Her attorney is trying to claim spousal privilege but the DVPO is already public. The Defendant doesn’t want her evidence nor do the attorneys as it is the nail in the coffin that her husband is violent and a threat (along with all the harassment he has done to us). In this case, since her file is public, can she avoid the subpoena by using spousal privilege in a 50-C? North Carolina FYI Thank you for any assistance ❤

I am a recipient of a TRO, and I am doing everything to not only be freed from the TRO, but to restore my name. I have no priors of any kind, never have been convicted of assault of any kind, and I separated from the Military with honors. If the 'applicant' desides to re-write my orders based on the Judge's decision, can I sue for deformation?? I have also enrolled into counseling, and scheduled classes for DV (Domestic Violence) classes voluntarily.

A women who tried manipulating management and police authority to get me evicted has been evicted from the apartment area I live in. She stalked me, found my new location, tried hitting me with her car, and she's not allowed in the complex. I'm filling a protection status and then I'm going to sue her.

Does text messages of prior verbal abuse count as relevant evidence? She told the police I was threatening her but has no proof. She was threatening me but I have no current proof. I do have many older texts from her saying similar things to the threats she made to me.

The judge did not give me a hearing at the hearing date. The attorney and the judge wanted to go straight to trial without even having a hearing about any of the situation. What can i do? Because at this point they set a trial hearing until January.

Basically, yes. But she has to be reasonably in fear, meaning she has to lay out a factual basis for her fear. And if there’s evidence she’s lying, you can contest it and probably win.

When you defeat the dvro the " surviver" will just file the same claim in a seprate action. Like a mulligan in gulf , they will probability misrepresent the facts of the other case and as you probably guessed its all your fault

I think you should start taking domestic violence and parenting classes now. Possibly therapy too. Bring proof of this with you to your hearing. Just because she has evidence doesn’t mean she will automatically win, though. If you’re going to represent yourself, I highly recommend that you at least take the free class that I offer at defeatthedvro.com. I practice criminal and restraining order defense, and I’ve won plenty of cases where there was significant evidence against my client. You just have to know what to say.

No, but you want to keep it organized and easy for the judge to follow. I usually have headlines with points/arguments I want to make and, underneath them, the questions that I want to ask regarding that point.

If someone cheats is absolutely relevant if it shows why they are trying to hurt you. If they cheat and regret it and it shows cause to hurt you and kick you out, absolutely its relevant and the main cause, its a 2 way street. Same with who broke up with who. If they leave you and want you out and your on the lease, is rhat relevant?

I took out a preliminary protective order against a neighbor down the street who also has a warrant out on her for stalking. Over the past week, she has posted our name and address on her Instagram account, and called us racial names. Would this allowed to show the judge there is a pattern of domestic abuse? She has had many PPOs against her from alot of my neighbors, so wouldn't it be relevant to bring that up to show a pattern? I have a screenshot of when she egged a neighbor's truck and drilled holes in their fence. Is this relevant to the case?

Even a local news station did a story on her a year ago because of how she terrorizes neighbors. The station had to take out a PPO on her and the judge granted it, because she showed up at the station banging on the windows. You think I can submit this to the civil clerk as evidence?

1. The original OP expired, but the judge granted her exclusive possession of the home during the divorce proceedings. 2. Approx. 3 months after that hearing, I went to the top of the street, saw a stranger's car in our driveway, went to look at it, went up the first 3 of 5 steps to our front door, and saw my daughter was home from college. I deduced that my daughter was given a brand new car. So I left. 3. Unbeknownst to me, my wife has installed a Blink camera and they saw me breach the curtilage. 4. She filed for another OP now, claiming I am stalking them. Will the judge rule in her favor?

Hi my ex girlfriend recently got a tro on me and the PFA hearing is in July. She claimed I assaulted her in March which is not true and I called the police that day she did not. Police interviewed us both and nobody was arrested or charged. After that we actually got back together weeks later. I have tons of texts after that point and up to a a point of like a month before she filed for the pfa. Lots of texts proving we were meeting up, texts of her saying she loves me, she definitely has feelings for me, she misses me, when I am coming back, etc etc etc. We were together many times after March in April and May. Went out on dates and stayed at her house and she stayed with me at hotels and my home. Is this relevant the text messages? I would certainly think so. You don't come back to someone several times that you claimed assaulted you and you need protection from.
