And this is why people say cops need more training. They need more then training, psychology and de-escalation needs to be tested for years. There are so many rogue cops once they get that badge it should be monthly psych evaluations for a few years to see if their anger or attitude has changed once gaining the power to take someone's liberty. Way too many young cops with no life experience. Destroying lives to get a promotion.

" professional police were unknown to the United States in 1789, and first appeared in America almost a half-century after the Constitution's ratification. The Framers contemplated law enforcement as the duty of mostly private citizens, along with a few constables and sheriffs who could be called upon when necessary. This article marshals extensive historical and legal evidence to show that modern policing is in many ways inconsistent with the original intent of America's founding documents. The author argues that the growth of modern policing has substantially empowered the state in a way the Framers would regard as abhorrent to their foremost principles." I fully agree with his assertions.

I totally agree and that’s why we do NOT need to defund the police, but rather make sure they have enough funds for proper training! The need more training and evaluations!

I served in the U.S. Air Force Security Police for 10 years and at my last assignment during a training session we conducted the same training as this cop speaks of. In our tests it was volunteer Airmen from our own flight that consumed the alcohol. The person who consumed supposedly little or none was assumed drunk. The person who drank the heaviest passed. The one that drank a moderate amount (not drunk by breathalyzer) failed. These tests are too subjective and if you show ANY attitude the officer will fail you. It makes no difference if you come out clean, they got even at you for your insolence and cuffed you and locked you up. Officers are assholes like other humans and don't care.

They don't prevent crime ,they hear about it, after it's over. Big deal then they try and arrest the victims. I told both my kids you never call the cops for any reason period we don't need them. they took away are right to travel. the organic constitution has been changed. Know one knows. if you get your ducks in a row you don't need license registration or proof of soothing that might happen , its a scam and we are the victims . your thoughts Steve

Anything you say can AND WILL be used against you in a court of law. This applies to the field sobriety tests as well. They are given to add evidence against you, never for you. Any lawyer will tell you to never submit to field sobriety tests. They are not required. They are designed for you to fail and support the arrest and charge.

Yep. Did a few of these as a volunteer for secfo when I was in the dorms. It’s a pretty subjective test and is easy to pass with any amount of practice.

The prosecutor and defense attorney both proved she was not impaired! The DUI, OVI laws and enforcement are outrageous. They are designed to ring the cash register of these counties and cities. And that is not surprising.

There was a case where the driver said to the off8cer that he had been driving 15/16 HOURS so of course he would not look fresh. Yet he was taken into custody. How HOW can an officer just pull people out of the cars WTHOUTH. EVEN. ASKING. QUESTIONS AND L.I.S.T.E.N. ???????? America's a kkilling machine when it come to your Ploce Force. This officers just said: some people come from work any hour of the night. AND YOY J6ST MAKE YOUR OWN CLONCLUSION. And this test of theirs is BS IN THE N'TH DEGREE. LET THE PEOPLE BLOW FOR ALCOHOL READING AND YOU HAVE AN ANSWER IMMEDIATELY. that is unless you comprehend ZERO reading and believe what you want. Like happened to a driver, blowing ZERO THREE TIMES IN ROW AND HE WAS STILL TAKEN FOR A BLOOD TEST.

The thing is.. lawyers specialise in certain areas of the law. Years and years, decades probably, studying one part of the law, like contract law, or divorce law, or building codes. They spend decades studying one small tiny section of the law. A police man thinks he knows the law, after a few weeks studying tiny parts of it.

Yep and even if you spent years studying you can still be wrong because laws are up to interpretation and at the Mercy of the people in charge perspective All laws are clear as mud and even if your within the letter of the law you can still be convicted totality of circumstances laws are always up for interpretation

For those confused. The cross examination occurs as 1:15:00 - the point is to accurately breakdown the accounts and measure the test the cop conducted and portray that there was a clear bias in his decision on this DUI charge. Relaying it back to the inaccuracy mentioned for these tests and the claims: 1) the defendant never had the "scent of an alcoholic beverage" from thier person but instead the car 2) had indications of tiredness instead of under the influence

What was the verdict? I never get a verdict here and it is frustrating. I imagine it means a conviction. Lawyer's rarely win these cases, even if the cop is a liar.

@@thefishfin-atic7106 not entirely sure if I'm correct in saying this but I think the lawyer's goal is trying to refute probable cause, in which case, would make any evidence collected after the refuted probable cause be inadmissable in court. Again, not entirely sure about that, but I think thats correct.

@@nerys71 BS, in my 25 years driving, aggressive speeding, and 100s of tickets i never been given any tests physical or breath. Never was even asked if I was drinking. Was only asked for how long i been driving that night. So when you are sober and not under influence its easy for anyone to see and no one will ever accuse you in that. Stay sober , and be polite to the cops. you will get away with a lot .

In the Army, we train for 4 years before becoming an Officer. Post that, we qualify on atleast 5-6 courses

If you go to friggen West Point, or you join with a college degree yes you can join as an e4 and start as an officer. (I am not one, I am a civilian, just had a friend who did it)

@@Themusicbiz West Point is not OCS. OCS is a course requirement in West Point. No one has to train for 4 years to be an officer in the Army. There are positions in the Army that require a license or degree in that field ie a Lawyer or a Chaplain which one has to be an officer to have that MOS. These are civilians who have obtained a DCO or Direct Commissioned Officer. BUT still you do not have to train for 4 years to be an officer in the Army! Can you train for 4 years and become an officer, yes. Do you have to, no! And OCS is not 4 years long! I spent 6 years enlisted, in the 82nd.

I'm interested at how many folks feel personally and physically threatened at the notion that police officers could receive more training on multiple levels or that the thought that you can't solve crime by overstuffing our jails and that it costs us more as taxpayers to incarcerate a person than to prevent crime through reinvestments in healthcare, education, transportation, childcare, family planning, utilities etc. In almost every other profession (ex: medicine, law, engineering, vocational work, trade jobs etc), we have a high standard on legal and ethical compliance and years of training let alone thousands of safeguards built into law, institutional policies, and overall culture. How come police officers and members of the legislative branch (if not also other professions folks know about) receive little to no training, safeguards, etc relative to the rigor of other professions? These folks are provided tools with the capacity to kill their own constituents either through the firearm or a legislative bill: how could we stand by and watch them wield such power over us without accountability, standards, safeguards, preventative research, etc that other professions have to be held up to? ^Oh also, divestment from police and reinvestment in community resources like healthcare/education/etc already happens in White Middle Class Suburbs in the US right now in case folks thought anything sounded too socialist or radical. lol

You are very accurate. Which is why many of those departments operate within the bounds civil forfeiture. They will use CF to fund their departments due to the lack of funding in middle to upper class communities.

well hd video takes a lot of storage. and they record for hours. and storage space also costs a lot. so i'm guessing they can't have hd because that would require petabyte of storage. also they might not even need it

Another thing I always wonder, when they ask "do you have any medical problems that would interfere with your ability to take the test?". How do I know? That's not something I ever asked my doctor. It never came up. I've never taken a sobriety test, so how can I possibly know how physically demanding it is? They ask the question before they give the instructions!

I think each juror should be given a field sobriety test in private and video taped. Then Larry could point out each and every single mistake they make. Ask them if they are drunk. If they failed any part of the tests, then threaten them for contempt of court because they are drunk under these tests.

What I was implying was: If every juror did a field sobriety test in private and video taped, I guarantee that Larry could find mistakes they made during the test. Just as a cop does when he gives tests. Then the jurors woul see how easy it is to fail these test and how easy it is to make somebody look like they have been drinking when they haven't. Now, on to issue #2. The probable cause for the STOP is all the police need. Because if I am not mistaken, they can demand or request you do a FST. You can deny and go right to the breath. (again not sure). Sorry now I have forgotten what the stop was for. Let me re-watch the video and continue my thoughts in another response.

@@smithtracing the stop was for speeding. The officer cannot just arrest and do a breath test without good reason. Failing the field test along with admission of drinking and an odor of alcohol was enough to arrest and breath test. Simply doing the field test isn't enough.

After the officer demonstrated the "walk and turn test" I got up to try it myself and I was wobbling all over the place. Then I tried the "one-leg stand" and I could only last for like 8 seconds, and I'm stone-cold sober!

Everyone please keep in mind that in some cases, the defense attorney's job is not to prove the prosecution wrong, it's just to prove that they do not have enough evidence to convict, or that at some point the cop operated illegally, making any findings obtained during/ proceeding the illegal procedure inadmissable. In this case there was really no refuting the breath test, so the goal was to make it appear that the cop did not have probable cause to even arrest the defendant and administer the breath test

Unfortunately its not black and white but there are rulings against evidence obtained illegally, so if they can prove the arrest illegal, then they have a nice foothold to ideally get the charges dismissed or maybe agree to a lesser sentence, because blowing over the limit is pretty damning. All in all not a great situation to be in 😂

@@mmtrauma9141 This is usually the case. Otherwise, the police could just go around and ignore everyone's 4th amendment right against unwarranted search and seizure. As long as they found something illegal it wouldn't matter. But since we are protected against unwarranted searches and seizures, if the police don't have a warrant or probable cause they cannot do a search. A breathalyzer is a search and cannot be done without probably cause or a warrant, if it is completed without one of these things then it is invalid.

I see no "ownage" by defense council here. What I did see was one of his arguments being denied. The officer appeared competent and well trained. The defendant admitted to drinking. What I did not hear was the percentage of alcohol in her blood stream after the test by the machine which is frustrating because that is the most direct evidence in this case.

I just won in court today it went from terroristic threats and intimidation of a witness now it's a disorderly conduct that I paid a lawyer 10 K to hire.I got a staph infection in the prison because I was in the hole during Covid and they had no soap and no toothbrush,no showers,and the made us eat with our hands!.

It surprises me that a breathalyzer alone can convict someone of a DUI. Blood testing would be the TRUE number of what is actually IN your system. The breathalyzer may establish there is need for further testing, but the breath number can be thrown off by several factors. If you took a shot of whiskey for example, the breath number will read higher than if you had had a beer, or a glass of wine. If you spray breath freshener in your mouth, many of those contain alcohol and can throw the actual number off. Or, if the drink was a thick, a syrupy one, like Jaeger for example, more of it could be retained in the mouth and on the tongue and foul the test as well. In other words, to protect the citizen and their rights, an ambulance should show up for every suspected DUI to take blood if and when necessary. "At the scene" because the test should determine the BAC at the time of the incident, not 45 minutes later when more of the consumed alcohol has had an opportunity to work its way into the bloodstream. That's like entrapment or at least, stacking the deck.

That's why they are supposed to breathalyze you a second time at the station. Police stations have stationary breathalyzers that are more accurate. If you blow over the limit once at the scene and again 30 minutes later at a more reliable machine with a different officer that's compelling evidence. Very confusing that that isn't standard operating procedure in that department.

I went through Kentucky DOCJT academy in 2002. I can say that from my experience in law enforcement, and 18-23 week academy for basic training is not enough. KSP requires three years of active duty military, 2 years of previous law enforcement experience, or a college degree. We were certified for alcohol intoxication, radar and speed detection, and firearms.

I was pulled over saying I run through a red light(which I disagree) then tried getting me for driving on a medication that I was allowed to drive on but still tried to get me on a d.w.i charge. Had to do many test in front of another officer that was trained to find clues of medications and didn't find any problems but the arresting officer still tried to push it through as a d.w.i charge. Long story shorter it was dropped before it made it to court because I had my doctor back me and a really good believe it or not public defender😯. This was the night I leaned never open your mouth to answer any questions at ALL

@@davidstella7224 he basically proved him and his evaluation/findings incorrect. I.e in order for the cop to find/declare that the plaintiff was over the legal limit or too drunk to drive, there is a criteria that needs to be followed. She needs to fail a certain amount of tests, which didn’t happen in this case. Which also proves that either the police officer doesn’t really know what he is doing despite the fact that he has been trained OR he completely disregards the law just so that he has a number of DUI arrests to his name.

She blew a .100 and that was after she had been driving for awhile. He was right in what he did, arresting her. It should be a wakeup call for her to get her act together. She probably has a rich daddy or bf who doesn't want to see her spend time in jail or get her license taken away. The DUI Guy didn't bother to show the outcome of the trial. Not sure what the defense attorney did to destroy cops credibility. Not worth watching.

If you ever get a chance, maybe he knows this but it’s good info, I have non-alcoholic hepatosteatosis which in Layman’s terms means fatty liver disease. I am also diabetic and on many medications. Did you know that with those two conditions right there, my body turns natural sugars that are high in people with diabetes in the body to ferment into alcohol. I have never been a drinker. Maybe one glass of wine at Christmas dinner. I have a fear of driving too far because of this. I could never pass any of the sobriety testing. I have had both hips replaced and I have an allergy to the metal components so I am always inflamed. I’ve had my spine fused and extensive scar tissue and contractures along my low spine. I would be totally screwed if this jerk officer pulled me over.

As a Brit, who's police force runs a 2 year training program before a police officer is qualified, I'm absolutely dumbfounded that these officers can be considered fully qualified officers after just 18 weeks. Also, for such a supposedly progressive and modern world country, it's baffling that they are using such antiquated methods for field testing. Pretty much everywhere else in the world uses breathalysers which remove any shadow of doubt before the person is arrested.

The lesson learned is never talk to police... In my state having a license means you consent to sobriety test when requested. Refusing a test means your license is immediately gone. I've gotten pulled over a few times (sober as a judge) and asked to do field sobriety tests I always just ask for a breathalyzer to get back on the road. Am I wrong to do so?

I wasn’t quite finished sorry, my point was when the podium was rolled around the car or am I’ve never seen that before the defense attorney bonded it towards the client and the jury but totally away from the judge you repositioned it to include the view of the judge which I think is much more sensible is there any relation to the fact that Amber kept looking at that Jerry was watching her head swivel on television was so uncomfortable. I know this is a long message but I don’t even know if you go over these past posts to check anything out anyway love you bye

If police are truly trying to reduce the speeding and slow traffic, then stay visible. Hiding with the lights out running radar is not slowing traffic. It takes the unit out of service to write the ticket and even longer to make the arrest. Pulling over a lone vehicle traveling along a highway is not really a risk.

I missed some thing here, the comments don't match the video. I didn't hear any complaints about the patrolman bullying. He seemed very even-tempered to me. The patrolman didn't seem uncomfortable or agitated with the cross examination. The prosecutor was extremely thorough and made no mistakes. Even on re-cross he decimated the defense. The defense didn't even question the 0.10 reading of the breathalyzer. He didn't try to have the breathalyzer results thrown out. He did the best he could but the patrolman nor the prosecutor gave him anything to work with.

well he shouted and was demeaning to the officer, which to me is a negative even. and came up with implicit arguments like "at least she could walk" and "you can't tell if it was the drunkenness or driving while super tired".

I started without any information on the video Simply saw one of. the most ridiculously common typical version of MAN sounding like a freakin salesman talking alf talking without actually saying anything Puffing his chest mansplaining down on everyone else while using extra specific words that weren’t even necessary or helpful simply trying to seem as big manly and smart as possible every chance he got ⭐️⭐️⭐️ Without biological psychological scientific technological mathematical Or any actual knowledge behind his explanations Soo many act this exact same way , sexist assumptions and predatory behavior... This is just one basic man puffing his chest out... the world is freakin full of em The information gathering was just beautifully setup He himself couldn’t stop talking himself... delivering everything against himself 😆 i love it This makes me happy 😉 Not sure how none females experience every single interaction with most MEN....

He can't be, or he would not be risking his life fighting crime for miserable pay, let alone working nights catching reckless driver xP Does he try to sound smarter than he is? maybe. If this is a personal insecurity or what is expected of him, idk. This seems like a common occurrence in the US, from my own experience, but to each their own. What he was saying made sense and he seemed rather reasonable and fair. predatory behaviour? we agree his job is to catch drunk drivers, yes? the woman's breath alcohol was over the legal limit, yes? as to hating cops, have you seen what a drunk driver can do to someone? btw, hating all men (even just strong, less intelligent ones) sounds unhealthy. I think you have some introspection to do ;P

I had my dui case go to trial. Officer claimed on the paperwork that night and in pretrial testimony that I ended my ABCs test with S-I-N-G instead of x-y-(and) z. My lawyer played the tape for the jury during the cops testimony. He clearly enunciates all of the letters including the last four correct? Yes Then why does the report and testimony state differently? (cop thinks for a second) Ow! I meant he was singing the last four letters. We just watched the video did he sing any of the letters? No. So on the form and in pretrial you said he used the letters s-i-n-g but now you are saying he sung the correct letters? Which is it? (Cop looks down dejected) I honestly dont know why I put that on the report. Case closed. Jury said they didnt convict because the officer wasnt credible.

Question.... I bet alot of people get off these little cases and DUIs , simply because most people like me would rather let a person off of a small charge or a .08 charge. And many people don't like cops that much.

Why are police allowed to purchase body cams with an optional button which allows the police turn the camera off, losing critical evidence? I have heard and seen many cases where for one reason or another the police turn "OFF" the body cam, defeating the purpose of the camera. Coincidentally the timing of the police evidence being turned off is often the most critical time for safety and accuracy of violations or lack of from a true representation, not a trained response learned in a quick class on how to make a conviction stick. I assume the classes are designed around defensive attorneys interpretation of the laws.

I used to work in a courthouse up in Canada, and there was this one lawyer that was an expert in DUI. I remember many times where he made cops head spin on the stand. A lot of these guys have very little training.

@@carlfrye1566 What counts is proof beyond a reasonable doubt. If you don’t believe in that standard, you will appreciate other judicial systems like the Chinese one. Where they held two Canadians and convicted them without proof beyond a reasonable doubt for political reasons.

@@brianoneil3532 Hey bud, this is going back to 2008. I don’t remember his name. He worked in the Barrie, Newmarket areas in Ontario. He knew the breathalyzers in and out….and a lot of the cops have no idea how to use them.

I used to work in by the Brooklyn Courthouse and there were lawyers, the Prosecutor's would make very favorable deals, just not to face them. The lawyer for John Gotti was so good, the government would not let him defend him.

I guess: 48hrs jail or 30 days community service, 200 dollars fine. 30 days of licence revocation, 60 months iid. This is if 1st offence. The limit is 0.080, her result was 0.100.

Increase the sound during the bench discussion on partition ratio and you will hear that the legal limit on the breathalyzer was 0.08 at the time and there is no need for the officer to do any calculation or have any knowledge of the chemical principles. Basically, the strategy of the defense is to say that there was no reason from the behavioral test to progress to the breathalyzer. The prosecution went through the details to say that criteria for going to the breathalyzer were met. My guess is that the same as Mete Kayisbudak: probably a conviction of some sort.

Typically they must also have a 4 year degree in something like criminal justice. Small towns maybe not, but city and state cops do have more than just a 18 week program.

Here's your gun and a book titled "How to beat someone where the bruises don't show", now get on out there an make us proud! And I'm pro-military/pro-police. But when you come from a small town, the prerequisite, I shit you not, is working a couple of years at minimum wage at the county jail, counting prisoners. (And attending the academy.) Hell, for the army I was in training for 8 months, they didn't stop after the 8 weeks of basic training, THAT'S why it's called BASIC training. Most police only have a basic understanding of criminal justice, no degree. I hate myself for investing this much time in a youtube comment... And Norway is great, but I wouldn't want to live there; I was born as a red blooded American.

I think one of the things that bothers me is that as they are arresting someone, they extort or try to extort compliance. "If you refuse to give up your rights, we'll go extra hard on you and you'll get longer jail time, higher fines, definite loss of license, and on and on." And when they want to pat someone down, " Do you have any weapons or anything that can hurt me?" How about asking the cop the same question. I don't want you touching me because you have a gun, a taser, a billy club, handcuffs that can hurt when they make so tight, but I guess that's okay??? Where is the injured witness affidavit? These cops are unreal. It's all about the money. Or mostly about the money.
