I absolutely 100% agree with him what he says. It was unnecessary what happened that day. Everybody knew who they were, why stop them? I understand why they got upset. This case should have never went to court. He should have just stepped aside and let them go. Every single South African knows there's a bond between them. In this case I support them.

The prosecutor has broken rule 101 for witness cross examination I.e. " don't argue with the witness" she lost the fight by being argumentative. She must paint the scenario and question follows requiring yes or no answer.. The witness always wins argument even experience lawyers lost when its argument with the witness, because the witness was there and prosecutor wasn't.

There's no rule of practice which forbids inexperienced cross examiners from fumbling their cases. There's nothing in the procedural rules of evidence which forbids argumentative witness it is to your detriment if you don't rail your witness to answering in " yes or no" . Lastly the magistrate as a matter of practice have a third bite of the witness ie examination in chief by your lawyer laying out the scenario , secondly cross examination by your opponents like this fumbling prosecutor testing the veracity of the evidence in chief, thirdly the magistrate seeking clarity from all the evidence processes so mentioned above. Therefore he cannot interject or interfere with this fumbling his time is coming.

Reasoning and logic exits the common white person when it comes to EFF, if you can't engage with them politically it's no use using the courts to destabilize them because with these videos you actually make them increasingly appealing. The problem with white owned media and the public in general is that when it comes to leaders chosen by the majority you guys get nervous and decide to "play the man" (Zuma and Malema) but when it's your guy ( Ramaphosa) messing up the country in catastrophic methods you guys decide to "play the game."

Everybody knew the occupants and the bond between them and the Mandela family. It was unreasonable to even stop them. Should have never went to court in the firt place. The right of Venter to execute his duty is not absolute.The prosecuted is one of many that proves lack of experience in cross examination,she pulls no punches at all. I have no idea if what we are seeing in these videos is typical of the true trial procedures and protocols in South Africa. But I am totally shocked at the apparent lack of control of the proceedings which appear more like a bar room or town haggle than a deliberative judicial hearing. The Prosecutor in particular seems to be at sea, triggering and blossoming a polemic with the accused, rather than, as is normal in other similar proceedings, posing precise, relatively open and shut questions for which likewise only succinct on-point responses should be permitted. The accused are rather allowed a free platform to pontificate at large and without limit and say pretty much what they like. Am not saying I agree or disagree with they are saying and you could even say that it is all actually quite entertaining. I am however amazed that a judicial process can be allowed to play out as some kind of pantomime like this and by how the magistrate is doing nothing to exercise any control and deliberation and appears himself only as a spectator of the spectacle!

Hi Tongoliman, looking at the need to truly dispense justice on one hand and 'follow' trial procedure on another, what must generally be the attitude of the courts or what must carry weight between restricting litigants to a mechanical navigation of trials versus allowing them latitude to express themselves and give background, emotions at the time of the act (as long as it is relevant to the issue at hand) which gives the full picture of what happened so that the court is fully equipped to tell what actually happened and ably arrive at the correct verdict? why should it still happen that any party win/lose a case on technicality and the courts still say we are dispensing justice? is there room for the said judicial process as we have known it for ages to be improved, where procedures that have been handed down to us do not optimally enable us to dispense true justice is it not important to have there procedure rules relooked at?

To your question as to what should be the role of a court for this purpose, my view is that the court should be "socially proactive and flexible", if I can put it that way, rather than only mechanically neutral so as to allow the full picture for justice as you have called it, to emerge. All that having been said, I would see a risk of allowing the court to become a theatre for outright political game-playing (by both sides), limits which it seems to me that this "trial" has more than exceeded. I therefore also see what I would call a management accountability on the part of the court to keep the whole process within the essential bounds of judiciality. From that point of view, the Magistrate in the present case seems to me to be almost absent, almost only a spectator, in regard to the evident excesses of both the Prosecution and the Defendants, to the point of the whole thing becoming just another version of the pantomimal contestations we often see between these same parties - the Government and EFF - in Parliament.

This one in the court of law by the court forcing answer Dignity was been violated Was not a man. He was on duty! Compromise court on ruling. Final the state should pay costs , thus control all the state power. All people are for the state. 'To mourn' rule.
