Oh, this story is justified!! That his hair was still dry following escaping the submerged car, his nonchalant body language while watching Steven and EMS try to find the car, and, of course, heading directly out to Cindy's home to state he killed the kids, holy smokes he's guilty!! I grew up in this area, and it makes beyond pissed off that this callous, selfish pathetic excuse for a man has the ordacity to still try and escape the punishment he deserves. All that technical crap should be discarded. The evidence lies in the fact he didn't even try to rescue those poor children, not call for help, went and told his ex wife first instead, then went back and just stood nearby smoking a cigarette

But I am absolutely certain that he would've died trying to get me out of the water if we were in such an accident. Did this POS dive even ONCE to try and rescue his children? Did I miss something? Exactly. It was this detail that made me believe he was guilty even before the trial. No parent would stand on dry land smoking a cigarette while their children drowned. I live in Geelong and followed the story - it was all over the news. During the trial, the evidence of the car having been steered around a tree to reach the dam was reported. That seemed incredible to me, that someone would do that and think they could get away with it. I still can't get past his behavior after the "accident" though. No attempt to save his kids. No attempt to call emergency services. Only determined to break the news personally to his ex, to see her face when she heard her kids were dead. Evil S.O.B.

I want to know that too! I can see panicking and still being kind of useless while trying to save them, but it said they all had their seatbelts off and one of them was partially out of the car...It isn't like he could have forgotten they were there, I imagine everyone was in panic... Whether or not he drove off the road on purpose seems less relevant to me than why didn't he DO anything, why didn't he want to call 911, why did he get home and tell his wife he killed the kids??

@ him having no history of coughing fits severe enough to cause black outs is surely an indicator of guilt. Him "blacking out" but fairing better then all 3 very awake children is also extremely suspicious. Driving at all knowing you experience such fits that cause blacking out with three children in the backseat makes no logical sense. Another indicator of guilt. His story makes no sense even without the other damning information.

You can always tell when someone operates superficially vs they actually poured their heart into their choices. Relationships and unions isn’t some kind of hobby or something that goes on your to do list! Too many folk have the reality of what relationships are made of twisted!!! Half the time, they’re likely competing with whomever and or just “playing house” for reasons that tickle their fancy. Being unified (on any level) requires healthy balanced and sane reasoning. You can’t up and mix water with oil and expect something grand! To up and spitefully destroy a whole 3 other beings as if it were a project. #braindead.

My parents were killed by a drunk driver when I was 5. Neither set of my grandparents ever got over it...& my parents were in their 20s. My maternal grandparents lived within a SHORT walking distance to a beach on Anna Maria Island in FL & my grandmother stopped going to the beach because shortly before my parents were killed she was at the beach when my mother called & she missed the call. I can't imagine losing a child, let alone 3, especially this young.

There is no such thing as a broken heart. That is just nonsense to sell romance books and movies. Decisions are made in the brain . The heart merely pumps blood throughout the body to keep you alive. Natural causes simply means the person died without some other type of interference or known illness. It can happen to anyone at any age at any time. Most likely she died of stress related illness due to the trauma which I guess is what you are glossing over and calling a broken heart.

Refusing to call for help, in my book, is more than enough to send him to prison. Even if the evidence now points out that the coughing fit was real and the deaths of his sons was just an accident, at least he has spent about 20 years in prison, which in that case would still be just, I think. Even if he did not kill his children, the way he treated them, especially the eldest, was horrible. The way he stalked Cindy after they separated, and the toxic environment he created for the poor children, makes me happy that his sorry ass was sent to prison. If he is released now because the murder charges were incorrect, at least Cindy will not know and the time he spent in prison at least punished him for all the things he did do to the boys.

@nixm9093 Indeed. My son and his girlfriend were murdered in 1998, the perp was sentenced to 2 consecutive life terms without the possibility of appeal (including civil rights) or parole. The judge told him that if he dared appeal, the DA can bring him back to court and seek the death penalty; that's a judge who did his job correctly.

The initial things about the heater, lights and ignition all being in the off position are very questionable. He stated his coughing fit was brought on by him turning the heater on. Why was in the off position when car was pulled from water? The water would not have turned all three of these things off. He did it on purpose to hurt his wife.

Never underestimate someone's level of spite.. I learned that the hard way (my kids are safe & healthy but the things I found out .... I'll just say that he was no longer allowed around my children without me being there. They were still young & wanted to see their dad so that was my way of compromising with the situation, while maintaining the safety of my children). Best wishes to everyone ❤

The murders happened in 2005 and IF Robert had been experiencing coughing fits as he had claimed in 2005, he would have experienced consistent issues with coughing fits as he waited in prison for the first and the subsequent second trial. After both trials Robert was older, sicker and was still most likely smoking so this suggestion that he had blacked out is utter BS! And let’s not forget HOW Robert acted immediately after the accident as he refused to call emergency services BUT demanded that he be driven to tell Cindy that her children were dead as HE wanted see the hurt and devastation for his OWN satisfaction!!! Robert killed his children as he was angry and wanted to break and traumatize Cindy in the deepest way possible which is WHY he was found guilty during both trials.

Crazily enough this happened again in Australia in 2015, this time it was a woman, an African refugee immigrant, she purposely drove into a lake with her three children in the car, two of them who were four year old twins drowned while her 6 year old survived. She was found guilty of murder and was sentenced to life with a minimum of 20 years, when or if she is released on parole after the 20 year minimum she will be deported back to South Sudan where she is from.

Any loving and caring parent would have been in the water doing everything they could to get to their children. Also, the car ignition was turned off as was the heater and the lights. Then he didn’t want to call for help but wanted to be driven to his ex wife’s house to tell her the “news”. This guy is mentally unstable and murdered his children.

Judge. I turned on the fan and had a coughing fit and blacked out. My car went off the road by itself, through a fence, across a paddock and turned by itself just before it hit a big tree and then crashed into the dam. Then luckily I became conscious and turned off the fan, lights and ignition so my battery wouldn't go flat. I was able to swim to safety without getting my hair wet. I flagged down a passing car and got them to drive me to my ex wife's home to tell her that I killed the kids. We went back to the crash site and I had a smoke while watching everyone trying to save the kids. Damn it's not my fault I blacked out judge so can I go free now.😮

I'm from the states so maybe it wasn't in the news here. I think that poor Cindy died of a broken heart and Steve is following close behind her. I live on the opposite side of Port Phillip Bay to where this happened. I remember it well. None of the altered information explains why the heater, the lights, and the ignition were off. It doesn't explain his behaviour and lack of concern or panic immediately after the incident. It doesn't explain why he refused to use the mobile phones of those who stopped. It doesn't explain why he went to Cindy's home and told her "I've killed the kids". It doesn't explain how his hair was tidy and his clothes dry, even though he said he dived for his sons. He's guilty, and a terrible excuse for a human being. May he rot in jail.

The fact that he did not do anything to try to save his boys makes him guilty in my mind. I would be getting my children out before leaving the car or diving down over and over to get them out. The father leaving the water and smoking, then going to a home and back? It was intentional, or at minimum, an unexpected opportunity to hurt his ex-wife.

My apologies, but I careless about the terranes and weather that day. Had I been a juror for this trial, my concerns and reasons for conviction would have been more towards the fact that his headlights were off, the ignition was off, and the heat was turned off. Which as any driver knows those things have to be turned off with intention (the knobs were all turned to the OFF position) and the only way that can happen is by human intervention. Then there's the fact he didn't try, attempt, scream for any help, nor did he show any kind of Panick or concern for the situation at hand. there's just way too much against him to not show intention and all he and his legal team keep pressing is he had a cough attack and few second blackout. Well, I suffer from syncope due to a brain condition and I know for a fact I have to be coughing a minimal of 10 seconds before I blackout. I know every situation can be different but it's the lack of oxygen to the brain that causes that. He's a liar and murderer and in my opinion shouldn't' be able to keep going through the legal system to get off because he's a wimp and wants to cry about his punishment. DON'T DO THE CRIME IF YOU DON'T WAN TO DO THE TIME. IT'S LIFE FOR A LIFE SWEETIE, NOW LIVE WITH IT!

Not excusing what he did in any way but she was an idiot for letting things progress to having 3 kids with someone she barely got on with. Surely she should have seen things were not going to improve when she already had major doubts even before they were married. In saying that I will never understand how anyone can use kids as a bargaining chip in any way shape or form or to cause them harm in any way just to get back at someone. That is psychopathic behavioural patterns and unfortunately still something glossed over around the world as instead of concentrating on what causes these mental conditions it’s just easier for people to cope with calling them evil. To these people it is a self survival mentality where they are the only one that matters and whoever wronged them in their mind must suffer. Unless we do learn more about these conditions it is going to keep occurring around the world. Unfortunately most people are inherently selfish regardless what they may say just some act this out in a disturbing way that we do not understand but need to learn to.

The thing that sounded the most suspicious was the man had said he turned on his heater, but yet when they check the car out after words, the heater was not turned on, and the ignition was turned off as were the lights of the automobile. As a Dad of two i am well and truly on the side of Guilty, how could a so called Dad stand there and watch everyone diving in to try and save the kids, even his ex-wifes boyfriend dived in and they weren't even his kids, he had time to try and save all three or even one just grab a hand get him to the surface and then under again, any Dad would keep trying until they couldn't anymore. Having a cigarette, not even dialing the emergency services choosing to get a lift back and telling his ex-wife himself, no sign of any grief until the funeral and that was a put on. He will most probably get it all overturned and a big payout for a false imprisonment, i hope some prisoner does something to him while in prison as he doesn't deserve to be released and i don't care what anyone says, he should stay in prison and rot.

no , you do not wish anything to happen to him and believe me , I understand righteous and justified anger but the reason is simple , if we want Robert to be harmed as he harmed others , we are just like him and we are hypocrites who seek our own vengeance . My friend , Jesus Christ is more real than you and I , he will get justice for every single sin in existence one way or another and that man will not simply get off with the crime . The lake of fire is for ETERNITY , we must repent and follow Christ and be born again OTHERWISE murderer or not , were going to the same place Robert is for our lies , our hatred , our fornication , our violence , our drunken partying and sexual immorality and whatever other damnable sin we commit , we will not fare any better than a man like him because we are all guilty . You see , it does not matter what number is on your shirt or what position you play , if you live in sin , you play for the same team as Robert , the devil , because sin is of the devil and all sinners will go to hell unless they repent . so repent , and pray Robert will repent , though it is unlikely he will and hell will be a place he deserves to be and those 3 boys , they will be in Gods new earth , his kingdom , forever . We cry out against sinners but we are sinners too , we are hypocrites , we need to repent .

As an Aussie this awful tragedy really hit hard…especially as I’ve been able to vomit, doing 80km an hour, in the middle of three lanes of heavy traffic and not crash. Those poor kids! I can’t bear to think about their end, it’s just too horrible to endure.

Rest in Peace Cindy and her precious boys. My sympathy to their loved ones. So how does Robert explain not wanting to call emergency services to try to save his kids ? How does he explain standing there smoking , with his dry hair , doing NOTHING when there was people trying to help the boys , trying to find the boys????? If he has another “black out coughing fit” and then HE dies from it , then I’ll believe it !!! Otherwise, he can miss me with that nonsense!!!!

Re-trying this man is a waste of taxpayers money. If he was unconscious, how did he save himself but not 1 of the 3 children? After realizing his kids were underwater and could die, why did he not call 911. And lastly, after Steven arrived and dove right in, the father stood on shore smoking a cigarette. HE’S GUIlTY.

Even if he does suffer that cough thing, in my opinion he's just saying that's what happened, there's no one to say he did or didn't apart from him so how could that even be a part of his defence.
