Today's installment is an exclusive, otherwise-unreported story covering the drunk driving arrest of a Lower Township, New Jersey police lieutenant on April 27, 2018.
On that date at approximately 6:28 pm, Lower Township police communications received a call from a concerned citizen regarding a black Chevrolet truck driving erratically on Breakwater Road toward Route 9. The citizen described the vehicle as being operated at a high rate of speed and in a manner unsafe to other vehicles on the road - reporting that the driver had already ran a light and nearly crashed multiple times. Two officers were assigned to the call and responded, quickly locating the vehicle and noting that “the driver was not able to maintain the[ir] lane of travel,” and that “the vehicle cross[ed] over the center line as well as the fog line numerous times" while it was under their observation.
In the area of Route 9 and Honeysuckle road, the lead officer attempted to stop the truck, but its driver turned onto Honeysuckle and continued for another quarter mile before coming to a stop. At that point the driver of the vehicle was identified as Lower Township Police Lieutenant John A. Chew. The responding officers contacted their command staff per department protocol, and after some attempts at field sobriety tests, Chew was placed under arrest for driving under the influence.
Back at the station the on-duty administrator - also a lieutenant - observed Chew's breath alcohol testing. His report memorialized the following events: “I then read the defendant his Miranda warnings from a card in the processing area. As I completed each sentence of the form I asked if he understood. After each question, he raised his right hand and extended the middle finger in my direction. Upon asking the last question if he wished to answer questions he again extended his middle finger in my direction. I advised I would consider that a NO.”
Chew’s attorney hired expert witness Kevin Flanagan to review the entire arrest. Flanagan, now retired from law enforcement, spent 16 years working in and eventually leading the Alcohol Testing Unit of the New Jersey State Police. Flanagan authored a highly detailed 12 page report covering every possible deficiency in the case against Chew. Nevertheless, on September 13, 2018 John Chew pleaded guilty to driving under the influence. His driver’s license was revoked for seven months followed by six months with an ignition interlock, and he was required to spend a minimum of six hours a day for two consecutive days in an Intoxicated Driver Resource Center or IDRC. IDRCs provide a 12-hour education class conveying information about New Jersey's alcohol and drug laws and the effect of alcohol and drugs on the body and driving ability. They also conduct screenings for referrals to assessments and/or self-help groups for treatment of substance abuse issues. Chew was also assessed $689 in fines. That battery of punishments is standard for a first DUI in New Jersey.
John Chew is no longer employed by Lower Township Police Department. As of the time of this story’s publication Lower Township Police had not responded to questions and a request for comment.

I think this video acts as proof that police officers being forced to have audio and video recording IS helpful for public safety.

A few here: In Mesa, Arizona, for example, use-of-force complaints decreased by 75% for officers using cameras in a pilot program.1 In Nampa, Idaho, they dropped by 24%. In San Diego, from a 2015 report based on preliminary statistics showed that body cameras helped reduce “personal body” force by officers by 46.5% In Rialto, California-after the police force had worn body cameras for a full year, citizen complaints against police declined by 60%. The number of incidents that resulted in the use of force by an officer, dropped by 88% after the use of body cameras. Officers who were not equipped with cameras were twice as likely to use force as officers who were.

@@debra6636 You don't understand, there is no one whose job it is to watch every second of body camera footage. There has to be a report for the footage to be looked at, if not the footage is deleted after 90 days typically. But yes, no denying the body camera provides critical evidence.

@John Isho I just don't understand how people can't understand it. It's a coworker and a superior. On top of that, there is a difference between some trashy person getting a DUI and an officer, the "moral gap" is much wider for the latter, seeing as his reputation and career is gone. A factory worker with a DUI can still get a job, but this guy's life is over. I generally have a strong distaste for cops, but to not empathize with the arresting officer just seems unintelligent.

The scariest thing that I ever heard in this video was that drunk cops first coherent statement that he made was to ask who called on him. Maybe even scarier was that arresting officer confirmed that he could get it.

@@suzettemyers6058 not all cops are bad, they’re human and they make mistakes. But they are a nation wide, government sanctioned gang. Someone breaks into your house what do the cops do? Someone attacks you on the street can the cops get there in time to help you? Your best defense is yourself. Cops are necessary in society but do we need a DEA, ATF or for local police to have tanks? I would say no. It’s just my opinion. And in 31 years of existence I’ve never needed the police, and I doubt I will anytime soon.

@@khl619 yeah, they still do. My ex-friend wrecked and cop said we were both drunk and to all a ride. Once we were pulled by a state trooper, he pulled him to the back. Buddy comes back to car and said"officer told us to go the fuck home. Now." It just depends on who pulls you over. I was arrested because I thought I fully paid a ticket, it was a court fee and I was acting as designated driver...was in for 13hrs.

When the officer says to his superior "we've got it on camera" is a good example of why body cams should always be recording without the officer being able to control it.

Then you would have an untold number of hours of meaningless bodycam recoding requiring more storage which costs more. So you would be willing to pay higher taxes for the police department to buy more storage capacity to store all the meaningless recording of body cams when a small percentage of all the hours of the recording is done is all that is required.

No, right from the get-go the more professional officer was telling the other guy they had to keep their body cams live. He was saying that even before he called his superior and got told that. He has integrity, I'm not so sure the bearded cop does. The bearded cop clearly wanted to ride off and pretend this wasn't happening.

Disgusting department, the fact that you would have let him continue if you didnt have cameras is just pathetic. IA needs to be investigating this type of stuff for real. Hope he lost his job or at least his title. Also, what I don't understand is how this isnt a conflict of interest since he works with them. They should have called another department, sheriffs, state police anyone else to make it fair.

@@abesoloman6932 not true.... Alcoholics learn to adapt to the alcohol level in their blood over time but their decision making and judgement is impaired. .40 is considered a deadly level of alcohol and I have seen many people "function" at this level and then drop dead at the hospital.

As I understand, the man lost his job but I highly doubt that anyone told him the name of who reported him, which makes me suspect that my theory is the more likely one : ) That it's tactical rather than actual. I am 99.9% they were just placating him in order to get his cooperation due to the man's state and position; there are a lot of police interrogation tactics revolving around ego to gain cooperation (see terms like "ego up"). Not saying that it's the most professional behaviour here but it is a path of least resistance, and frankly I do get it. I am sure that these police officers could lose their jobs as providing such 3rd party information to a defendant is not only unethical but illegal. But of course they could get access to the info of who reported it as that's part of the case though I'm sure the ease of that process depends on how it was reported (or through what channels and whether direct or indirect). Trust but verify ;)

What a tough situation. Unfortunately, the LT made this decision and Drunk Driving should never be tolerated. But, this broke my heart when he said no, I'm not getting handcuffed. Yep that is so true I had a souped up 90 civic ex sedan a off duty cop hit while parked drinking and driving the on duty police officer said he didnt breathalyzer him because he had allergies and couldnt smell the booze on him it was a fucked up and sad situation then the on duty cop gave the drunk off duty cop a ride home because his was totalled leaking g fluids everywhere when it was running they parked his car down the street were later on the off duty cop was seen collecting his bottle of whiskey and remnants of a case of beer my neighbor called the police to report this and still nothing was done police show each other preferential treatment it makes me sick I hate cops and do not have respect for them they can all eat shit and die for all I care also I was molested by my uncle when he was 17 years of age and the man is a cop today even though a police report was filed and police were called since he was a minor nothing happened he sodomized and molested me my sister and 3 cousins they treated this drunk cop with copious amounts of compassion a civilian would never receive and to be honest they should be held to higher standards than a civilian

The description clearly states the Lt. pleaded guilty to drunk driving and had his license revoked for 7 months along with having to take an alcohol course and he no longer works for the department. I've seen multiple comments now of people saying he wasn't charged just to make it seem like the cops are above the law. 😀

And you dont realize that is the problem, but you said it yourself common sense isn't common. Cops can treat people with respect and dignity. But they see themselves supervisor to the "civilian", most of the time cops go into a situation, and there first priority is to establish authority. That's the problem. They can start off with respect and curiosity, till the situation says they have too be aggressive.

@@bagelars the only obvious point that you are making, is that you are real close to law enforcement, you are probably a cop yourself or was raised close to police officers. Which means that your opinion will always be bias. to the majority of the rest of people who are not privileged to live in a cops home. We see the crime cops make at face value. The tyranny, the abuse of power the murders they committed far too often, you say cops dont pull people over for no reason, you are just to blind to see that is not ture, if that was ture they would not have quotas, they are under constant pressure to meet their quotas. That is fact. Now I will admit not all cops are corrupt and some do the job they are paid well for. However far to many are just evil individuals looking for excuses to hurt people. To tell the story's to there Contemporaries later. I think (IMO) out of 100 percent of cops 35 percent (or so) are the men and women that I am talking about.(the bad cop) And my guess is you would think 90 to 99 percent of police officers are honest and moral, so I will leave you to your opinion I disagree will u strongly, but respect you for your opinion.

There's a discussion because he's a superior in their department. Some places would require a different department to come do the investigation or someone higher up in the chain of command. Theirs a discussion because he's probably a good friend of both of them and I don't know anyone who wouldn't want to be more lenient with someone they know. If they let him go, that's a problem, but they didnt and didn't try to. They both seemed unhappy they were the ones doing it, and again idk anyone who wouldn't be, but they both did their jobs. If this was a different industry, no one would care they were more lenient, they would just say he works there makes sense.

Armbruster (the cop doing most of the talking) knew what NEEDED to happen from the start, but it's almost as if he's hoping his superiors (at the other end of the radio and the cell phone) would come to the scene and take over, alleviating him of the responsibility of arresting the DRUNK DRIVER. There should never have been a moment's hesitation. The citizen's phone call and the in car video were all Armbruster needed to say, "Put your hands behind your back."
