Jeremy Bennett built his taxidermy and deer processing business from the ground up. After teaching himself the craft in high school, he slowly grew his business from a part-time gig into a flourishing business through hard work and quality workmanship. He even designed and built, by hand, the two-story shop that houses his taxidermy and deer processing businesses.

Jeremy’s shop is a private space. It sits on his property just a few dozen feet from his home, where he and his wife home-school their five young children. His wife helps with the books and his children are frequent visitors during the day. Customers visit the shop by appointment only and, even then, there are private areas in the shop where customers are not allowed.
But Jeremy’s desire for privacy doesn’t matter to the Ohio Department of Natural Resources (ODNR). Although Ohio does not regulate the work of taxidermists and deer processors, it does require them to maintain records of the animals they work on. And to enforce that recordkeeping requirement, ODNR grants its wildlife officers free rein to inspect taxidermy and deer processing shops without warrants.
For years, these warrantless searches were only a minor inconvenience for Jeremy. But following a personnel change at ODNR in 2011, the searches became increasingly intrusive and disruptive. During an inspection of his deer processing shop at the height of hunting season in 2020, he politely asked an officer to come back and inspect his taxidermy shop when it opened in a few weeks. Jeremy was then criminally prosecuted and threatened with jail time. Now, Jeremy has no choice but to comply with future warrantless searches or else face additional criminal charges.
ODNR’s treatment of Jeremy and other taxidermists and deer processors is unconstitutional. The Fourth Amendment generally forbids warrantless searches of private businesses. And although ODNR has pointed to an exception for “closely regulated industries,” Ohio doesn’t even regulate taxidermists or deer processors-it just requires them to keep simple records. If the government can side-step the Fourth Amendment by requiring businesses to keep records, then no business would ever be free from warrantless searches.
Now Jeremy, represented by the Institute for Justice, is fighting back to protect his constitutional rights. Jeremy has filed a federal lawsuit asking the court to hold that ODNR’s warrantless inspections violate the Fourth Amendment, because a simple recordkeeping requirement does not make it open season for government officials to barge into your place of business whenever they want.

Not just the fascistic "law enforcement" officers that live this mantra, but the petty tyrants that create & foster the environment they operate in. Blue areas don't devolve on their own, but with a giant helping hand from the sadists that get voted in by the mindless drones that live there.

You strike nail on head here. You should learn and know how to ask a question in response to every question. "Have you been drinking?" - Why are you asking?/Have YOU been drinking? "Where do you live?" - Why are you asking?/Am I somehow obligated to tell you? "Do you have any weapons or anything I should know about?" - I'm not a fish, do you have a particular concern I should know about? Am I being detained? Why am I being detained? Am I free to go? What reasonable suspicion do you have to detain me? If you had a good legal reason to search, you wouldn't be asking my permission, would you? You are exactly right, exactly when they start to investigate you, you NEED to investigate them and collect evidence. Be peaceful, smart, and record. Ask smart questions and otherwise say and do nothing at all except what you might be legally obligated to do.

That very comment is PRECISELY the problem with law enforcement, particularly in more recent times. Law enforcement was never really intended to punish those who unknowingly broke the law. Their primary function should be to punish those who blatantly broke the law, and even then not without due process. In my opinion, a GOOD officer does far more educating and informing on the laws than penalizing.

Mr. Bennett could possibly go after him civilly. It seems pretty clear the officer violated rights that the Supreme Court has already ruled on. He ought to lose any qualified immunity he has. At that point, find a good lawyer and go after the guy.

This isnt about police. This is about a game Warden. You agree to warrantless search the moment you shoot and tag an animal. It's in your license agreement you sign the moment you get a license. The only reason a processor would fight this law/rule is because they want to process poached animals. It's not about privacy it's about his ability to maintain a space he can violate the law. It's been this way since before he was born. If he doesn't like it he should've never got into it. He's mad because the govt is doing its job

Please tell me the statute that says butcher's and taxidermist do not have a fourth amendment right, you can't because there is no such statute! Did they find anything illegal on his property? NO! So what illegal activities is he trying to keep space to hide?!? Why would you make such an accusation against a proven innocent man?!?

Especially apply this to the people who own the politicians. Remember the political class are just the public-facing servants for the people pulling the strings behind the scene. The public can easily find out who the politicians are, but the identities of the real players are obscured.

@@Thalanox The thing is, if you just lynch the politicians who violate our rights, the people behind the scenes using the politicians won't have anyone to use. I don't blame people for trying to get a leg up. I blame the politicians who violate our constitutional rights. Focus on the people who violate our rights, not the people who give them money. Once those people run out of people to give money to, they are harmless. It's much harder to prove or find that someone who gives a politician money is violating our rights. That person may just be giving them money so that a bullshit law doesn't apply to them. But we can in fact prove that a certain politician has violated our rights by their voting history. And if we remove these corrupt and evil politicians forcefully, no new ones will step up to take their place.

@Shadow Of Wiggin I live in West Virginia and was always under the impression that they could do that here, but in all my years, 65 of them, I've never heard of them entering any ones home or cabin without a warrant. Now I've ran into a warden along a river or on a back country road during hunting season and have had them check my license. I don't see a problem with that though.

In kalifornia I've been told by numerous folks that fish n game has more rights than a policeman. That I have no rights, how constitutional is that! (I've also heard that they can enter one's campground with their loaded gun pointed at you...for NO reason.

I know Jeremy. He’s done taxidermy and deer processing for us for for the past 8 years. I’ve spent my life in business, working with and for people of all sorts. Jeremy is a highly conscientious and detailed businessman. And… he’s as honest as the day is long!! This is a horrific injustice - simple as that!!!

The average person doesn't know the law the way a police officer or lawyer would, and cops know that. That's why they try to pull crap like this, because they know more then likely the person doesn't know the truth of the law or they will get away with it anyways.

This has become the way of police and law enforcers in the USA. Having been to 26 countries and lived in a good number of them, this "Nation of laws" BS is for the birds. It leaves way too much room for "overreach" without the reach around. When IJ gets on the job, and the lawsuits start flying, they make it hurt so bad that the government criminals won't dare violate the people again.

He doesn’t know who or what has been poached. He may speculate that some of his customers are poachers. But he isn’t a game warden. So it’s not his business if they are. Lazy game wardens are trying to make a case on someone they can’t catch is the most probably reason for a search. If not then they are just harassing him

Also, idk about this state specifically, but in the 14 states I've hunted in, I've NEVER EVER seen any agreement about warrantless searches. Furthermore, the department knew it was going to get railed by the feds for unconstitutional policy. That's why they dismissed his charges AND amended their policy. Do you SERIOUSLY think they'd do that if you and they were right about this??????????????

I served in the US Army back in the early 1970's and seen things that I couldn't believe was going on in our government! After I got out, I never trusted any local, county, state or federal government again - NEVER! Sir you should file a law suit against the state of Ohio!

This IS law enforcement. Anytime you have an armed force of government agents who can act with authority that the average citizen does not have you are definitionally living under tyranny. A Sherriff is the only elected law enforcement in our country. They are not government agents, they are elected officials. They are elected by the people and can be removed by the people. On the other hand, the police and these regulatory officers are government bureaucrats that get to carry guns and have no direct accountability to the people. I know it makes people feel good to say that they support law enforcement but you need to be knowledgeable about what law enforcement really is and how corrupted it has become in roughly the last 120 years.

110% projection on the side of these pigs. I have yet to encounter a single decent officer of the law. Every last one of them are more than willing to bend and out right break the law. This is why they are so under paid. Leaves them wide open to corruption and doing the bidding of those who fill in the pay gaps for them. These are not the sharpest knifes in the drawer either, but just smart enough to do the paperwork required of them. They watch as those they arrest with 100 of thousands of dollars, while they are only making 10 of thousands. This is all by design.

And why didn't the prosecutor do the calling? You can never believe that a law enforcement agent is telling you the truth. The courts allow them to lie to get their way. Unfortunately, we operate under an adversarial-based legal system, so yes, every encounter is a hostile actor trying to get enough information to use against you, they are not there to help you.

They are Code enforcement agents. People forget or never new we became full blown members of the UNITED NATIONS around the time of ww2, some say before some say after. John F. Kennedy refused to sign U.N. documents but Johnson signed them within days of taking office. Research U.N. membership entry rules for your self.

It is legal for cops to lie during the process of an investigation. Never talk to the cops. It is legal for them to ask questions that are illegal to ask in court. Know how they know that? They talk to judges and prosecutors, who send people to private, for-profit prisons. The system is rigged.

Reminds me of the story of feds showing up at at a farmers place telling him they were gonna search for marijuana. Farmer said ok but stay away from that pasture. The fed pulls his badge and said, you see this badge it means i can search anything i want. A few minutes later a large bull was chasing the fed out of that paster, the farmer yelled, show him your badge.

I was told years ago by a KY. state trooper that fish and wildlife officers were able to go anywhere on your property at anytime they wanted. He said he felt this was a slap in the face of the constitution. I agreed. I'm adding this onto my original comment because I had no idea what a can of crap I was opening up when I got drunk with an off duty state boy. But from what I have learned from the comments here. He was correct to a degree. But I can also agree with the gentleman who posted that there are different laws for business vs. individual's. And not being aware of those laws does not make a valid defense.

Great work Institute for Justice. I have viewed this video several times, and keep coming back. I think a BIG problem is that there are people who roll over and say "I don't have anything to hide." That makes the police think that they are doing nothing wrong, even though they are infringing on basic rights. Thankful for this guys and IJ for standing up.

His dad lives in that town and it is only 26 miles from his house he actually grew up in that area going back and forth to his mom and dad. Everyone acts like he drove several hrs just to do what he did. He has training and wants a career in law enforcement

This isnt about police. This is about a game Warden. You agree to warrantless search the moment you shoot and tag an animal. It's in your license agreement you sign the moment you get a license. The only reason a processor would fight this law/rule is because they want to process poached animals. It's not about privacy it's about his ability to maintain a space he can violate the law. It's been this way since before he was born. If he doesn't like it he should've never got into it. He's mad because the govt is doing its job

He might be calm and reasonable, but he's also clearly ignorant of the laws that his business must abide by. Nobody is responsible for explaining the law to him. That's on him. Ignorance of the law is not a defense. The 7th Circuit court and the Supreme Court have established that heavily regulated businesses (like wildlife related businesses) can be subject to warrantless searches. Maybe he should have looked into that stuff before he went into business.

@@petedavis7970 just because you can doesnt mean you should. The wildlife officials likely have a right to inspect his shop, but reason is allowed to play into it. If it were my shop, i would have allowed the check because of the rules. However, in the off season, a surprise inspection seems silly.

I heard that from 2 cops, 1 of them was getting to be a friend, I dropped him after he said that. That's a huge distinction that I fear has been lost. More and more, we think of our rights as being granted to us by the government or the documents/principles written into our government. That's incorrect and a massive problem with the way we think. If the government does, in fact, grant us rights then it can certainly take them away. That just stands to reason -- what is given and regulated by the government can always be taken away. Rather, our rights are inalienable, god-given. Our rights (free speech, bear arms, etc.) are not granted to us by a government, constitution, president, person, or other entity. They are part of our body and soul, no different from our right to breathe. We have eroded that concept and language is a big part of it. We have to get back to basics that our rights are part of our humanity, something we're born with, and not something the government can take away. The government is there to protect our rights, not to ration them out to us.

I worked in public safety for 20+ years and many years as a forensic investigator. I would never allow any warrantless search of my property nor would I volunteer to be interviewed without an attorney........... even if I was 100% innocent of any crime. Government always has, and should have, the burden on it and the government and its agents should never target citizens or search for crimes to simply search for crimes.

Perfect example of what's wrong, just nit picking everything till they find something little to ticket or charge even the most honest person with... They are in overdrive looking for revenue. In many states the possum cops actually do have more power than real police. Here they don't even have to have a warrant to search your truck or you if you are hunting or fishing. All the need to do is claim some BS. Many times the dirty cops will ride with a game warden to skirt around needing a warrant to search somebody.

I remember taking my son to a hunter's safety course in Michigan probably 6 or 7 years ago. There was a game warden there that made the statement that game warden's didn't need a warrant to search someone's house. He did qualify that statement by saying he wasn't going to be the first one to try it.

@@hateca1 LOL. That's been tried. A lot. Want to know how it turns out every time? DNR gets to keep warrantless search powers. Every single time. They have been smacked by State Supreme Court for overreach but only when someone can afford to take it that far.

That law enforcement officers would allege 'everyone does something illegal' in reference to his business is truly disturbing. It is gross government overreach to expect someone to allow a warrantless search when their business is not even processing orders. Some cops just have nothing to do, so they invent problems, which is the exact opposite of what an officer should do.

It’s the lens through which they see the world, and the reason why the tenet “innocent until proven guilty” has been forgotten in this day and age.

@@DEVILDOG1964 this was Ohio, which is ran by Republicans. Might want to scale back the stupid before making a rant like that. (Fish and wildlife can be a state or federal agency. From context this sounds like state, but even so given the timeframe references, republicans were in charge at the federal level when this happened)

I emailed Wildlife, and asked them if they could search without a warrant, and they said in some instances. I asked what instances, and they never responded. They think their above the constitution, I'm so glad that someone is finally pushing back against wildlife's unconstitutional actions!

When I lived in CT the cops wanted you to put a sticker on your car giving them the right to stop and search it without probable cause; because most people out after midnight were commiting crimes. As a night shift worker I took that as insult from the only person with a gun.

That was my first thought as the LEO was speaking. That, and then where did this LEO leave his spine.. if I was handed a unconstitutional NTA or summons I would have simply handed it back to the DA and said I'll have my resignation letter by the end of the business day. I'm so fed up with this overreach...

In Minnesota ( years ago ) the game warden could come into your fish house whenever he wanted. Not anymore someone took him to court and now they need a search warrant. Keep up the good work, freedom isn’t free I’m donating

That's not true. Still can be inspected in Minnesota for multiple reasons by game wardens without a warrant. You agree to it when you get a license. What you discuss is getting a warrant on a suspected violator that never agreed to that clause by buying a license. It was a violator thinking of a loop hole that just added charges. But still can happen as it should.

If charged with a crime, the government has the burden of proof. But to get to that point, there has to be evidence of a crime or violation.

We own a school bus company and have to go through state inspections yearly. The issue with inspections on any vehicle is that it's up to the "officer's interpretation", meaning the inspection tech we brought it to for a sticker says it passes, but somehow the state police manages to always find something wrong. The state police official for our area hates us and purposefully docs our buses for all kinds of infractions that are bullshit, even scraping the inspection stickers right off them one time so we couldn't do our bus run for the school district we work for (which makes our buses look unsafe when they're not!). Well I was about sick of his bullshit so I wrote a complaint on him and started a petition for all the other garages in the area he inspects to sign, saying he constantly abuses his authority. Some were scared to sign because they were worried about retaliation, but I got 20 signatures from different garages he deals with in a town with a population of about 6 thousand people. So that's pretty near every single garage. We got a hearing to present our case, and of course the state police investigation consists of the state police investigating themselves so 🙄 But it felt good to read out loud that the guy doesn't even get wear a real badge, he only wears a patch 😂. He still does our inspections to this day. Congratulations Jeremy on the changes you forced your state to make!! Way to fight em 💪

im serving 3 years for asking for a warrant when they were taking my car from private property. they pulled me over saying i had a headlight out.. i asked what crime the suspected me of the siad none i asked to leave they would not let me leave..

@@leef_me8112 obstruction... they rigged the jury the states attorney was "resigned" fired for it ... my lawyer didnt argue any elements of my case nor let me see any evedence and my apeals lawyer called i crimininal what they did then.. hushed up about it when i told her its her job to report them.. she then told me i have no say in my apeal...i have a recording.. the bar says i have no say in my apeal ..they held it without me and wouldnt tell me when it was or where it was...

We got the same issue with RCMP and Fish & wildlife here in Canada. My dad fired up the burning barrel after a storm. Officer gave him a ticket due to fire ban...while my Dad got soaked by the rain and the officer wouldn’t even get out of her truck due to the mud and flooded yard.

LOL Well when you add all the rain drops together it did. So when you vote for government and for police this is what you get. So as you can see you are causing this with your one little vote. Great job by the Institute For Justice in representing the little guys against law breaking government officials. As a Peace Officer, I fully understand that the 4th Amendment is in place to protect against unreasonable searches and seizures. Wildlife officers seem to think they are above this, a lot of times.

That's right, Article 6 states ".... any legislation that is contrary to the Constitution is not valid".. Also Article 6 states that the Constitution is the supreme law of the land.. The Constitution gives "... all inherent power to the people".. People have not been taught the Constitution and those that are ignorant of their rights gets stepped upon by these corrupt thugs that "represents" rather than what they try to do as "lord and masters"..

As a former Game Warden, a warden can ask, but if the taxidermist refuses, the warden must get a warrant if they want to pursue a search.

Very interesting. As a Taxidermist here in Wyoming we have to sign paperwork each year as a renewal with a fee for our new license. Part of that paperwork is acknowledging that the Game and Fish has full access to your property at anytime. Seems crazy but you have to give concent in order to receive your annual license.
