Our client Terry got arrested in South Florida for DUI after blowing 2.5 times the legal limit on the Florida Breathalyzer Test. He did not feel impaired during the incident and felt as if his initial lawyer was doing a poor job representing him. He decided to look elsewhere for legal representation.
Terry found the Rossen Law Firm and saw our record and experience dealing with Driving Under the Influence cases in South Florida. We took him on and immediately developed a strategy of attack.
The investigation done against Terry had major holes in it. We found out that the police officer who pulled Terry over did not have a legal basis to do so. First, the police officer alleged that Terry did an illegal maneuver while making a turn. We showed that Terry's turn was not illegal according to Florida Traffic Law. Next, the officer alleged that Terry's window tints were illegally tinted. We hired an expert to evaluate Terry's tints and prove that they are within the legal limit.
These findings showed the errors that the police officer made during his investigation of our client, Terry. Also, the investigation was conducted in Margate, Florida, where law enforcement does not wear body cameras. This made it hard for the police officer to prove his allegations against our client.
As a result, we were able to win Terry's case and prevent him from being charged with a DUI and having that on his record. We had his charge reduced to reckless driving and made sure Terry got to keep his license and and his employment.

How did the argument on the probable cause turn out? If they charged him incorrectly, the original PC would be dismissed and create a fruits of the poisonous tree situation unless there was a window tint violation that could be proven. I am guessing that this town with no dash cams or body cams has tint meters? That figures. if so, was the reading at or below the legal tint requirement for Florida? since the defendant had already had them tested prior? We didn't have tint meters where I worked so I have no experience with them and therefore I have never charged someone with a tint violation in 22 years. lol. I was (i am retired) police officer, and taught at the police academy the ADAP program (Alcohol Detection Apprehension and Prosecution) as well as field sobriety testing and certifying recruits on the breathalyzer. I also have some formal legal training beyond the police academy including a LOT of in-service training, I have a Bachelor's in Criminal Justice and I did go to law school for a while, but I was also working full time on night shift and frequently had court in the morning after shift and I got burned out after a while. I think I got out of law school what I wanted though. I was more interested in learning about law that pertains to my job than learning all aspects of law. But I did learn very valuable things during my time and I was better at my job for doing it. But in closing i'll say this. I am a law nerd. I watch court trials for fun on youtube. LOL. And I have nothing against defense attorneys as you guys serve a constitutionally guaranteed service to the people of this country and people don't always like you for it, but I am not one of those people. In fact, I have 3 good friends I met in law school that I have to this day. All 3 are defense attorney's now. We all give each other a hard time about our respective aspects in the criminal justice system, but it is all in good fun. We all have a healthy respect for what we do and for the law. The law is fascinating, complex and ever growing and changing and I enjoy watching good legal arguments take place in real world scenario's no matter who wins. I never took things personally, I considered myself to be very fair and had great patience with people. Sometimes I even told people it's best that they stop talking for their own good, especially in a few particular incidents we had which were self defense involved shootings. I told them quietly to NOT talk to the police until he has an attorney and I was the the duty Sergeant. No one can accuse me of not respecting peoples rights or not being well versed in them. We both have(or had in my case) tough jobs and I have nothing but respect for those who make it all the way through law school and pass the bar while working at the same time. :)

in texas about 12000 with a less than 5% chance of not guilty. these cases are usually given to baby prosecutors and in general dwi defense attorneys not too good, its a crap shoot with the juries siding with the police officers

Hello Ramon, in this client's case there was no pre-trial diversion program. Currently Broward County, Florida does not have a pre-trial diversion program for DUI offenses. We were able to beat this case by filing a motion to suppress evidence collected by law enforcement.
