Bob Seger or his agent object to his song, "We got Tonight" playing on the radio as I recorded the video. Really Bob! I'm not making a dime on the video, so what's the big deal. Your song was playing over the open airwaves. I didn't add it to the video by choice. Seems petty. Just watch the new one from 2014 and we'll see how long before it gets muted too! Their Reason for dispute This video contains the material at issue, but the material is in the public domain or is not eligible for copyright protection. My Explanation The audio recorded was being broadcast over the open airwaves (FM radio). The audio is incidental to the video. The video is not monetized for any personal gain. The incidentally recorded audio was simultaneously being broadcast to the general public and not at a "fee for service" event. To retroactively make a claim against the public broadcast of the song, after the public broadcast was already approved, seems contradictory. Additionally, to separate the audio from the video is a violation of my freedom of expression and artistic license. What's next, I can't show the name of the boat, without approval from the boat manufacturer?
