She should have given them punitive damages. I don't know if you can give somebody punitive damages when they haven't asked for it, but people are often unknowledgeable in these things. If it was me, I definitely would have asked for it.

Defendant is a scheister. He is quoting one price in the contract to create 5 pieces of custom made furniture, then falls down on the job and tries to charge her the whole deposit for ONE PIECE. On top of that he took forever. Good thing the plaintiff had a contract, emails, and text messages to prove her case. Good for her!!

when are people gonna learn NEVER PAY ANYTHING UP FRONT . plaintiff would not have to go through this had she only did business with someone who does not ask for up front money . u pay when the job is done and if they need materials then u go with them to get the materials or u buy them yourself to make sure they have been purchased with your hard earned money . this contractor finished the jobs for people who told him he would get paid when he finished the job .

​@@marleonetti7- You normally do have to pay a deposit upfront, because the person has to buy materials, and he's not going to do that when he doesn't know if you're going to pay him when he's done. This guy was obviously pure scum, and a thief and a fraud, but it is normal to pay a deposit. Try getting a lawyer without paying one, unless it's a slam-dunk civil case where he's going to win a lot of money.

I work for a company that builds custom industrial heat transfer equipment. If I went back and told a customer there was going to be a 5-fold increase in price, my entire career would be dangling by a thread. This guy needs to shut his doors and work for someone else. Either that or learn to sell effectively.

As someone who has purchased a lot of custom furniture, this defendant is nothing but a thief. I’m glad they used the name of the business and his last name so everyone knows exactly who they should NEVER HIRE!! The only thing I believe that he said, it was his last statement. “I’m not thinking too much” 😂

psssh there are a few such moments. go look up the episode where one family memeber sued his brother for stealing a painting the deceased father left to him. that episode is FIRE ! JM went in and almost killed the man.

Although it could be that the Defendant's skills might not be up to par, I think cost also played a big role! I think the Defendant just said a price to get the job, but didn't do his homework! Once he realized he underbid the job, by A LOT, he tried to pull a switcheroo! Then instead of just giving back Plaintiff's money, he was greedy! I don't think $5,500 would even cover the cost of all those materials anymore! Once the pandemic started, cost of those materials skyrocketed! 🤑💸

Lol the judges’ relationship reminds me of mine with my husband. He’s so nice and patient and I start out that way but I’m usually more like Judge M. I always tell him exactly what her husband said, “sometimes being nice pushes you to the back of the line”

$5,500 is so cheap for that custom furniture, I actually considered if I should find my own Craigslist "artisan"🤔. However I don't want to end up in court, so I'll just stick to Wayfair!🤣 Although, I don't know if Wayfair would even have comparable furniture for $5,500, especially with inflation! 🤔😂

Wayfair is often overpriced. Vastly. Same thing I got from Amazon was $400 more on Wayfair. They have good customer service though if there’s an issue. I got a free tv stand when mine was damaged and missing parts (handles). They just sent another one and let me keep the old one. I use both. 🤷‍♂️

7:45 I’ve worked in a cabinet shop, work with a construction company, and I built furniture at home. There’s a lot that goes into making furniture i.e. cutting material, multiple sanding, assembly, and paint/stain the finished product. When I heard 5K for this project, my first thought was its a very cheap price/bid. He knows nothing about the industry, even if he is an artisan. The defendant screwed up!

The defendant changed the terms of the contract midstream and has no defense in this case. He clearly breached here. The plantiff deserves a complete refund. Milian had every right to go at him the way she did. Great verdict

Judge Milian, I am so glad you let this individual have it. I recently order furniture (from a country I won’t mention the name, across the border) and the work was simply sloppy from beginning to end. First, they didn’t make the furniture to my specifications, never sent me pictures after requesting them several times, and kept delaying the delivery time. After complaining to the owner of the company, he was so senile, and assured me the furniture would last me decades. I had asked for wood and instead got some tri-play junk that was half ass done. Unfortunately, the laws don’t apply in this country and I so wish there was a judge like you here that stands up for consumers like the plaintiff and me. So annoyed just thinking about it.

I'm really glad when she made sure to say his name and the company again, right before she said what a jerk he was. Did he really think he'd be able to breach the contract, and then expect them to pay what they've already paid for one coffee table????. I really hope they put in a report with the Better Business Bureau, and I think he should have been charged with a crime (fraud). I hope they ask for punitive damages. I would. I'm glad they had that text.

Never give more than a 10% deposit on anything. If the vendor does not like that, move on. Vendors need incentive.

Sounds like an issue my kids had! They came across a furniture maker at the monthly market and so they contracted with him. They did the same thing as the plaintiff, they called, text, email, Facebook posts and messages… he didn’t respond for over a year! We had to step in and get a lawyer involved. The carpenter FINALLY got in touch and then delivery kept getting pushed off. After 18 months they finally got the bed delivered. Needless to say I was furious!!!!!!

100% agree! And that's not totally true.. There are 2 ways you can be awarded for more than just what you are out of pocket. You can get punitive damages (basically a punishment for extremely poor behavior to deter them from doing it again) against the defendant, if it seems fitting for the case and in this case I think it most certainly does! She definitely could have asked for it as part of her suit but even if she didn't, the Judge has the power to make changes to the case that matches the evidence the way she sees fit and could certainly tack on punitive damages for a case like this! At the very least I expected her to at least award the plaintiff with pre-judgement statutory interest from the time she gave him the money.. it's not a whole lot but it at least gives her a little something for her troubles and makes a statement to the defendant! Usually she does award the interest on cases like this when they just don't seem to have any remorse and end up pissing JM off, which he certainly did!

The defendant was a little too smug for my tastes - glad the plaintiff got her money back. I don't understand why the defendant is even in business if he can't or won't fulfill the terms of a customer's contract.

once in awhile there's a case where i'm pretty sure that the gavel died when the Judge made her decision. This is one of them.

Why didn't we get to see the furniture? I wanted to see what he made for her! Did I miss it? I usually listen, more than watch, (while doing chores,) but I rewatched, & still only saw the inspiration pics of what Plaintiff wanted, not what Defendant made!😞

Golly. That furniture looks like it's back from the "Father Knows Best / My Three Sons" era. I mean the flat screen tv looks out of place sitting on that old ass style of furniture. Whatever floats your boat. That defendant shouldn't be in business much longer when he treats customers like this. If he'll treat a gentle and patient lady like this, he'll treat anyone like this and worse. Without customers, what do you have?

Good luck getting that furniture for what he quoted, the material - i feel like he only quoted labor? He really did cut himself short. But he can DEF make that money back with what he has!

Some of this requires a translation. When a contractor or workman says " I'm running behind " what that really means is " I'm doing work for other people and I put YOUR job on the backburner, too bad for you pal ". That's what they do. I once contracted an outfit to stucco my house and before the job started, the contractor said the job would take about a week. Well, TWO MONTHS LATER, WHEN IT WAS STARTING TO GET COLD OUTSIDE, THE JOB STILL HADN'T BEEN COMPLETED. I wish I had been watching court shows on tv back then, I would have known about the " time is of the essence " clause and had it put in the contract. Lesson learned.

Sometimes, I wonder what makes these defendants think they have a defensible case when it is clear as day they'd breached the contract totally. It's not even close to being disputable.
