So what have we learned here? 1) The government will protect itself. ( both the bus company & the investigators are owned by the government) 2) you don’t really have to stop for a red light just follow the guy in front of you and the people with the greenlight have to wait for you to clear the intersection.

In Canada, if you are caught in-between the entrance and the exit of an intersection and your light is red, it is your fault. Our lights seem to have a bigger delay before switching from red to green on all sides of an intersection.

A similar thing happened to me in the UK. I was stationery at the traffic lights next to a bus stopped. The bus driver rammed into me trying to force me from my lane when the lights were green. The police, the bus company and their insurance company geared up to accuse me of being the cause of the accident. It happened back in 2008 and I had a dash camera wired in long before it was a thing. It ended up in court, my lawyer sent my recording on a CDrom with a free video codec rather than Windows player and as surmised the otherside didn't bother to look at the contents. The disk was simply marked as plaintiff's statement and evidence. They also had hardcopies. When the magistrate looked at our video, he called the bus driver a liar to his face.

Any driver, including one turning, shall yield the right-of-way to other traffic and to pedestrians lawfully within the intersection or an adjacent crosswalk." The car was lawfully within the intersection by virtue of the green light.

The car can't be lawfully in the intersection unless it was a delorian going 88mph and went back in time. So the bus is already lawfully in the intersection while the car is outside of it making 21451 apply to the car.

Reporter also doesn't know law either. He gives us a quote from the driver hand book which is a recommendation not a law the law is actually opposite of that. The handbooks is just safe defensive driving practices which again is not the law.

Exactly that same thing happened to me in 2002. A VTA utility vehicle made a left turn while I had the green to go straight. The VTA vehicle wanted to leave the scene. It took roughly 4 hours for a San Jose PD to show up. My car was totaled and I was slightly injured. I ended up suing the VTA and we settled. But it seems VTA drivers have a habit of this. One day they’ll kill somebody and the VTA will blame the victim.

Yes, always make sure the intersection is clear before proceeding. That said, it was absolutely NOT the car driver's fault. The bus driver had plenty of time to stop. I've had instances where I was approaching an intersection at speed when the light turned yellow and the timing was just off enough that proceeding through was safer than hitting the brakes, but this was not the case with the bus driver.

It's also hardly reasonable to expect a red light runner trailing the car in front of it with a full 4 second delay. The only chance he had to see it unobstructed before he entered the intersection was right at the beginning of the clip, when he probably focused on the traffic light.

People who watch car crash video perhaps, but not a driver approaching an intersection with his traffic lights about to turn. At that moment a driver should be concerned with figuring out whether or not he needs to come to a full stop within the next seconds. His lights turn green and he probably took note of the last cars clearing the intersection in front of him. At the time he enters the intersection it's not reasonable to expect any more left-turners, unless you consider a red light runner accelerating like a bus, which is exactly what has happened here. If you're 'careful' enough to reliably avoid this kind of accident from the perspective of the car driver, I'm sure you'll cause a lot more accidents because cars behind you don't expect you to break at an intersection where the lights just turned green. Could the car driver have avoided the crash if he were hyper focused and looked to the left while he entered the intersection? Probably yes - just like a pedestrian can avoid accidents by jumping out of a way when a car denies their right of way. It's the right thing to do. However it's just poor judgement to blame the victim for not acting sharp in a critical moment when the other party violates traffic code as blatantly as seen here. It's your responsibility to clear an intersection before another traffic light phase starts. For bus drivers that means they're supposed to come to a stop while the traffic light turns instead of attempting to squeeze over during the yellow phase, let alone running a red light like the bus driver did here. When you've failed that simple task and find yourself in the middle of an intersection while intersecting lanes have got green light, you're supposed to give way until it's save to clear the intersection again.

No he is correctly saying you must yield to traffic still clearing the intersection once you get a green. The bus was still clearing the intersection. The video of the bus makes it questionable whether he should have stopped, and the traffic lights appear to not give sufficient time for vehicles to clear, but that doesn't change the need to yield to vehicles still clearing when you get a green - not just charging in apparently without looking.

The cops were just trying "to do a favor" for the city by ticketing the accident victim in this case, figuring his insurance would pay for the damages and he'd be unable to sue. IF I got on the throttle when the light turns green with no regard for traffic I would be in an accident every time. The light system is a traffic controller not a guarantee of clear road. Just like crossing the street a pedestrian has the right of way but the pedestrian MUST must look BOTH WAYS. SO. Driver MUST LOOK BOTH WAYS before proceeding on a green.

I'd put blame at around 50-50. Yes, the bus driver pushed it too far and either gunned it through a yellow or possibly ran a red. But the SUV driver really should have made sure the intersection was clear, which was difficult because of the other SUV blocking his view to the left. He didn't even try to put on his brakes when a massive bus was right in front of him. That tells me he wasn't really paying attention to the road at the time of the accident.

Actually the bus driver was completely legal in going through the intersection. That is why upon further review the officer cited the other guy. Once someone goes over the limit line no matter how small, they are legal. Even though legally the car was at fault I wouldn't have cited the driver as the intersection has badly timed lights. Just recently someone discovered the math to figure out yellow light timing was wrong. In just the right situation it was impossible to stop in time and impossible to speed up and beat it. Drivers are blamed until someone discovered this issue with yellow lights. Oregon actually tried fining the guy who discovered this for practicing engineering without a license but he won that court battle because it was a slam dunk win for 1st amendment. Although rare the right circumstances will see this happening again.

@@jayg2895 the cop was telling the truth though. Once the bus is past the first limit line he has to complete the turn because he's in the intersection. The crosswalk is not the limit line. The strait light turned green. As crappy as it sounds, it's in the VC that you have a duty to check for cars in the intersection legally prior to going on the green. Always check intersections before driving. I've seen lots of accidents, some deadly, where people run reds.

I don't know about the U.S but it's true that you can't just send it if you get a green light. In an EU country where I live, if somebody is making a turn in the middle of the intersection and his light goes red while he is making the turn, everybody else has to give him the right of way to complete that turn.

In a sense he is right. But in this particular incident the bus driver was clearly at fault. Whenever you cross an incoming lane of traffic you do Not have the right of way. He ran the red light and the mazda driver had entered into the intersection 4 seconds into a green light.

@@cicicave1279 They were probably banking on the driver just accepting their decision and letting his insurance settle. His insurance did pay out. A lot of people in this country wont argue with people of authority or are too scared to. Some people see that the insurance paid out and don't pursue it since they weren't out-of-pocket until their next insurance premium rolled around.

He did. It took him 7 months of fighting but by the then. All conclusion and fighting with VTA. The guy ended up winning but he turned around and sued them again for other reasons. So ended up winning 2 times in the process. The driver was promptly charged as well. The amount he received still isn't known but he ended up taking a "good sum" to buy him a new car 2019 comaro (at the time it was brand new)

Not really, the bus entered slowly at red. Yes if you have a green light you cannot just crash into anything in the intersection. When the car entered the intersection, her path was empty, so no reason to yield.

From looking at the video, it looks like the opposing traffic light goes green as soon as the other goes red. That is so messed up. Here in Australia there is always 2-3 seconds to allow traffic to clear the intersection

@Investors Guide: Does traffic like are not up to code, because when one side turn red the other side should not have turn green immedialty it should have stay red on both side for a few second to clear what is left in the traffic, I also notice another flaw with the light their is a missing sensor that would make the yellow light a few second longer if a Bus or car enter the intersection on yellow, in the city I live that sensor is not missing, because I notice a diffrence on how long the yellow light stay on, if I stop behind the stop line on yellow the yellow light change red right away if no one else cross on yellow, if someone cross on yellow the light stay yellow for a little bit longer

While living in San Jose (and I’ve lived many places), I witnessed multiple incidents of stupidity from the SJPD. They determined that a guy with a green light and right-of-way was at-fault?! I hope this guy sues and doesn’t settle. Instead, I hope the investigator is punished for blatantly lying.

@@--_DJ_--this is dumb, if the bus was a small car sure take the yellow light and make that turn, but it's a large vehicle and it takes longer to make that turn, the bus shouldn't have taken that turn. Green means go and people who have a green light are expected to be less cautious than one who had an orange light.

I also agree that green means you are less cautious, but that isn't a good excuse if something like this happens. You also do need to be more careful at lights that go green as you arrive for reasons like this.

@@--_DJ_-- the size of the vehicle does matter, this is why drivers for larger cars go to additional training to get their class B or A licenses. There are things you cannot do in a larger car that you could or get away with in a smaller one. The bus driver should've been well aware of this.

The complexity and time involves in getting this properly sorted for the car driver, I feel for him, I would very likely lick my wounds and just move on; come on, this is common sense no brainer.

That's always been that way to my knowledge turning left ALWAYS yields. Left green arrows are the exception, However if the left (green) turn arrow is lit the traffic light is red for opposing traffic. That guy should sue his insurance company and the bus company.

It looked like the car driver also might not have been paying very close attention, because he accelerated into the cars turning before the bus while his light was still red. The bus is probably technically at fault, but it's stupid driving on both parts.

@@weabae5910 So you assert the bus had the ROW? Laws vary from place to place, but I would be surprised if the bus had the ROW. I would expect the buses' move to be the same as making a left turn on a "Green Ball", which requires the bus to yield to oncoming traffic. There are different elements to the situation that have to be checked off as you go through the analysis of what happened. In my state, once you are in an intersection, you have the ROW to leave the intersection before anyone else can enter the intersection. But when you pull into an intersection on a green ball and you wish to make a left turn, you must yield the ROW to oncoming traffic. This fellow essentially did just that by entering an intersection on a "stale yellow." He had no reasonable expectation that he could complete his left turn under a green arrow, so he lost the ROW to oncoming traffic. To treat the ROW for the oncoming traffic any other way would create too much confusion for anyone approaching a Green Ball at any intersection. That would nearly reduce the Green Ball indication to a four-way stop (stop and proceed). Well, good luck with that. I believe this will get overturned in court if the evidence of both cameras are admitted into evidence.

Clearing the intersection always supersedes the stoplight color or else when people pile up into an intersection because the next light is backed up for example if the light for the intersecting drivers turns green and they can nearly legally slam into stopped cars would create a conflict of interest within driving law and thought of process.

This is no joke, the reality is your actions should depend on the situation. I'm a motorcyclist and sometimes signals don't react to me and stay red. When that happens, I will make sure there is no traffic around and I will go through the red light - cautiously and safely The opposite is also true, if there is traffic in my path of travel I might yield even if my signal is green. The signals are tools for maintaining safety and flow of traffic, but it is the drivers' responsibility to act correctly and avoid accidents. IMO, both drivers involved in this accident reacted poorly. It seems like they both had plenty time to stop and avoid the accident.

You forgot an important word: "just". The officer is right; if a light is green that does not absolve you of your duty to yield to vehicles that are within the intersection. You're always supposed to check whether it is safe to cross an intersection, green light or not. This isn't the wild west: you don't plow through another car when you can avoid doing so just because the other car ran a red light.

There are some extremely simple fixes that I see no one utilize. Simply delay the next green light for 2 seconds between every switch and then even traffic that enters the intersection at yellow light will be able to pass through before opposing traffic starts coming. This wouldn't even delay traffic that much since people at the light that just turned green have to wait for the vehicles to get out of the intersection either way.

Was a bus driver for many years, and yes it is always easy to blame the bigger vehicle, but this bus driver is 100% to blame for the accident. To then go on to blame someone else when he went through a red light is beyond me. As a public servant, he had a duty of care to, not only his passengers, but to others on the road. His license should have been taken from him, not because of the accident but because he lied about his actions.

@Woz Berry First of all, *it is up to the drivers discretion to safely turn on a yellow light.* Second yeah you can't stop in 0ft but he also didn't need to rush to beat the red light. That's not safe and slightly negligent. Never said he ran it but he probably didn't catch it turning which is why I said if he knows his route he should know the light timing, but it *did* turn red as he turned out. As a school bus driver, we're told to wait a couple seconds after the light turned green to make sure there aren't any last-minute vehicles (i.e., the bus) trying to race through the yellow light (now red). I wish I could say, "it's rare for city bus drivers to behave like this," but when riding the bus in my area, I've observed all kinds of unsafe practices such as: Unsafe following distances Speeding Racing yellow lights Running red lights Braking hard in the rain Barking so hard, I fell out of my seat Turn so fast, I fell out of my seat Talking on the cell phone while driving Honestly, it's a miracle when you reach your destination on-time. (I haven't observed this behavior in coach bus drivers, though) Also, when I was a truck driver, someone told me, "don't assume just because he's a commercial driver, he's gonna drive right."

The car was at fault in fact it was the retired police officer who straight up lied through omission and left out half the law that actually said the car was at fault and then applied that law to the bus instead of the car like the half of the law he didn't mention said it should.

Look at the timings of the lights, look at both drivers povs. After you're done denying the bus driver is at fault, watch the the intersection lines from the other drivers pov and the length of the greenlight. Now you will have to deny reality and say that the bus driver did not cross the intersection line when there was a red light, because it is physically impossible for that to not be the case.

In the POV of the car, you can see quite clearly that the bus enters the intersection approximately 2 seconds before the car enters it, and it is not possible for the bus driver's light to still be yellow, as the traffic control system does not allow that to happen.

Unfortunately, bus drivers are often blamed regardless of the circumstances. When I drove charter a hotel van attempted to turn right into their lot from the left lane. But.. alas I was moving in the right lane and keeping a close eye on pedestrians I thought might decide to step into the street. Even the hotel’s insurance adjuster tried to pin the blame on me knowing that their driver was attempting a right turn from the left lane. “I should have seen him in the mirror” was the line.

As a class commercial CDL driver, the bus was legally in the intersection. Seems like there's a issue with that intersection between the distance from the limit line to the intersection. The first line is the limit line, not the crosswalk. Once the bus is past that line he's in the middle of the turn. But I don't feel the Mazda is at fault because he had the green. However he did have a duty to clear the intersection prior to entry.

Actually the bus driver was completely legal in going through the intersection. That is why upon further review the officer cited the other guy. Once someone goes over the limit line no matter how small, they are legal and cross traffic has to yield until the intersection is clear even if they have a green.

Once you cross the limit line before it turns red you are in the intersection and have to finish going through and clear it in a reasonable and timely fashion. Because he was in the intersection first cross traffic must yield to him the second officer they interviewed was half right. He quoted the law correctly but misapplied it. The bus was legally in the intersection first so the car had to yield to the bus before he can proceed.

A driver facing a steady circular red must stop before the limit line and remain there (with exceptions) until the light is green and it is safe to proceed. A green light means 'Proceed when safe'. The bus driver was legally in the intersection, having entered before a red, but after the green arrow expired, had a duty to yield to oncoming traffic. Therefore, the bus driver was at-fault. The other driver was approaching a green light in lane 3 and proceeding straight when the bus crossed 2 tracks and entered his lane without yielding.

I am a retired LEO, I am trained in accident investigation and reconstruction.. I would definitely have cited the bus driver for not abiding by the California Vehicle Code for entering that intersection. I have had many cases where traffic accidents occurred in this type of manner. The green light for the oncoming driver was illuminated and there was no sign of the bus in the intersection when he was approaching until it was too late. The bus was at an almost crawl speed when it approached the limit line when the light turned yellow. With the fact he normally transports passengers, and passenger safety is key, the driver should have stopped, just my two cents.

The video clearly shows the car is at fault look up vehicle code cvc 21451 and cvc 21452 i know this for a fact because i just beat a redlight ticket under similar circumstances. I also beat a redlight camera, and a speeding ticket on seperate occasions. I am actually very familiar with traffic law i am not like 99% of the people commenting who have no idea what the laws are and think they know what the law is for no reason other then they feel they are right. I want his answer because he could actually be right depending on who is being cited for what. Like in my case i probably was guilty of something but it was not running a red he could have probably gotten me for a different violation but he messed up by trying to get me for a red light violation. From what i know the officer was correct on citing the car for failing to yield to the bus but maybe the bus did commit a violation that i want Andrew to cite that i am not aware of that would absolve the car driver. From the video there is not one that i know that i see the bus did the only violation is from the car but i could be wrong so i want andrew to tell me which code was violated. It could be one i dont know of I dont claim to know every code but i do know more then most people.

I'm gonna say that 'yield' would surely apply to both vehicles in any case. Even if it could be argued the bus driver was in the intersection lawfully, it would still have to proceed cautiously and yield if necessary. Given the late entry, the driver would surely be aware that other vehicles might be moving off and should be slowing down. Apart from all that - I wouldn't want to be a passenger on a bus turning like that!

Fun fact - when an investigator like this changes his mind, it means the city paid him to change his story because the law doesn't apply to city officials and workers. Cameras prove the bus driver was at fault (he turned on a Yellow light and I bet you anything it was red before he reached the line) and all of a sudden after the city refuses to pay "Oh yeah I change my story and the entire law of the road, so guy in the car is at fault and I'm totally not being paid to say this by the city".

It is not required to stop on a yellow, if the very front tip of your car goes over the line into the intersection before the light turns red you are now in the intersection and have the right of way to clear the intersection

imagine there's standstill traffic, somebody gets blocked in intersection, you're not allowed to smash into him, even if you have green, the logic is valid. The truth is the traffic signal is at fault, it should have enough time for the intersection to clear or the approaching cars see the cars that ran the yellow, you can see from his camera that the left on his side is still yellow when he has green, that should be in sync with the bus light since both lefts can be performed at same time.

The bus driver may not be at fault. I still think he could've stopped, but that yellow was so quick (especially for a left turn) that it didn't give the bus enough time to clear the intersection when he should've. Increase the yellow time from 3 seconds to 6.

Just a few seconds longer time on the yellow ( and the other side should STAY at RED not shift to yellow/green ) then this would not have happen. But both sides turn yellow at same time and then red/green giving NO time to clear the path. BUT... Oh , man if they just slow that down a little they you will hear the drivers complaint of long waiting times ect. It's a result of bad traffic planning paired with the bad behaviours of drivers. Also drivers as soon as they see green light they speed up ( if aproaching and not already waiting ) This mean they simply move faster and as here doesn't leave time to watch out for traffic. You can see in video that all the other cars they Did NOT drive but waited for traffic to be clear , But he didn't slow down he speed up , driving and hit the bus. ( '''I have my right , it was green ''', syndrome ...) He didn't have more right that to be shure it was clear before drive. So who to blame ? The CAR DRIVER , he didn't look if it was free and didn't do as the others and wait. He speeded up in same second it was green light and , BAM there was a bus. But if you dare to mention this then they all go after you. But it is the truth. I see the same picture again and again in different countries. Too busy to actually observe what going on in traffic.

If there is a law in place that require you to yield anyone still within the crossing, there technically does not have to be any clearing time whatsoever in the signals. And if the bus was there legally? That is a question of barely milimeters - whether he was already past or still before the line at the moment the light turned red. And that was the bulk of following investigation, I guess. In any way should the bus be 10cm faster, so be in the crossing still legally, there is no way for the car driver to tell the difference, so he had to act like the bus was there legally. And clearly he didn't. And so that was clearly his part of the crash cause. So the final question was only whether the crash was caused by the car driver alone, or whether it was together with the bus driver. Either way good bye the insurance bonus...

The bus is clearly in the intersection, other traffic has stopped because the bus is in the intersection, and this driver comes up the right lane into an intersection he has no clear view of because his view is obstructed by the BMW.

@@aigtrader2984 The driver should back off as he approaches a partially obscured green-lit intersection, absolutely, but all that means here is he didn't get the opportunity to avoid the bus' bad driving. Nothing about this situation exonerates the bus driver at all. He punches it on the yellow arrow from a dead start and barely gets his front wheels to the line as the arrow turns red. He enters the intersection on red. The fact that his view (bus driver) was also obscured was further reason not to punch it into an intersection against a red or yellow arrow.

If you look at the yellow turn light they are synced in both directions he was halfway across the intersection and the yellow turn light was still yellow. It’s also reasonable to assume that a bus driver on that route would know that no matter how you slice it one person was in the intersection and one person was not in the person who was not in the intersection had the duty to ensure that the intersection was clear before he entered it. That is the law, that is what the police found, and that is why it ended up being his fault. It would help if when the news man is talking trying to make this the bus drivers fault he wouldn’t narrate something that is directly opposite of what We can all see

Wrong. I don't think you're from the US. Along with 41 other states, California is a "permissive yellow" state. As long as you crossed the limit line when the light is yellow, it is legal. This is to prevent people from speeding through the intersection to get out or slamming on the brakes and causing a rear-end collision. The opposite is "restrictive yellow" which means you must be out of the intersection before it turns red. Therefore, if the bus entered the intersection on a yellow, it cannot "jump the light".

@@jade8910 A few seconds of caution isn't going to garner a honk. A few seconds is how long it takes you to build up speed letting go of the brake. Slamming on the gas flooring it through an intersection without looking out for red light runners will get you killed. You should be prepared to slam on the brakes not the gas, chicken without a head. Do you always assume there are no red light runners? Just tunnel vision ahead of you once it turns green?

It doesn't change the fact that the bus was at fault. Left always yields to oncoming traffic. He ran a red light. Simply put the bus driver should have been given a citation. Insurance never takes care of you. Get a lawyer and even then learn everything you can because you are your best defender. Last accident I had, I had to basically represent myself because my lawyer was too busy to submit proof that other driver was at fault. They were going to say we were both at fault. I fought it tooth and nail. I won and got paid well.

It seems in the US lights routinely change at intersections with no "dead time". Here, in the UK, a junction (which is what we'd call it!) like this would not turn the lights to green for Canoy for a good 2-3 seconds after the bus' light had gone red. Thus, there would be a few seconds where no lights would be green at all, which gives traffic like the bus a few moments to clear the way. Here, we would expect a vehicle which has proceeded on a yellow light on the crest of it turning red to expedite its crossing, not to proceed cautiously.

My town has a small dead time where all lights are red for a bit 2-3seconds. Clears intersections. I’m in Missouri, USA

That‘s mandatory in pretty much all of Europe and the UK I believe. Seems like an incredibly naive idea to leave no dead time between the lights changing. Might work for horses and carriages, but cars? No.

Most intersections in the US are actually like that. Red on both for a minimum of 3-5 seconds and up to 10 seconds sometimes. I really don’t know why it wasn’t like that there. Had to be some “city saving time and money with programming” issue.

The US is a big place. You're going to see variations across different states, counties, and municipalities. In larger metro areas (like the DC Metro area where I am), there is a "dead time" of around 2-3 seconds in most major intersections. There is a very large incentive to minimize traffic down time as much as possible because of the extremely high volume of vehicles that need to travel through. It's a careful balance that traffic engineers have to consider.

What if the bus had been stationary in the intersection. Say it had stalled and couldn't move. Does that give you the right to proceed through simply because you have a green light? What if it had been an emergency vehicle? A green light does not mean that it is safe to proceed through the intersection, it just means that you have the right of way to proceed through. How safely you proceed through is up to you.

I dunno how it is in Cali but in Ontario (Canada) if you fully cross the stop line before the light turns red you have right of way. For instance, left turning traffic that enters the intersection waiting for through traffic to ease up before proceeding . It's possible to be caught there right up until your (and their) light turns red. AT which point perpendicular traffic now has the green but they have to wait for you to clear the intersection. So no, just because it's green doesn't mean you can beam it through an intersection.

everyone: debating which of the human beings are wrong in this scenario. me: the traffic lights are wrong! for real what about the poor calibration on those traffic lights, it seems like when one light turns red the other turns green immediately, even though this is a huge intersection since there is a tramrail in the middle. at 0:48 the light turns green, even though the car that entered the intersection before the bus was still on the intersection (that car didn't even go through yellow, it was plain green).

I hade the same ide. How can it be possable for 1 sector to be green before any crossing sector has turned red and hade a few sec for traffic to clear the intersection. ppl run yellow all the time so it is very possable that 1 would pass just as the light turn red and another lane turn green with a moving car already on the way. That is just a disaster waiting to happen.

@@discthrowerjs hi genius, so? that means whenever a light turns red the other lights should turn green immediately? because that is not how traffic lights work. they should also consider the time needed for a car to get off the intersection, even if they went through yellow. even if they missed yellow and just go through red, there should be enough time to leave the intersection. If that bus went through yellow a second earlier, they would have probably still had an accident or atleast had to brake firmly.

Just because the lights green doesn't mean you can hit the old lady walking across the street. It's the same idea. The bus driver was clearly on the cusp of the point of no return. I had the car driver been paying attention and looking both ways and being aware he could have avoided the accident. The bus was certainly in motion before the car.

@HomoTriSapien If these lights were that badly synchronised, then this intersection would already have been a known accident black spot. The way the enquiry seemed to run was that this was an unusual set of circumstances and they couldn't figure out who was to blame. If the lights were so bad, it would _definitely_ have happened before.

The bus was wrong, but also to preserve your life and avoid being maimed. Just use your eyes to make sure the road is clear. He sped into a crash because of a green light. Notice the other driver who actually could also have taken off because of a green light not move and get themselves in a mess?

I am listening to what the Milpitas officer that was interviewed says, "a driver with a green light has the duty to ensure the intersection is safe to proceed". That begs the question to me -- doesn't a driver entering the intersection on a red light have an even higher duty to ensure that it is safe to proceed?!? To defend the wrong-doer is status quo anymore I guess. I hope that a good lawyer picks this one up for Canoy and gets him some justice.

Operator did not enter the intersection on a red. he entered it on a yellow. this was clearly stated in the video. it was not his fault; in the laws eyes. In the companys eyes he was surely hit with a "preventable" accident, suffered substantial retraining and most likely being heavily watched if hes not fired.. I'm a city bus driver too and if a company deems it preventable they do NOT like a driver recking their bus and putting a vehicle out of service even if its not his fault legally.

Your comment is right. Since inception, the USA especially via the constitution main mandate has been to protect &shield the lawbreakers and criminals ‼️ The other guy who posted the bus turned on a yellow, even in the report it stated you can't see it but the light was read. If that arrow was yellow and the other light was green there would be accidents in that intersection 7-24-365-all the time till they fixed that problem

@Stan Lee It is neither the bus, nor the car's fault. It is the city's fault for having a system whereby it is even possible for insufficient traversal of the intersection to permit a green that soon after the bus crossed that point. If the light was indeed green for him at that point, the timing from the car's visible dashcam indicates that there was insufficient time for the bus to clear the intersection before changing the other light to green.

Remember guys, treat a green light on a major roadway like a 4 way stop, you never know when a bus is running a red light and is granted right of way. Also, don't bother calling the police, let them tell you after the fact you were wrong without even looking at dashcam footage from the bus.

Actually the retired officer and/or the news is being very shady they cut out the first half of the law. California Vehicle Code 21452. (a) A driver facing a steady circular yellow or yellow arrow signal is, by that signal, warned that the related green movement is ending or that a red indication will be shown immediately thereafter. Not one mention about stopping. But look at what green light laws are. California Vehicle Code 21451 (a) A driver facing a circular green signal shall proceed straight through or turn right or left or make a U-turn unless a sign prohibits a U-turn. Any driver, including one turning, shall yield the right-of-way to other traffic and to pedestrians lawfully within the intersection or an adjacent crosswalk. Look at that if you have a green you "shall yield the right-of-way to other traffic lawfully within the intersection" Meaning the retired cop and news are being sneaky they cut out the green light part for the broadcast and applied it to the bus but the bus ran a yellow according to the news so the law doesn't apply. The law only applies to the car. So the bus went in on yellow and was legally in the intersection well before the car meaning the car has to yield so the first officer was right not the retired one.

@@Larwood. You can clearly see he passes the limit line well before it turns red. California and 41 other states are permissive yellow states once you touch the limit line before it turns red you are legally able to continue through the intersection. Only in the 8 other states you are required to stop if you cant make it all the way through before it turns red. Which is why the laws are written the way they are above, you don't just pick and choose how you want to follow it you have to take them all into consideration at once.

That is the problem with “officer’s discretion” and “interpretation” of the law. I’ve been pulled over for crossing LEGALLY on a yellow light (meaning my tires were already past the crosswalk and within the intersection) because according to the officer, I “ran” a red light. The fact that the intersection is so wide wasn’t taken into consideration either. That bus driver should’ve been driving safely and not like he was in a rush to go home. I hope he sued VTA

The bus driver was looking to pass the blame to keep his job and pension, and as for the yellow you ran it depends if the cops need to pad there ticket count. Spoken to a few and they just don't always have the time to care. Most of them don't care but young cops and the likes are looking for blood in the water.

To tell you the truth it takes some dedication because after the first win i was getting harrassed by them i filled complaints against them also though.

HomoTriSapien I see it here in this video.. but even aside from this.. I’ve been noticing many large intersections throughout the Bay Area having this problem. I see the intersection shout-outs every day being a truck driver.. its usually everyone’s faults too.. but if all these problem intersections have a common problem AND another commonality such as the engineers/electricians who program them, then I’d say THATS where the blame should sit!

I can attest to the stupidity of that intersection. The left turn line stays green for all of 2 seconds, while 15 cars waiting to take the turn squeeze well past the light turns red. Its city's fault, amd also the bus driver's

@Pouty MacPotatohead the bus wasnt in the intersection, it was behind the line, dont be an idiot. The bus could have easily stopped if the driver wasn't being an asshat. A bus going 8mph can easily stop in 40ft. Thats why they have airbrakes and the drivers are licensed. if the driver actually took his job seriously he could have hammered on the binders and this whole thing wouldn't have happened. And you wouldn't have commented looking like a smoothbrain.

Maybe it's different in America but running a yellow light is illegally entering the intersection

It differs slightly from place to place but I agree the bus should have stopped. I also agree that the car was paying 0 attention to his surroundings.

He was at fault though, watch the lights. The bus likely went through when it was green or yellow (in some countries busses can go through yellow light) and he saw the bus as well, so he should have yielded. In fact in driving school you are taught that you must yield to public transport, ambulances, fire trucks and police vehicles. Thus even if you were in the right you would actually not be because you violated a basic rule that you are taught.

The bus was empty (looks like it was being driven back to depot or something), and the driver is somehow in a hurry. The investigator even timed the incident - the light was on yellow for 3 seconds for the bus driver, so he can't claim he had no time to stop. He driving into a blind spot (turning left into the intersection), so more reason to slow down... but it looks like he sped up.

@Abyss Strider Nah bs, check back on the video. There was a car blocking his view in the left lane. He couldn't see the bus till he was at the line. At most, he had 3 seconds to react. That intersection was completely clear from his view. Would you have stopped on a green of about 4-5 seconds, you don't see any traffic, and it looks crystal clear. Of course you would

I blame the city traffic engineers for creating the situation were both think they could legally go through the intersection. The intersection is very wide so should be using delayed lights, where both intersection are red for about 2 seconds before the light changes. Our city uses such a strategy even for smaller intersections because instead of relying on the drivers to make the decision it just prevents such a situation from occurring at all by removing human error from it.

I does seem a bit strange to me to see both a green and yellow at pretty much similar times. Here in the UK, the lights go red for one side of the traffic flow before the other one even starts turning green. That way there is no ambiguity.

Agree. It seems to me that the light wasn't timed correctly. A 2 seconds delay would probably give the driver more time to react. Maybe the city is trying to cover their mistake.

You need to make sure the intersection is clear before entering it. Just because you have the green doesn't mean you can go in blindly. Do you see how the cars around the guy are still waiting for the intersection to clear before entering it.
