Article 21 - individual's right to life and personal liberty . 1:27:55 parliamentary legislation in the state field - 1 when rajya sabha passes a resolution. 2 during national emergency. 3 when States make a request. 4 to implement international agreements. 5 during president's rule. 1:30:50 there are 29 states in India in 1950 with classification of part A, part B, part C, part D . 1:37:27 in 1992 state emergency was imposed in madhya pradesh, Rajasthan, Himachal Pradesh. 1:39:34 currently in Manipur emergency was imposed. 2:03:08 alladi Krishnaswamy ayyer was the chairman of the credential committee.

Internal disturbance is mentioned in the original text of the constitution itself, 38th CAA made the change saying that "even if there is a emergency already in place, another national emergency can be promulgated on different grounds" so, emergency 1 is taking place from 1971-1977 Indira Gandhi after passing the amendment announced second emergency on grounds of internal rebellion (1975-1977) Later 44th CAA changed this to "Armed Rebellion" as the term "Internal Rebellion" is too vague

Sir I have a doubt See, according to 42nd C.A.A. National Emergency can be declared in any state. Right ? And President's Rule is also declaring emergency in any State. Are they same?? If yes why mentioned in different articles? If not , then how do these two differ? Sir please reply I'm really very confused 😣😣

National emergency refers to condition for the whole nation...but to impose 352 on whole nation at once it would be better to impose on a portion, like any state which has threat like naxals in bastar range or infiltration in Kashmir etc, yet 356 refers to failur of state machinery that's to say, SLA can't discharge it's duties and constitutional head of state imposes 356 for proper functioning of legislation. It's not threat like condition

Is article 359(suspension of other FR's Except Article 20&21) also include suspensions of FR's guaranteed under Art19 As Art359 can be applied to both external and internal emergency? If yes then what will be value of 44th CAA which says Art19 can be taken away only when emergency is been declared on the ground of external aggression? Or Is that all means even after using Art159(which says suspension of other FR's except Art20&21)govt can't take FR's guaranteed under Art19 in case of internal emergency (NOT external emergency). ANY ONE PLEASE🙏🙏💓???

Article 359 kheta hai... Ki president through presidential order suspend kar sakte any FRs except 20 &21.... Toh article 19 bhi kar sakte.... Difference yeh hoga ki article 359 me president ko pura batana hoga ki kab Tak yeh koi article suspend rahega.... Aur article 359 me order ka approval chahiye from both the houses.... Toh agar internal issue se emergency lagi ho toh population ko control karne ke liye article 359 ka use ho sakta to suspend atricle 19 taki law and order phir se maintain ho sake .......

Article 365- when the President is satisfied that a state is not following the constitutional provisions or failing to carry out its duties as per the Constitution. Article 356- when the state government is having trouble with running things properly, like maintaining law and order or having political problems.

Both of them are the grounds to promulgate president rule in any state 356 says if president is satisfied that state can no more continue as per constitutional provisions on basis of report shared by governor or he himself is satisfied so, he can impose presidents rule 365 says if centre give any directions to state and state fails to follow these,even then president rule can be imposed Here president means PM+Council of ministers, president works on advice of them and he himself can’t promulgate these ordinances
