of an illegal search. A passenger in my car was arrested in a warrant for fishing without a fishing license. They took my bag out of my car, I sai that's mine you can't search it, so they searched it anyway, charged me with some bullshit, which got thrown out in court later. The video camera in the cop car recorded it all.

No, and despite Shaffer815's response neither did leaving your doors unlocked, although locking your doors would have made it clear that you did not consent, what happened to you would be considered a "no contest" situation in which the law considers that since you did not expressly deny your consent to be searched you allowed the officers to do so. Such a case is not as strong as if you had given express consent but it's also not a violation as if you had denied it.

Can you stop a voluntary search after already agreeing to it? Like if your scared and accidentally say it's okay, can you stop them after cooler heads have prevailed to prevent them from searching or finding anything they haven't already found?

I agree. It is absurd and ridiculous. But the point is it can and does happen. And if you relent and don't invoke your rights, there is nothing to guarantee it won't happen to you. However, there is a way I can guarantee it won't happen to me. Simply knowing and invoking my rights. "I'm sorry officer, counsel advised me under no circumstances can I allow you to search my car without a warrant." The disadvantages far outweigh the advantages.

What about when they son't ask permission and proceed to search you at the start? I was walking home after curfew, but not being a minor at the time & having my ID as proof on hand I wasn't worried about that. But I was walking through the neighborhood and a police car pulled up in front of me, got out of his car and immediately told me to put my hands on the hood of the car. I asked if there was a problem but they continued to hold me and eventually searched me, took my ID, etc. Thoughts?

If the dog is not present they can not detain without for length without reason till the dog arrives on sceane. Always if you can pull on prvt, property------- keep a spare hidden key---- lock your keys in the car on the front seat. Where are you----outside the car or when they ask you to get out.

First off, if they don't have a warrant or probable cause to search your vehicle, you should ask if you're being charged with something, if you're not, ask if you're free to go. If you do that and they still say they intend to call a k9 unit, they can't legally hold you until it arrives.

What if: A LEO asks to search my bag. I politely refuse. He then cuffs me and sits me on the curb and proceeds to search my bag. I repeat I do not want or condone this. He says I gave him probable cause when I refused. He further explains that a consentual search would not have hurt me unless I had something too hide.

Im not in the USA but I think the process is similar. I know I don't need to say anything but I wanted to "say something" so they will leave me without taking a piss test. I went to the station and they asked me if I had something to do with drugs and If i want i can take the test. I refused to take the test and hope they will not bother again with it. -If it's legal, there's no requirement to tell the officer. If anything it's a kind and respectable gesture. Now if they're searching you and you don't tell them, well, he might not like it but even then it's NOT illegal to not tell them; as long as the contents that are on your person are legal. Not saying that if you have something illegal on your person and tell them of said illegal contents that it is then legal - It's not, though they may be easier on you.. Thank you for confirming my point. But guess what, THE COPS CAN'T MANUFACTURE THAT PROBABLE CAUSE by setting up a road block and pulling someone over who avoids it. Because avoiding a road block is not probable cause or reasonable suspicion. So that statement is extremely relevant. If they have probable cause it must be clear and articulable. Therefore, he doesn't need your permission to search with probable cause. So, if he ASKS to search, he doesn't have probable cause. Understand?

In fact, you can give them consent to search, then withdraw it, and if they have not managed to find probable cause by then, they have to stop. Swerving in your lane (without more) is very questionable as "reasonable suspicion". for a traffic stop. But "reasonable suspicion" of a crime ( includes traffic violation) is enough for a Terry stop, that is, pat down for weapons - no reaching in to pockets unless the pat down gives indication that a weapon may be in a pocket. That is a completely separate "officer safety" search from any later search of an automobile. Of course if you consent to an automobile search, that is waiving your right.

ok so question, if I am just walking down the street, and I am wearing a trench coat and I am walking home from a party, if the cops get a report of a suspicious person attempting to break into a house is reported and while I am on my way home, do they have probable cause to search me because I sorta match a description of a suspect? I ask cause this happened to me on time walking home from a Bowdoin college party, I borrowed a friends jacket and they stopped me on the sidewalk on my way home.

Maybe laws are different in your state but where I live in Florida K9 officers do NOT need probable cause to run the drug dog. It's called a 'free air sniff' and any K9 officer can have their dog sniff any vehicle at anytime. Think of the dog as the cops 'partner.' If an officer and his partner come up and the partner says he smells marijuana, it's pretty much the same thing as having the dog alert when it walks around the car. I wasn't asked to consent to a search, I was just asked to step out of the vehicle and then searched. Was me stepping out consenting to the search?

@rockybirddog If that happens, you continue to refuse to consent to any searches. If the dog really does smell something then they can search you without a warrant. At that point, it's a matter of debate between your lawyer and the prosecution. But if the dog does not actually signal, but the cop says it does, and you reluctantly agree to the search at that point, they've convinced you to consent. NEVER CONSENT. If they actually have probable cause, then they won't stop to ask you for permission

i have a question, when you get pulled over and u dont allow them to search your car, they will say im getting a drug sniffing dog and if he hits on something i will have the right to search. Now that in its self should be wrong cause the cop is detaining you while waiting for the dog to arrive which i believe is wrong, and isnt the do sniffing your car a search in its self just a different kind of search, and that dog is in fact a law inforcement officer right?

But the fact of the matter is that it is one of our rights to be represented by a lawyer if we cant afford one. This is a very real issue. Whoever is your lawyer should be out to protect your best interest. If theyre are not defending you then the lawyer should be disbarred. Thanks for the heads up though, I might just defend myself.

I have a QUESTION. I carry a Legal 4" folding knife all the time, if I am pulled over and asked if I have any weapons on me and I tell them I have a LEGAL Knife on me does that give probable cause for him to search me further and my car for anything illegal? What kind of problems does carrying a legal knife on me present me while driving or even on the street??????? Please Life if you would also like to know about this also. From California - LA/OC County

What if you thought the road block was an accident so you decided to take another route? So you get pulled over. The cop asks to search your car. Being the good citizen you are, you agree. Then the cop accidentally breaks your laptop. Then he finds an empty shell casing from that last hunting trip. Then an empty beer can you picked up because someone left it on your car. Now you're being charged with a DUI in possession of weapons. That's a felony. DA offers 4 years. Have fun in the pokey.

I have gotten normal tickets dropped because of using what I've learned on this channel, I thank you. But one question can you do one on Weapons or the 2nd Amendment or if you ever want a person to come out and help you guys out I'm in Connecticut I wouldn't mind coming out and helping out the cause.

PLEASE RESPOND:ok I had a cop pull me over because and this is his exact words "I saw your brake light tape come off." Ok I figured this is a good one and thank you for telling me.... he asked me for the basic driver lic regi and insurance. I provided all the legal items... he came back asked me to step out.... then he asked me if I had anything illegal in the veh... I was like what no... then he asked me if I had ever smoked weed I told him duh lol who hasnt he asked me if I had any drug charges.... I at this point was getting upset... SEEMING HOW I DONT. then he told me ok and let me leave. I was very close to asking if I was being detained and I was going to say can I leave? Would I of been legal? I dont like letting my rights go. I wouldnt of let anyone search my car.

You didn't have to answer any of those questions. He was fishing for a reason to search your vehicle. You have a 5th amendment right against self incrimination. You admitted to smoking weed. He could easily have twisted what you said and then used that against you.

@sabreyow yes but if you don't have anyting to hid and they break something during that search they are now liable to pay for it if they break it..if you consent to it they are most likely not liable because you did consent to the search.. also the dog may come but it the dog is certainly not allowed inside the car.... remember that so don't open the car door for the dog

I like to know about getting searched through at airport customs. I arrive in america I go through all the checkpoints then I start to leave an ass to search my bags before leaving customs. what rights do I have by refusing customization searching my bags when I arrive in the united states and I'm an american citizen

Do you know that the RFID chips on your drivers licenses will be used to help police ID you without your permission. They will also allow the government to track you wherever you when you are in proximity of their sensors.

What if you have been caught with pot in the past...do they still need consent to search you?
