As someone who, while not a gun “expert”, has experience in shooting, Hannah’s account of the series of events leading to the shooting actually clarify a lot of the “how could this possibly happen” questions that I had. I don’t know that I buy the theory of sabotage, but the negligence of not informing the armourer before continuing the scene, the shocking negligence of pointing even a prop gun in the direction of a person etc. are all important facts.
@merriewicuna5370

"pointing even a prop gun" was a real gun. I was confused on the fact that a "prop" gun was anything from a real gun down to a rubber gun, why are they all called prop guns. Found out that prop is just short for property, as in anything that isn't part of the set is the property of the film production. So anything anyone holds or wears on a movie is a prop. Just wanted to clarify, because I know I was confused, and when I heard prop gun, I thought it meant that it was a gun that could NOT fire, so how did this happen?

They were shooting live rounds on a movie set during breaks! Lots of different types of ammonium for several types guns. The armourer didn’t do her job. The prop master déferrés to the armourer to make sure the gun is completely clear. She didn’t.

Emily, Whenever I first listened to this and you read that the set was gun heavy and you retorted, “well if it was gun heavy why did you have her doing two things, that’s ill advised,” I yelled BECAUSE THEY WERE CUTTING CORNERS! Production wanted to save money by having one person do two jobs. Wear multiple hats! That’s it. I’ve done it personally and it’s exhausting - so I can’t imagine one of those jobs being Armorer. Its important to remember that standard procedure for placing dummy rounds in a revolver for a scene require that EACH ROUND be tested AS ITS LOADED by shaking the dummy round and listening for the telltale of rattling bb's instead of the silence you get from a round that has powder. dummy rounds used on set NEVER are just empty because it can lead to a fatal accident (like Brandon Lee in Crow). So even if five thousand boxes of real live ammo were forced into the armorer's hands, there is still NO EXCUSE for loading a live round into the prop gun. Maybe someone did try to sabotage and slip live rounds in, but standard procedure requires two people to observe loading each round, so at least two people would have to be in on it, usually its the armorer and the AD or a prop person, or any other one of a few key people in trusted positions.

@@markgado8782 As a medical professional, that seems... stupid. Of course I'm not familiar with the rules of filming, but I'd say the risk of dying from gunshot takes precedence over Covid. Especially if Covid precautions are observed (masks, isolation, routine testing), the Covid risk should be low enough. Yes limiting the number of people is one of the most important Covid restrictions, but not including the armorer in the list of essential people in a scene with guns is a huge oversight IMO. Also, if she can't really be in the room, I can think of a few ways to circumvent the situation without sacrificing gun safety rules. For example, she could be examining the bullet and loading the gun outside with AD, than have the AD and another approved person bringing it into the filming area, and the armorer could be observing via video call. I'm not saying this as a knowitall, btw, I'm just thinking outloud and this is just my way of saying that NOTHING ABOUT THIS CASE MAKES SENSE.

@@inkasaraswati7625 The problem was that 1) They were asking Hannah to do two jobs and the other job was as props assistant - so she was needed elsewhere (and that's where she was when the gun went off) and 2) that Video Village (the CCTV system) was down. Video village was normally on all the time and that allowed people off set to see what was going on where they were filming - so that the depts would know when they were needed. When the crew that quit the job the previous day left, they switched off Video Village and on the next day when the incident happened, no one could see what was going on. In both cases - Hannah having two jobs and the crew quitting and switching off Video Village - it was down to the producers being cheapskates and not providing the correct amount of money for the job.

Sarah and Nicole were extracting the guns from the gun safe when Hannah arrived on set at 06:30. This was very abnormal because it was usually Hannah that was first there. The box was on the prop table and Hannah asked where it came from, as she had been waiting for a box of dummies all week. Sarah didn't answer and Nicole giggled. Sarah was the girlfriend of Seth Kenney who ran PDQ Prop. They'd supplied the guns and were supposed to supply the dummies for use on set. Hannah assumed that Sarah had brought them to the set from Seth. All three girls sat down to load the guns that were being used that day from the ammo in the box. They checked each round for the BB rattle before loading them. We now know that there were EIGHT live rounds in that box. Which suggests that the live rounds had BBs in them to fool the armorer that they were dummies.

@WOTArtyNoobs
@WOTArtyNoobs 3 жыл бұрын
This is the theory that I've been postulating. Seth Kenney has a disagreement with Hannah over Sarah's negligent blank discharge. Says accidents can happen. Seth supplies box of dummies with a few live rounds in there in the hope of causing another negligent discharge. He might have assumed that none of the guns would be pointed at anyone when discharged - as standard movie practice is to aim away from target. He probably hoped that after said negligent discharge - Hannah would be fired. Instead - he sabotaged the ammo box and led to someone's death. He blames Hannah - then asks Hannah to blame Dave Halls for the incident Then he shows up on set after the accident and accesses the gun safe - even though he's not supposed to have the combination to the safe - yet claims that Hannah bought it from him!

@@MrNorker77 Quite true. The armorers job is very specific and if things go wrong, then the blame comes back to you - EXCEPT where someone deliberately sabotaged the rounds to fool the armorer. I've discussed this case with the other online lawyers and it appears to me that Hannah's lawyers have laid out this legal claim as an explanation of how Hannah was deceived and by whom. Every round that was loaded into the guns was checked for the BB rattle, so the live round that killed Halyna was sabotaged by having BBs in it. That's what the lawyers are suggesting. The one key factor that works against Hannah is that she should also have checked the primers too. After the incident, Hannah asked Sarah to check the box that came that morning and she came back (rather quickly for Hannah's liking) to say that there were seven live rounds in the box. So the eighth round must have been the one that killed Halyna. I suspect that Sarah just checked the primers rather than shaking each round for a BB. The Police later said that there were live rounds all over the set, including in Hannah's fanny pack. The question is how did they get onto set?

I live in Albuquerque, New Mexico so I unfortunately have the upper hand of being a local with this news and I'd like to add something. New Mexico is in the top 5 poorest states in America. Crime rates in NM are dreadful. Human trafficking is a big issue here, drugs are a plague and crimes involving weapons and guns are an everyday occurrence. I am absolutely not surprised in any way that an event like this would occur at a NM film sight. I personally don't have much faith in the criminal investigation turning up anything substantial. Again though, I live in Albuquerque not Santa Fe (only about 45 minutes away) so I'm sure things are different up there since there are richer neighborhoods there. IF any of what Hannah is now alleging is true, I can see how it would be easy for someone to sneak in live rounds. I don’t see how any of this absolves her of her responsibility. I would guess a prop masters job is to ensure the safety of all the props under their control. Being so she is responsible to check the prop gun is clear of obstructions, then is loaded with however many blanks as is needed for the scene (going as far to verify they are blanks) and finally escorting said firearm to the actor personally so that no one else but the actor has control of said firearm. So let’s just take her on her word and a box a live rounds made it on the set, if she checked the ammo before loading the firearm she would have caught it. Edit - I don’t know what “wonky” blanks or dummy’s they were using but I have seen blanks and dummy’s before, there is a visible difference between the two… namely a live round has a bullet in the casing. So this shaking the round to make sure it was a dummy or blank isn’t needed if they have two eyes. Also I would assume that when you are dealing with firearms it should be like handling pyrotechnics. It should be a regulated environment. If a mystery box of ammo shows up it should be considered live rounds until it each round it checked. Hell even then I would say if the box is not catalogued and logged then it will not be used.

Not if the person who set her up also ensured that she was so overworked that she couldn't be everywhere at the same time. The AD actually told Alec the gun was fine. Jake's right. Hannah was overworked and that was apparent in the communications. She could not be in two places at once and if there was a negligent discharge with a LIVE round, then Hannah would have been fired from the production immediately. The person who put those live rounds in amongst the dummies did not expect that the guns they were loaded into would actually be pointed at someone when discharged. Standard movie practice is to aim off target. If that had happened, then the round would have discharged and hit the wall or something other than a person.

@@galaxys6071 There's no record of any 'Plinking' as reported in the press. There were training sessions by Hannah - but the press made up the story that she brought live ammo to the set for the crew to plink. The crew that quit the set did not leave due to the firearm incidents - they left because the production would not get them accommodation closer to the set. They were having to drive too long to get to their hotels and when you take into account the long working day (normally 14 hours) there was not enough time for them to eat and get sleep before returning. The crew did mention the incidents - but these were the BLANK rounds fired accidentally by Sarah and Baldwin's stunt double. Not live rounds - BLANKS. There were only TWO incidents. There was not enough dummies for all the guns and ammo belts in use. Seth was contracted to supply those rounds and he'd not sent any all week. When Hannah showed up on time that morning, Sarah was already there as well as the box. Sarah was Seth's girlfriend and Hannah asked where the rounds came from, but Sarah did not answer and Nicole just giggled. Would seem to me that Sarah not replying indicated that they had come from Seth. There was no 'bullet fairy' dropping off boxes of ammo and Seth was supposed to send the dummy ammo, so Hannah just accepted that Sarah had dropped them off when she came that morning.

I've said this before when it was brought up, but I'm not really sure why you're discrediting the idea of someone in the immediate aftermath of a traumatic event not fully clicking onto what's happened until they've had more time to process. Stress can mess with memory--and I'm sure lots of details didn't register to him as it happened or immediately after, if he was in a state of shock. We can't fairly speculate on what he thought, or how long it took him to figure things out. Personally I think he acted out the recoil, AS it recoiled, so it wouldn't have been felt as strongly, since he was going with the motion, more or less. Add to the fact everything that was going on at that same moment, I don't doubt he was too distracted to really notice or realize at the time. But again, we can't really know how it went down from his perspective.

Just thought I would give a little insight into why Alec might not have detected the "kick" of the live round vs the blank round. There are special live rounds for the gun Alec used called "Cowboy Loads". Basically, these are live rounds but with less powder in them, thus producing less kick. They are used mostly for the shooting sport called Cowboy Action Shooting. This is most likely live rounds used in the Rust shootings. The heavier, standard pressure 45 Colt rounds are really only used for killing 4 legged or 2 legged critters. Here is the thing. A live 45 Colt "Cowboy Load" round from a steel framed gun like the on Alec was shooting has significantly less kick than your typical 9mm or even 38 special. If really feels like a lighter push vs the noticeable recoil of a typical Glock. The first time I shot one, I was actually surprised at how light it was, and I have been shooting handguns A LOT for years. I can't guarantee that is what happened. I am just offering a possible scenario.

She thought that the chamber was dirty, so she put the round back in the box and left five rounds in the gun - a Cowboy load - with the hammer on an empty chamber. It's possible that the sixth round - the one that failed to load - did not load because the round was not completely circular. When you remove the projectile from a round (dummy or live) you can bend the brass case at the end. It's very easy to do. I did it when I was 14, creating bangers from .22LR. Suppose that someone took the projectile off a live round to insert a couple of BBs and then reinserted the projectile, or put the case and projectile through a reloading press - as you would when creating Dummies or Live ammo. The live round would have BBs and rattle like one, but would have powder and a live primer. The hole and a spent primer are the best confirmation that it's a dummy. The sixth round that Hannah loaded (for the extreme close up) did not have a hole, but she rattled it before loading. She also went through the checks with Halls when she handed him the gun and asked him to call her when he handed the gun to Baldwin. He forgot to.

I believe I read about the issue between Hannah, Seth and Sarah in a news article last year…can’t recall the outlet or outlets which reported this. They even reported the text messages…

I would imagine that Hannah's attorney has their own investigators. They may know some of this through their investigators?

Right at the get-go I knew how this happened. They all spilled the beans of themselves. Hanna, who had an ear-piece in was being yelled at while she was shaking the round on her way to the church. She didn't hear that it "did not rattle". She also had a sever headache. This was simply an incident that was to happen. The entire crew/set was way too comfortable and trusting. This is where "check and recheck and RECHECK" is a MUST.

Also, isn’t it common that the guilty party in a crime tries inserting themselves into the investigation? I.e., Seth and his company may be a liable party in the live ammo appearing on the set?

Hannah is coming out swinging. Good for her. Only problem is that she allowed others to override her position in the first place - that was inexperience. Imagine them trying that to a big gnarly guy!

@@waitwhat9412 I meant the first time they countermanded her (Hannah's) order. If she'd been a more experienced and possibly older, armourer, she'd have told them it was her dept and put her foot down; not that they'd try to kill her like Hoffa....

Hi Emily. I would like to know if the concept of "contra bonos mores" applies anywhere in the USA. Most NDAs are contra and most plea bargains are also just so. Kudos to the law firm for drafting this ridiculous document. Professional embarrassment

Both lawyers are former DAs like Emily. This document reads as a "Warts and all" defense. They are admitting Hannah's mistakes so that these cannot be thrown back at her in court, but they are laying out the simplest explanation of how live rounds were brought onto set. Doesn't explain why the New Mexico Sheriff said that they found live rounds all over the set though. We know there were seven live rounds left in that new ammo box, so there were eight out of fifty when it arrived. It doesn't explain why the Sheriff said they found live rounds in Hannah's fanny pack though.

Em, 45:47 the reason we know Seth had no first hand information about the incident is because we know he wasn’t on set. 😁 Also, I want to go through this lawsuit and correct all the bad sentence structures and all the terrible grammar!! There was so much context missing! How frustrating was that to read?! 🙄🤣

Another point for Alec Baldwin, even if he'd checked the bullets he couldn't have known, Just as the armorer who should have been the expert say's she couldn't have known. Please stop blaming Alec Baldwin! Innocent until proven guilty and now we see already how innocent he is!

The box that had the live ammunition, isn’t that the same box that couldn’t be found u til that day it just showed up. She shook the box and based on the sound it did not sound like live ammunition.

Oops my comment posted too soon. After the shooting session, Thell asked for his camo-colored painted bucket that he brought, filled w/the various sizes of bullets + mixed of live, blank & dummy rounds that Kenney texted Thell to bring. At the end, Thell asked for his ammo bucket back, but Seth Kenney refused & told Thell to “write it off”. Thell had also called the NMPD to inform them of where the live round may of came from & described his ammo can + what it contained, including the possibility of .45 caliber rounds. *BTW Officer Troy called Thell Guttierrez, every time Seth Kenney called him. Troy is like a best friend to Thell and when not in NM he stores his live rounds at Troy’s house and Seth was trying to get some more of Thell’s live .45 cal rounds he may of made from Troy, as Seth apparently used the 2-300 rounds that may of been in Thell’s ammo can. Seth has always been a bad movie Armorer n was jealous of Thell’s success, tho armorers really don’t make a lot of money, unless they’re doing like 8-10 big budget films w/guns. So Hannah is a threat to Seth Kenney in that area, imo. He tried getting The Walking Dead franchise by opening up a shop in GA. Yet his attempts failed & so did his prop house there. He worked for a big LA prop house but got fired for stealing weapons. Oh found out “wonky” has been around since 1920. I guess it was used more in the UK than here;/USA, until the past 5-10yrs. And it simply means or implies, something’s not quite right or adding up.

On the text messages, does it sound like Seth mentioned an "accident" in a veiled threat where Hannah used live ammo (maybe on the Texas movie?) near a horse? Did it spook the horse, or injure it? So there was a previous incident of live rounds on a movie set by accident that Seth mentions?

OMG this is my 1st time to watch one of your 1st reaction to a case/Plaintiff's Original Petition. 100% agree with you that there's a gazillion amount of hearsay in this complaint. However my absolute favorite reaction was: "Art Director Bryan took Hannah away...? I spewed my water out when you said: "Whose Bryan? He had no last name - whad up B". Almost peed my pants too. Just hillarious and I'm still giggling. My opinion - I thinking it took Alec 45 minutes to realize he just shot a live round was shock & stress. When the victims fell and he saw blood and left reality for a minute(s). Thank you for your channel. Such an enjoyment to watch. I just joined your 2nd tier member.
