Congratulations Alfred for your I-140 approval !!!. I'm using Colombo&Hurd law firm too and my I-140 form was received by USCIS last November 23rd. Now, waiting for the USCIS response, in my case we prepared all my case from Argentina, so after the I-140 approval, I'm going to enter the consular process. I'm STEM Project Manager with 16 years of experience, my endeavor was about promoting the Solar Energy with PV systems in underserved areas, e.g. Florida state. This gives hope. Yesterday we were rejected by a law firm despite my partner and i have masters degree and several years of experience and certifications. I do not know how high the bar is but they said we qualify for Employer sponsored visa, which of course we don’t want…. They didn’t even ask for our future endeavor, which i thought should have more weight?? i think law firms get turned off when they see someone doesn’t appear on Tv or has many publications

Hi Aneek, a lot of stuff in your question. The short answer is yes, you can do that and there is a 90 day rule before you submit the I-140..you can google it and read more about it. Regarding the permit, you can only request it once you submit your adjustment of status and it takes time (variable) to receive it. My 2 cents: consult a lawyer if you are going to attempt something as complicated and risky as this.

Hi Oscar, I've mailed my I140 NIW but found the dates of one of the old work experience was off by 2 months on the employment letter versus on my resume. Is it a big problem? That experience was 8 years ago and unrelated to the NIW petition field.

Probably not a problem as it may not even be detected at all. At most, if the officer realizes (unlikely) they will ask about it in an RFE and you'd have to clarify it

You are right about teaching though, it's really hard to get an approval, but if your endeavor goes beyond your classroom/school and especially if it has to do with STEM , then you may convince them

@@hjgovi in the video he does hint thtat his endeavor is something like: promoting STEM education with a specific group, underepresented populations like Latinos. So it is clear he did state he intends to work in education. The teaching job by itself is not enough to qualify but if your endeavor is framed around STEM and goes beyond the classroom and school where you are, it may rise to the level of "broader impacts"

Hi Evangeline, Alfred says in the video that he was on an H visa when he applied for a green card. He was on J visa before that. If you are on a J visa subject to the 2-year rule, you must obtain a waiver before applying for the green card, or otherwise spend 2 years in your home country before applying.
