@@nicholas4839 That is the definition of assault though. Assault does not require contact. If you make someone feel like they are going to receive bodily harm, that is assault. Battery is when contact happens. For example, if you throw a rock at someone and you miss, that is assault. If it hits them it is battery. Flicking a lighter that close to someone is assault as it is reasonable that the officer felt he could have been burned by it. Edit: in Washington 'battery' isn't explicitly defined so in this case the traditional definition of battery is also categorized as assault.
