Defendant is a scheister. He is quoting one price in the contract to create 5 pieces of custom made furniture, then falls down on the job and tries to charge her the whole deposit for ONE PIECE. On top of that he took forever. Good thing the plaintiff had a contract, emails, and text messages to prove her case. Good for her!!

@@marleonetti7- You normally do have to pay a deposit upfront, because the person has to buy materials, and he's not going to do that when he doesn't know if you're going to pay him when he's done. This guy was obviously pure scum, and a thief and a fraud, but it is normal to pay a deposit. Try getting a lawyer without paying one, unless it's a slam-dunk civil case where he's going to win a lot of money.

Although it could be that the Defendant's skills might not be up to par, I think cost also played a big role! I think the Defendant just said a price to get the job, but didn't do his homework! Once he realized he underbid the job, by A LOT, he tried to pull a switcheroo! Then instead of just giving back Plaintiff's money, he was greedy! I don't think $5,500 would even cover the cost of all those materials anymore! Once the pandemic started, cost of those materials skyrocketed! 🤑💸

Wayfair is often overpriced. Vastly. Same thing I got from Amazon was $400 more on Wayfair. They have good customer service though if there’s an issue. I got a free tv stand when mine was damaged and missing parts (handles). They just sent another one and let me keep the old one. I use both. 🤷♂️

7:45 I’ve worked in a cabinet shop, work with a construction company, and I built furniture at home. There’s a lot that goes into making furniture i.e. cutting material, multiple sanding, assembly, and paint/stain the finished product. When I heard 5K for this project, my first thought was its a very cheap price/bid. He knows nothing about the industry, even if he is an artisan. The defendant screwed up!

Judge Milian, I am so glad you let this individual have it. I recently order furniture (from a country I won’t mention the name, across the border) and the work was simply sloppy from beginning to end. First, they didn’t make the furniture to my specifications, never sent me pictures after requesting them several times, and kept delaying the delivery time. After complaining to the owner of the company, he was so senile, and assured me the furniture would last me decades. I had asked for wood and instead got some tri-play junk that was half ass done. Unfortunately, the laws don’t apply in this country and I so wish there was a judge like you here that stands up for consumers like the plaintiff and me. So annoyed just thinking about it.

Sounds like an issue my kids had! They came across a furniture maker at the monthly market and so they contracted with him. They did the same thing as the plaintiff, they called, text, email, Facebook posts and messages… he didn’t respond for over a year! We had to step in and get a lawyer involved. The carpenter FINALLY got in touch and then delivery kept getting pushed off. After 18 months they finally got the bed delivered. Needless to say I was furious!!!!!!

100% agree! And that's not totally true.. There are 2 ways you can be awarded for more than just what you are out of pocket. You can get punitive damages (basically a punishment for extremely poor behavior to deter them from doing it again) against the defendant, if it seems fitting for the case and in this case I think it most certainly does! She definitely could have asked for it as part of her suit but even if she didn't, the Judge has the power to make changes to the case that matches the evidence the way she sees fit and could certainly tack on punitive damages for a case like this! At the very least I expected her to at least award the plaintiff with pre-judgement statutory interest from the time she gave him the money.. it's not a whole lot but it at least gives her a little something for her troubles and makes a statement to the defendant! Usually she does award the interest on cases like this when they just don't seem to have any remorse and end up pissing JM off, which he certainly did!

Some of this requires a translation. When a contractor or workman says " I'm running behind " what that really means is " I'm doing work for other people and I put YOUR job on the backburner, too bad for you pal ". That's what they do. I once contracted an outfit to stucco my house and before the job started, the contractor said the job would take about a week. Well, TWO MONTHS LATER, WHEN IT WAS STARTING TO GET COLD OUTSIDE, THE JOB STILL HADN'T BEEN COMPLETED. I wish I had been watching court shows on tv back then, I would have known about the " time is of the essence " clause and had it put in the contract. Lesson learned.
