I think steven said in the piratesoftware interview you can turn AOE's to not hit none flagged targets on but it's bugged at the moment.

I think a third flag would be a good idea, but I think it should also come with penalties where if you intend to harass green players or push them out of a spot you should be ready to lose all your materials if you die from provoking them.
