On December 22, 2017 East Cleveland Police Officer Joseph Marche was arrested for OVI in the City of Bratenahl, Ohio. Joseph Marche was appointed to the City of East Cleveland Police Department from 1998 to 2005. He left the city and his OPOTA certification ended with the city 9/16/2005. According to public records Mr. Marche worked with Blackwater USA from 2005 to 2015 as a security specialist. Mr. Marche returned to the city of East Cleveland, according to OPOTA files, August 2009 to the present, Mr. Marche is employed as a full time police officer. According to Ohio Administrative Code 109 when there is more than one year break in service, peace officers are REQUIRED to take a Refresher Course and until the course is completed and a letter provided by the Executive Director grants permission, the peace officer reverts to cease and desist function. Peace Officers are not allowed to engage in law enforcement and carry firearms. Mr. Marche's records with the Ohio Peace Officer Training Department reflects he has never taken the MANDATED Refresher course and has been in cease function since 2007. The video clearly reflects Mr. Marche not only intoxicated but having his service weapon and other firearms on his person and in the vehicle along with empty prescription pill bottles. The vehicle is a City of East Cleveland police car which suffered extensive damage to windows having to be broken out to retrieve the officer safely. D
East Cleveland Police Commander Scott Gardner confirmed Marche was convicted of operating a vehicle while intoxicated in Bratenahl court, and was given a 30 day suspension without pay.
Gardner said Marche was on prescription medication for two shoulder surgeries, and drank a limited amount of alcohol, misjudging the effect the combination would have on his faculties.
Gardner confirmed Det. Marche's drivers license was suspended, but he was granted work driving privileges.
Gardner said Marche has an an outstanding work record and had no prior convictions.
Gardner said the department consulted with four other police departments to insure a 30-day suspension was adequate.
"There is nobody that's going to condone the behavior of Detective Marche," Gardner said.
"Our department wants full transparency, and we welcome residents to give us feedback."
"He accepted full responsibility, it was an error in judgment, and like I said, nobody feels worse that Joe Marche."
Possession of a Firearm While Intoxicated
In many states, there are several misdemeanor firearm offenses an individual can commit
Under the law, an individual may be charged and convicted of a class A misdemeanor simply for having a firearm in their possession while or after drinking. The statute does not require the individual be actually using the firearm. Nor does it require the person to be legally drunk of have a blood alcohol content or BAC over 0.08.
NOTE: A machine gun, as defined in the NFA, is "Any weapon which shoots, is designed to shoot, or can be readily restored to shoot, automatically more than one shot without manual reloading, by a single function of the trigger." A machine gun refers to all firearms capable of full automatic fire and includes true machine guns, sub-machine guns, and machine pistols. The frame or receiver of a machine gun, and any combination of parts intended to make a machine gun, is legally defined as a machine gun. For example, according to the ATF, "A Glock conversion switch is a part designed and intended for use in converting a semi-automatic Glock pistol into a machine gun; therefore, it is a "machine gun" as defined in 26 U.S.C. 5845(b)." I see it this way, as a professional you’re held up to higher standards of operation than the normal citizen. Being a professional shouldn’t garner you extra liberties over the regular civilian. A great example is a Truck Driver having his CDL (Commercial License), he operates as a professional on the highways and is held to a higher standard by the law because of his profession and training that certifies him as an individual which will obey all highway laws and standards as regular 2 and 4 wheel vehicles. A truck driver is not given any leniency because he chose that profession, he’s held more accountable on account of it. This is the exact same type of situation, these law enforcement officers are supposed to uphold the laws that they’re enforcing upon the public, not given extra liberties because of their profession...it’s absolute hypocrisy and makes the public incapable of respecting those that point the finger yet not capable of accepting responsibility for their own actions.

Wawawsforlife 9 ... If he’s having trouble with stress, he needs to go to counseling or maybe even retire. I understand he has a hard job, but getting drunk and putting lives in danger is not the solution. This is intensely personal to me, as I was the victim of a drunken driver years ago (I nearly died and I lost my fiancé in that wreck), so I have a hard time watching someone who has taken an oath to protect and serve, putting innocent lives in danger, then feeling as though he is above the law and should not pay the consequences. I realize he does not represent the majority of law enforcement, but after all I have been through at the hands of a drunken driver, I am entitled to my feelings in this matter.

wow. Any citizen telling cops that “one day when you come to my side of the city” would have had charges against him for threats against a police officer. NO citizen passed out in his car like that would have gotten off with just 30 day suspension because he had “excellent work record”. Normal citizen’s work records doesn’t impact citizens. Elijah Walker he decided to uphold the law. You can’t uphold laws you don’t follow yourself. By your standards, medical doctors, nurses, pramedics, firemen, army vets should all be able to do what they want based on their carreers saving lives. Toby Hill You have no way of knowing weather I've ever experienced it or if I have seen it. I never said "Cops thinking they're above the law doesn't exist" as you said. I simply challenged the comment that Joe Miracle wrote as it pertained to the "Typical" cop thinking they're above the law. By using the word "Typical" he is suggesting that the majority of cops think that way. I believe that to be a statistical impossibility. So I'll ask again.......What can be pointed to to support the notion that the majority or a "Typical" cop thinks that? I don't love nor do I hate cops. I've been arrested, I've recieved traffic tickets, I've had my driver's license suspended etc etc. I just think that Joe's comment is nonsensical. As is yours.....In my opinion of course.

Even this example of a cop being held accountable shows they CAN"T police themselves. Police anti-corruption should be run by civilian review panels and investigators. And that's precisely why no person should be permitted to serve in a law-enforcement capacity, certainly not at the "street" level for that many years. And spare me the lecture about how the public and the "system" benefits from the wisdom and experience that these veterans of the "force" bring to bear. Members of Special Units such as SWAT etc. can be granted a couple of more years otherwise 2-3 years AND YOU ARE DONE. Go find another line of work.

Justin Bloodworth Yeah but it IS actually different for a SWAT guy to have that weapon than it is for you, if you’re not employed by a place that gives it to you legally. You can’t really say that you’d do twenty years for it, because that’s “not even wrong”, it’s just not a good comparison. Essentially you’d be comparing DUI, which is what a normal person in that scenario would get (we wouldn’t have a sub machine gun).

@Anton Zuykov They also bust into people's houses and shoot everything up, including the family dog. Since SWAT was first instituted, the number of no-knock raids, even on the wrong house, has grown exponentially. Their mandate has gone way beyond what is reasonable. The US is a police state.

@@canadianroot judges sign the warrants based on evidence and permit no-knock raids based off of that evidence. The cops don't just raid places without warrants. SWAT gets the warrant and information then conduct's the raid. They aren't the detectives gathering evidence, or the judicial body signing the warrant. Typically they only know what they are told.

What's worse is that he is still employed. How messed up is that. You can imagine that this guy has probably done plenty of corrupt things to innocent people. How sad is this? I feel really bad for Americans even though I'm Russian and a lot of ignorant folk from the states are quick to tell me how terrible and corrupt Russia is which may be the case ( however it's much better these days than it was 20 years ago) but Russia doesn't claim to be perfect whereas the U.S claims that they are always right and so free when this is far from the case. Constant wars, the Opiate crisis, ridiculous healthcare, the amount of homeless people, corruption in so many states and government. The rich/poor divide. It will take a long time to fix all these problems but I truly wish the best for the average American citizen and I really hope that one day the world can live peacefully together without any silly propaganda trying to convince people that someone is out to get the U.S

Anyone else think it's crazy that the arresting officers are all trying to downplay the magnitude of this dude's actions? Like they feel sorry for having to arrest someone packing an SMG who was so drunk he couldn't even put his car in drive to evade the scene. Is this how police departments operate in Ohio? All cops as well as everyone that has lived will one day stand judgement to our Heavenly Father of how they lived there life true repentance is the key to forgiveness.

I got a dui when I was 18. Nobody was hurt or anything crazy like that. They revoked my license for 3 1/2 years and then I had to have an ignition interlock device for 6 months. I’m now 21 and I’ll be getting my interlock device removed soon. That Dui put me down 7k and I got to see what jail was like also. I had to take a 40 something hour class and if I didn’t by a set time I would spend 9 months in jail. Having a revoked license for that long as an early adult in my opinion was cruel. However their scare tactics worked. I’m now very scared to do anything illegal or anything that may be illegal. I’m very very stressed out while driving as well. And this guy was 10x more intoxicated than I was.

I have always wholeheartedly backed the blue, but THIS INFURIATES ME!!!! This cop was given special treatment despite resisting arrest, trying to leave while highly intoxicated, made threats to the officer talking to him ("come across the bridge") and refused testing. Yet, he was released to his "teammates" and caudle. These officers should be held to a higher standard when it comes to breaking the law but they aren't held accountable. This cop got a 30 day suspension and returned to work. No jail time and was reinstated without penalties of breaking the law and putting lives in danger. This same cop, who is now a COMMANDER, was videoed kicking a man onto his face in February of 2021 or 2022 who he believed was "intoxicated or mentally ill." How would he have felt 8f he was kicked onto his face for being intoxicated? This is complete and total BS!!!! He clearly expected special treatment and he got it. This is the type of crap that makes people lose complete faith in police officers. This is a disgrace! This man, Joseph Marche should not be allowed to be a law enforcement officer.

If this was a citizen with a license to carry a concealed firearm and was arrested for a felony, they would be looking at a mandatory 10 year sentence. Cops and law enforcement officers, should, at the very least, be held to the same standard as non-Leo’s. Honestly, I believe they should be held to a higher standard. It’s bs like this that is why LEO’s have such a bad image. Not until they’re accountable to the law instead of above the law will this change.

What are you guys talking about? He is being arrested isn't he? He is a cop, and doesn't need a lecture about public safety. He knows the impact that DWI will have on his job, and so do the officers that are processing him. Unlike most civilians, it is possible that he will lose his job.

Literally stands up disobeying commands saying "no" and flashes his gun while completely wasted. And just recently resisted being arrested... yes they cuffed him, asked if he had any weapons, he answered no, they called out the gun and removed it and then a knife. I believe answering no when you do have a weapon is a charge, at the very least interfering with police investigation like anyone else would get but i think there's a specific and more severe charge, nonetheless only charged with ovi...

If a non-cop refuses to take the test, they loose their license and get charged with a DUI. I was on a jury where a smart ass thought he could refuse the test and fight it in court. He lost. He had to sign the same type of form they were asking this guy to sign which explained what would happen if he refused. Why would there be any other standard for a cop? Why would a sober person refuse a test? My guess is that there is probably a lot more than alcohol in that blood.

Lots of information in this video. 1. Swat car plates don’t show up in the computer at all. ( not even registered to a department. “Ghost” vehicle. ) 2. The patrolman definitely whistles at his commanding officer and must motion or give a look indicating to stop taking about the details that would be captured on the body cam. 3. The swat officer being arrested refuses the breathalyzer, and tells the arresting officer “ you know how it is.” Indicating that if he refuses the test, they have no quantifiable proof of how intoxicated he actually was. We all know that the law that automatically suspends your license for refusal is a way to coerce a BAC test. I just found it interesting that a cop verified that fact. They should have thrown the book at this guy-ovi, attempting to flee, carrying a firearm under disability, I’m sure they (for a non-police officer) would also have swabbed the prescription bottle and collected pill dust/ residue and called it a possession of controlled substance even though all the pills were already gone. They did arrest him, and said they charged him with ovi, but the laundry list of other charges that were swept under the rug is staggering. Also funny that the guy getting arrested says “fuckin’ Bratenahl.” Everybody from Cleveland area knows Bratenahl cops are every 10 feet. Any time I would drive into the city, you see at least one car pulled over in Bratenahl’s 2 minute stretch of freeway, and they usually are searching the car. They also pull people over for going like 3 over the speed limit. This dude picked the wrong town to take a wasted nap in the car. Haha.

Ummm he wasn’t abusing, he had two shoulder surgeries and those were required. He mistake was drinking alcohol with it, which either it infused or he drank to much and it got him intoxicated. He also wasn’t disabled, and that is his service MP7. So he technically is allowed, although he wasn’t because he didn’t take a refresher course. Those are prescription which is what he is allowed to carry because he is required to take them. There are flaws in your argument and maybe mine. But please read the video description and the entire story that explains the event that took place.

I have ZERO sympathy for that dickhead. A SWAT member of all people should know damn well better then to be passed-out drunk in a car late at night. Funny, I thought they were supposed to *protect* the public. And besides, we should know by know that there are better ways of dealing with the shit we see on the job. At the very least, he should have been put on administrative work while undergoing alcohol & addiction counseling.
