Great information. I didn't realize GC through EB2/EB3 had become so hopeless. Here are some options. 1. EB1 - Extraordinary achievements. PhD, Published papers, Doctors. I know people who did this. 2. EB5 - Invest 800k in a business. I know people who did this approach. 3. Go to Canada and get Canadian citizenship. Then come to US as a Canadian citizen. I know people who did this. 4. Go to Europe. Many countries in Europe are now welcoming professionals. 5. Come to US on H1 and have kids here (who will get citizenship). Consider US more like Dubai and go back to India after retirement. If you really need it, after they grow up to be adults they can apply for your citizenship. 6. If you can get a good job, stay in India. Compared to 30 years go, I feel that lifestyle in India is better than it is in the US.

Mr. Sandeep, on your point 3, if it was that easy everyone would go to Canada and become Canadian resident and then citizen to come back to USA for Green Card. It doesn’t work that way. The Green Card application goes by country of birth not by citizenship. Canadian citizen who is born in India will fall under India’s GC Pool. Yes, they will be able to get work permit but not GC.

I am a Canadian citizen now. Moved to Canada few years back after studying on F1 and working as a H1B in the US. The only options I have to get a GC in USA is through family sponsorship as a sibling of a US citizen. As my country of birth is India, my family sponsored GC process will take the same time as applied through H1B process. The second option to get GC is by getting a H1B and then applying for GC. As a Canadian citizen I can work for almost indefinite period (3 year renewals with job offer letters) through TN1 visa which is a single intent visa meaning I can’t apply for GC/immigration through it unlike H1B which is a dual intent visa.

EB1 A/B for research scientists with about 10-20 international peer reviewed research papers and about 300-1000 citations. Biomedical scientists with Indian PhD can get it. Post doc experience with publications and citations can get green card for Indians. Other than software professionals Medical doctors ( physicians) and post doc scientists are considered in extra ordinary EB1 category GC applications. It’s a good route for hard working bio med professionals!

Good information, but one thing, tax is same to each and every individual based on your income. The taxes vary state to state. No discriminations in tax calculation if you are an Indian or an American or person from any other country. Same tax rules applies. Similarly house taxes, it is same for every person who lives in America. If you pay two percent tax on a property as an Indian in New York and the same 2% tax will be paid by American who have property in New York.

To clear this backlog mess, simple, make H1B not tied with employer and allow candidate to apply him/her self. only GC has 7% quota, not for EAD. If a group realize that they cant make money through H1B processings, then they dont backstab H1B ppl. If get EAD 95% of the above said problems discussed in this series will get resolved. USCIS can do this overnight, but they wont cuz few groups are breadwinners due to this backlog.
